I’m a small govt type person myself but it’s situations like this that the federal govt should be able to intervene in. The US justice Department should be able to take the state to federal court and if sufficient evidence is shown that a person is innocent a new trial should be immediately ordered or release the person. An innocent person in prison serves no benefit to anyone. The murder victims family has not received justice and it’s a true disservice to the wrongfully accused. That was a great statement he made about how the US would lecture and sanction other countries for the very same thing…

No motive was established. · Chris' public defender did not present any evidence in his defense, though he had seven alibi witnesses and had been on the phone at the time of the crime · The jury deliberated for 42 minutes before returning a guilty verdict, and Chris was sentenced to life without the possibility of parole, plus 90 years. · The young boys, now men, have both recanted their testimony, explaining that they didn’t see who fired at them and hit their friend, but decided to say it was Chris because they didn’t like him. · Based on the recantations, and more witnesses and other newly discovered evidence of his innocence, Chris was granted an evidentiary hearing in 2018. · The hearing’s revelations included that the victim, his brother, and a couple of friends had severely beat a man the day before the crime. A couple of months later, the victim’s brother was also shot and killed. The possibility that both boys were killed in retaliation was never pursued. · 25th Circuit Judge Hickle deliberated for two years and three months after the hearing. In 2020, he issued an order stating that Chris had demonstrated his innocence with clear and convincing evidence, and NO JURY would convict him now - but the judge couldn’t release Chris because he wasn’t on death row. · The judge blamed the 2016 Lincoln v. Cassady case, which said that even if a person proves their innocence in court, they cannot go free unless they have a death sentence - or can prove a constitutional violation in addition to their innocence. · In 2006, Joe Amrine was freed from death row when he proved his innocence before the Missouri Supreme Court. The Amrine v. Roper case thus provided a path to freedom for people who prove their innocence. · In 2016, Rodney Lincoln brought his innocence case before the Western District Court of Appeals. Judge Cynthia L. Martin ruled that even though Rodney Lincoln had proved his innocence, he wasn’t on death row like Joe Amrine had been - so she didn’t have to release him. Judge Martin grossly misapplied the law. A proven innocent person should be freed regardless of their sentence! · Missouri is the ONLY state with this kind of law. · How is it that such a court precedent can exist in the United States of America, or anywhere? · This is insanity. Also I was called to jury duty about 6 months ago here in my state. I was interviewed for jury duty as I was a potential juror and I said Point Blank I do not take any witness testimony whatsoever if there is not compelling DNA evidence or unedited video I will never take the word of any person police law enforcement or civilian I will never trust anybody's word that statement got me off of jury duty

Skepticism is a good trait for a juror, but if that goes to cops too, that's a deal breaker. Prosecutors depend on jurors with blind faith to law enforcement, and will weed out potential jurors without that.

The Missouri State Legislature should get its act together and legislate a remedy to this problem. It is shameful that the legislators, governor, and state attorney general failed to solve this problem years ago. Though law can present very complicated issues, rigorous analysis can lead to legitimate and workable solutions. To the Missouri State Legislature, governor, and attorney general: "Stop failing at a moral and ethical level. Demonstrate some integrity. Innocent individuals, justified by substantial evidence, should not remain imprisoned. Solve this problem." To the imprisoned persons' attorneys: "Carefully research federal substantive and procedural due process cases. Missouri's prohibition against release, despite a factual basis for vacating a judgment, implicates due process protections. Perhaps a federal lawsuit seeking habeas relief, a declaratory judgment, or injunctive relief may provide some relief."

I wouldn't count on it. For two years, Senate Bill 1201 was introduced to allow innocent claims to be extended to inmates with life sentences, but for two years, that bill hasn't even made it up there for debate let alone getting passed.
