Technically, you only qualify for citizenship by descent if one parent lived in the country for a certain period, even if the parent is a citizen. They seem to be operating under the old law, given the 10-year requirement. However, the current physical presence requirements are as follows: - The parent has been physically present in the United States or its outlying possessions for at least 5 years. - The parent met this physical presence requirement for at least 2 years after reaching 14 years of age.

It's because birthright citizenship is only enshrined in the Constitution for those born on American soil. Those born overseas who may become citizens at birth through a parent, receive citizenship through Acts of Congress, not through the Constitution. At the time he was born, the law that Congress had passed, stated that not only did a parent have to be an American citizen, but they had to have had certain residency requirements in the US. This would have prevented for instance, someone who was born in the United States (and so had birthright Constitutional citizenship), but then who's family moved to a foreign country (say England) when they were young (say 3 years old) and they spent the rest of their lives in England, that person who was born in the US, had US citizenship, but spent the rest of their lives in England, would not be able to pass their American citizenship to their own children because they didn't have enough years living in America despite being a US citizen.

Social Security cards have a number. The numbers will ID if you are Citizen or not. It will also say if you are eligible to work if you are not a citizen. I believe this man is a citizen but the social security has messed up. I had a problem when I was 23 and lost my social security when I got the new one, it said something to the effect , not allowed to work, which was for none USA student studying within the USA. I look at the woman straight in the eye and said, Fix it. You have my military records and my brith certificate on file. she stated, we don't keep those records. I said oh yes you do. Now look. She did and fix it and I had to wait another two weeks for the correct one. I also keep my records with my City Records deportment. That means military, legal status, and will. It's helpful in case my house burns down or destroyed or if someone at social security tries to say otherwise. The city authenticates the paper work. Many people don't do it because records are publics but at the end of the day. I rather have my paperwork authenticated and if I ever need something. I can get a legal copy.

There are other requirements involved, including, as mentioned in the video, that the parent with citizenship has to reside in the US or it's territories for a specific period of time prior to taking residence in another country.

Back in the '50s and the '60s it was very easy for Canadians to come to the US without showing any proof of citizenship. Social security cards can be easily fraudulently manufactured and hand it out like candy. Social security administration has no record of his number ever being in their system nor does the US immigration have any information of his status. But what is true at the moment is he is an illegal living in the United States, voted unknowingly or knowingly in American elections. That is a federal offense, voter fraud.

(I have to double check on stuff, but you will get the idea) Because of the Great depression and because of how the US wanted to avoid something like that happening again in the future they decided to collect money from people and then just give it to them later. Which is why at the beginning SSN were not that specific and were even in numerical order. There was a point in time that you could figure out what state someone was born in based of their SSN. There is a whole complicated history with it. Now comes the part that you are asking for. And that's that no there is no central way to find out who everyone is in the US. Thats why your SSN has become such an important thing to find out who you are. Even though that's not the point of the SSN, this has to do with who in the US you don't have a national ID, but rather you have a state ID and how do you get a state ID? You get it with a SSN, I believe that there is other stuff so not every state requires a SSN I think? Part of this is because supposedly the US thinks it's a bad idea to be able to track people individually or something of the sort. It's just a real nightmare That likely didn't answer your question at all but you can look up videos about the history of SSN and some of the stuff I just said will be mentioned in those videos.

I can do you one better. My dad was home birth in the US in the 1930. Back then you don't even need to register it and he had no birth certificate from the state, only with the detail (like photo and the name and the registration of the midwive etc), so when it come time to register his birth, they can't remember the day he was born, only the month and a year, and he was given a birth certificate (IIRC in the 60s) with only a month and a year and it also appear in his passport without the day. And then in early 00s after 9/11, the government send him a letter asking him to declare his birthday and they change his birthday by deed poll and they just randomly gave him March 31 as his birthday...

In most states, you can just start using another name any time you want, and that becomes your name. Having a legal name change document makes things a lot easier though. So when congress was writing this law back in the old days they put in a residency requirement that has stayed in but has changed over the years. The concern was that since the US has always at least allowed dual citizenship by birth, we want to make sure there isn’t an island of accidental Americans somewhere where a bunch of Americans moved, had children who had children who had children etc but never came back. As such, if two of your parents are citizens only one of them has had to live in the us at some point for any amount of time. If only one parent, the law used to be like 10 years. I think they’ve shortened it to five now?

Even with 4 medical doctors and 4 therapists saying I had PTSD the government rejected my claim until I got a lawyer. I am a US veteran and I was a black out drunk for 10 years, the moment I admit I have a problem the government wants me to relive my past 10 times before they reject my claim then change their mind when I have to pay for a lawyer. "Support our troops," they say. I don't even have a speeding ticket but a veteran with 9 years of honorable service after being out for 10 years and after I pushed myself to vomiting at every civilian job I had because I don't know how to work slow or be lazy now wants to defraud the government?

In the military if I went to therapy I would have lost my clearance. You are one of those people who sit next to hard workers and say "slow down" aren't you? Passport cost dude. I have 3 citizenships, I was born and raise in the US, immigrate to Australia while my mother was British, I can get a 4th if I wanted as my dad is of Mexican descent. It cost me $1000 every 5 years to renew all 3 of my passport and associated document. Also, if you have multiple passports, you need to be aware which one you use to enter what and then which one you use to come back. You are supposed to use the country of origin to enter/exit that country, (US Passport to leave and re-enter US, Australian Passport to leave and re-enter Australia and so on) so the record would show. You are F'ed if you forgot one passport when you travel. For example, you can't enter US with an Australian passport without a valid US visa, they will put you in a room and actually may deport you (Yes, the US immigration can deport you even if you are a US Citizen) if you do not travel with proper document.

But still, the cost to renew everything is just too much, and I just use my Australian passport to gain entry to the UK since they have visa free travel (as they both in the commonwealth) and I think my British Passport expired a decade ago.

No, you don’t get your money back. Why would you think you would? By the way immigrants also have to pay taxes and won’t necessarily get Social Security. And no, it’s possible to serve in the US military without being a citizen. And it will not earn your citizenship.

his dad was ALWAYS the issue. To claim US Citizenship by descent. The American parent need to live in the US 10 years before the person was born (back in his day, now it's 5) If he can't proof that his dad lived in the US for 10 years (like showing them tax record, high school record and so on) he cannot claim Citizenship by descent because he is not eligible for it. The fact that he moved from Canada to the US at a very young age is not really a point here.

@@cosplayshop But the Marines appeared to accept him. I know at least if you join the Army, the Army had a program to get your citizenship if you served. I really don't know the specifics. But it's kind of crappy that the guy served in the Military and the USA deems him "technically" not a citizen. He worked and paid all of his taxes. Would Canada have to accept him? No matter what the law is, you could have a man without a country. But what do I know?

And the draft was still in place and they draft everybody for Vietnam, not just citizens, a corpsman friend of my dad who served with him in Nam was a college student from Netherland, he was drafted when he was on a student visa, you are require registering for the draft if you are of certain age and in the US, even if you are non-resident. And you still do that today for selective service Non-citizen can gain citizenship after they serve, but then you would need to apply for it, if he thinks he was already a US Citizens, he won't apply for the change of status. On the other hand, the man has a Canadian passport, so he can go back to Canada no problem, but he would have nothing in Canada and have to start over again at 66. But I seriously doubt CIS is going to deport him to Canada.
