- Also, accusing someone of a crime that they have not committed is "defamation per se". Briefly, that means you don't necessarily have to prove monetary damages. - Some states require the defamed to issue a demand for retraction/removal/apology, before a suit for defamation can be filed. However, it can be unwise to include a threat that you will sue if they don't comply. The reason is that a threat to sue leaves you open to be sued for 'declaratory judgment'.
