Never forget he was a good friend of Big Mike Obama MRS. OBAMA: I want to start by thanking Harvey Weinstein for organizing this amazing day. (Applause.) Harvey. This is possible because of Harvey. He is a wonderful human being, a good friend and just a powerhouse. And the fact that he and his team took the time to make this happen for all of you should say something not about me or about this place, but about you. Everybody -- we are here because of you. Whoopi Goldberg, Naomie Harris, Ryan Coogler, David Frankel, Blake Lively -- all of us are here because of you. And of course, my dear friend Gayle King is here. We are here because of you. Actually, it is not a bunch of crap. Weinstein is still guilty. The New York Appeals Court is not saying that Weinstein is innocent. There was just a very real and obvious error (an inexcusable one) by the prosecution during his New York trial. Weinstein is still in jail in California. He is not going anywhere, though he does need to be re-tried in New York. But he is still guilty, and he will be found guilty again in the second New York trial. Stay cool, everyone. Justice actually is working.

I'm confused... growing up in NY.. I was a model and the casting couch was a real thing... you had to sleep with photographers, booking agents, and everyone. This is why I stopped modeling. Everyone was doing it. So, they need to go after the entire industry. Also, this was 30 plus years ago. This is why we have the statute of limitations. The women should had come out 30 years ago... with a rape kit and drug test. But, to come out and its his word against yours. That's why I didn't buy Cosby's case... out of sixty and Constance.... who was his girlfriend for two years... had zero evidence. Zero! That's why Cosby's case was vacated... it should had never been tried. Period. Hundreds of thousands of black men were lynched without a trail on the word of a whyte person... then the black persons land was stolen over a false accusation.... this tactic is old as time. This is Whyte Justice.

To suggest that the women involved in the Harvey Weinstein rape trial are to blame for their own victimization is not only deeply misguided but also perpetuates a harmful narrative that shifts accountability away from the perpetrator. Blaming victims overlooks the fundamental dynamics of power and control that are inherent in sexual assault. Harvey Weinstein wielded immense power in the entertainment industry, and he exploited that power to coerce, intimidate, and manipulate his victims. The argument that the victims "offered themselves up" ignores the reality of how power imbalances can be abused to exploit others. It is critical to understand that consent obtained through coercion, threats, or manipulation is not consent at all. Furthermore, victim-blaming attitudes contribute to a culture of silence that discourages survivors from coming forward. It perpetuates a cycle where perpetrators are not held accountable for their actions, and justice is denied to those who have been wronged. It is essential to challenge and reject any narrative that seeks to shift the blame from the perpetrator to the victim. We must support survivors by acknowledging their courage in coming forward and affirming their right to seek justice without being subjected to judgment or blame. Such attitudes towards victims not only fail to address the root issues of sexual violence but also hinder progress towards a more just and respectful society.

It wasn't money that got him off, it was having testimony given against him, allegations made that went without an actual charge (basically heresay), to establish his character in a negative light and to embolden other witnesses in their own given statements - in short, whether or not he is actually guilty of the charges facing him in regards to the trial involving those three women, he wasn't given a fair trial. The judge demonstrated prejudice against him and that was the trial's undoing. He's still in prison for the other conviction but they'll have to try him again for the case involving those three women and it opens up an opportunity to seek a retrial for the initial conviction. Just so you all know, he's still in prison while this is all going on.

Hold strong girls!!! I know how hard rape cases are to prosecute, and have been victimized myself, so I know how important this is! The holding was that he did not get a fair trial. And if you believe in gender neutral laws I hope that you can see this ruling as that. New York has a rape shield law, where prior acts of the victim (i.e. being "easy") are not admissible on the grounds that consenting to sex before does not have any bearing on consenting to sex in the alleged rape. New York is merely applying this shield law in a gender neutral fashion, and equally to defendants as well as victims. In other words, just because he raped before does not necessarily mean he raped THIS time. I know that the me too movement was not just about one rape - it was about his career full of bad behavior. It was a topic of conversation in the industry long before the story breaking. But the way the law works, rapes are prosecuted one at a time. As for the court's ruling based upon legal strategy, in this way it was novel as that strategy was an accepted and viable strategy at the time the case was tried, so I don't think we should really see it as an error of strategy. The court is merely announcing, today, that said strategy is an error. The challenge for the prosecution in the retrial will be to figure out what strategy is viable. Despite what is written above, it is a well known and statistically supported fact that the majority of rapes are committed by repeat offenders that get away with it because of this crime has the highest dark figure of all crimes in the US by miles. So, in reality, the fact that a perpetrator has previously raped DOES make it more likely that the present instance was in fact a rape. So.... how to deal with that? One strategy is to call Weinstein to the stand and ask HIM to comment on all the other accusers.

FEMALE JUDGES:: "“We conclude that the trial court erroneously admitted testimony of uncharged, alleged prior sexual acts against persons other than the complainants of the underlying crimes,” the court’s 4-3 decision said. “The remedy for these egregious errors is a new trial.” The court’s majority said “it is an abuse of judicial discretion to permit untested allegations of nothing more than bad behavior that destroys a defendant’s character but sheds no light on their credibility as related to the criminal charges lodged against them.” In a stinging dissent, Judge Madeline Singas wrote that the majority was “whitewashing the facts to conform to a he-said/she-said narrative,” and said the Court of Appeals was continuing a “disturbing trend of overturning juries’ guilty verdicts in cases involving sexual violence.” “The majority’s determination perpetuates outdated notions of sexual violence and allows predators to escape accountability,” Singas wrote.
