The pliers were tested by the States expert and, tests that Kyo conducted were negative and the pliers were too rusty to have been used in any commission of the crime according to the States expert. That testimony is available. Constance Fisher Preliminary Hearing October 29-30, 2003 Summary The hair found in Scott's pliers is important to the prosecution to link Laci to Scott's boat. Fisher explained the difference between mitochondrial DNA and nuclear DNA. FBI analysts compared the hair found to one of his blood samples and to DNA on a test swab designated as "SR2," obviously from Sharon Rocha, as mitochondrial DNA is passed from maternal relatives. According to Fisher, the hair did not match Scott's blood sample, but did match the SR2 sample. Because everyone in a maternal line carries the same mitochondrial DNA, it cannot be used as an unique identifier. 1 in every 112 Caucasians would be expected to have the same DNA sequence, as would 1 in every 159 Hispanics. Mark Geragos challenged Fisher’s qualifications. Under questioning, Fisher acknowledged that she had never testified in California state court and that this was the first case where she was testifying about the admissibility of mitochondrial DNA evidence. He never said what he was fishing for. So what large fish are you talking about? He called Sharon's and asked if she was there or if she had heard from her because he believed that is where she was. Sharon said " NO" . So at that point she was missing. So she told Ron to call 911 and Scott went go talk to the neighbors and search the park. The 5 anchors he made, 1 for the boat and ? other 4. Laci was missing head, arms, legs. Then he admitted on Tape to Amber that he told her he "Had lost his wife"(2 weeks before she went missing) That smacks of premeditation.

Laci knew about the boat. "Scott had told the police that Laci knew about the boat and that she had been to the warehouse on December 20, 2002. Detective Brocchini was told about an eye witness who confirmed seeing Laci at the warehouse (where the boat was stored). When he heard about this witness in August of 2003, he purposely left it out of his police report. While under oath during the trial, he admitted to excising the information from his police report and acknowledged that he did not think it had been reported by any other officer. This woman later confirmed that Laci was at the warehouse on December 20, 2002. This situation confirmed that Scott was once again being truthful. It was Detective Brocchini who had been deceptive. Guy Miligi told police on January 4, 2003 that he and Scott had discussed purchasing a ski boat together prior to December. Jodi Miligi told police that Scott discussing a boat one to three weeks prior to Thanksgiving. Brian Ulrich told detectives on January 4, 2003 that Scott had been discussing buying a boat for over three months. Scott withdrew the $1400 from his joint checking account with Laci. Also, Scott did not try to hide his identity from Bruce or the DMV. Scott gave accurate information to Bruce including his home address. This information was filed with the DMV on 12-9-02. Another boat Scott looked at on December 8th was not registered with the DMV, so Scott decided not to purchase it. It was also the sellers request that Scott pay cash. He made one anchor. Do some GD research and read the trial transcripts. They did not find cement anchors in the bay even though the State alleged he made 5 anchors. These alleged distinctive circles that Brocchini said were on the trailer resembled rectangular shapes from cement bags from work he did at house in September. The pitcher the prosecution alleged Scott made the anchors in didn't even fit. Geragos: "I've got a sixth-grader -- that looks like a triangle to me." Hendee: "If you look carefully ..." (Prosecutor Harris objects) Delucchi: "The jury can see it. They can draw their own conclusions." Geragos: (pointing to various shapes) "Is this a circle? ... Is this?" (Harris objects repeatedly) Delucchi: "Sustained, sustained, sustained." Geragos: "Ever go out into the fields where they have those circular patterns?" -CEMENT DID MATCH THE SAMPLE IN THE DRIVEWAY CONCRETE EXPERT GEBLER: Yes. In our sample we found fly ash, cement, pea gravel and sand, similar to what was described by Mr. O'Neill. GERAGOS: Does that mean that the cement that was used in the anchor and the cement that you've collected here and the cement sample that you also observed, does that mean that they all are one and the same? GEBLER: They're all consistent. They all have, they all have all, from what I saw, the, the, the anchor and these materials are consistent with each other. GERAGOS: What does that mean? GEBLER: With the concrete. GERAGOS: You say they're consistent. Does that mean they have all the same components? GEBLER: Yes, sir. Scott lying to Amber. Selective, considering he lied about everything, but we are going to believe he's not lying when he tells a fling he lost his wife. So, how was Scott Ever going to break it to Amber that his wife didn't die when he said she did, if he intends to pursue Amber? If he wanted to be with Amber on Christmas, New Year's, he would have never made an excuse , as he did ,to not be with Amber on Christmas throughout New Years . He purposely made up that excuse so that he would be with his wife. Scott made up these lies to not be with Amber, and to be with Laci, is because he indeed planned on spending the holidays with Laci. So, he's a prolific liar but he's telling the truth to Amber LOL. The same women know for a fact he lied to over and over again.

Police failed to follow up with them. Grogan excuses the MPD failure to follow up on tips by citing Karen Servas’ 10:18 timeline for finding McK. Even if Karen Servas’ timeline were accurate, which it is not, MPD did not have information about her reinvented timeline until January 3. The detectives did nothing to confirm that her time source was valid. PWC "Grogan also says tips were not followed up because phone records indicate that Scott was still in his neighborhood at 10:08. This theory did not take shape until shortly before trial. Two prosecution witnesses stated that cell phone records were not designed to be used to identify location. Grogan also uses the excuse that tips were not investigated because witnesses reported Laci wearing black pants and her body was found wearing tan pants. MPD did not have this information until mid-April when Laci’s body was found. Then Grogan indicates that sightings outside of the park were discounted because Laci was planning to walk in the park. This is blatantly false and Grogan knew it. Grogan had been present on December 26 when Chris Boyer interviewed Scott Peterson at his home. Scott clearly stated that Laci sometimes walked in the neighborhood. He told Boyer, in Grogan’s presence that Laci had walked on Sunday, December 22, in the neighborhood."

What convinced me that he did it was when he told the cops that Laci and him were watching the Martha Stewart show and he went fishing instead of playing golf, because it was too cold to go play golf, but fishing in the bay wasn't cold but playing golf was way more colder than going fishing in the bay where the weather is more colder than a golf course. Scott is clearly guilty but I don't believe Amber Frey. There's a lot of information that heavily suggests that she knew he was married well before the date that she claims. The police, likewise, were pretty suspicious of Amber before the bodies were recovered because she was having communication with Scott that bypassed the wiretaps and lying to them about. I don't know what it means or if it supports my suspicions, but I find it kind of strange that she retained Gloria Allred to represent her when she was, by appearance at least, *merely* a witness in the case. Her many different accounts of the circumstances by which she came to call the tip line doesn't help her. Neither does her frankly odd relationship to Det. Byrd. I'm not accusing her of anything and I think this was glossed over during the trial because it would undermine the state's case.

I suppose I must have sympathy for Scott's enabling family, but I just can't bring myself to exonerate their denial of his obvious guilt. They end up becoming purveyors of lies and justifiers of pregnant-wife killers. Severe family dysfunction is often what socializes these psychopaths. There's usually something going on in the family that at the very least misses or misinterprets the signs and possibly were in denial even then. Look at the mother's history, it's very strange and unaccounted. She had two illegitimate children who came out of the woodwork years later. Clearly, this woman was not in control of her life or life's choices very early and kept repeating the same mistakes. I'm not blaming her for Scott's adult crimes, we are all ultimately responsible for our own behavior. But his family's subsequent behavior points to this tradition of denial and emotional dishonesty that Scott grew up with.

Sadly, I think it had nothing to do with Amber. If you look into how he was raised and the family background, this was about protecting his image. He had cheated on Laci twice before. The first time right after they got married in '97. He was found out on December 9th by the person that introduced him to Amber that he was married and confronted him. He begged that person to let him tell Amber the situation and that's when he told Amber that he had lost his wife and this is his first Christmas without her. He knew that he only bought a little bit of time before they dug deeper and found Laci and end up exposing him themselves so he had to make the story true. She caught him red-handed the first time, and didn't tell anybody nor did she tell anybody about the second time. But he knew he wouldn't have the third time's the charm luck. This time it was different because she was 8 months pregnant and he was afraid of falling from grace from his family, her family, and Amberband her friends that he just met. He couldn't stand the thought of being the guy that no one liked or being seen in a negative light. He was "The Golden Boy"
