Excellent lecture by Sr. Adv. Aiswarya Mam. Thanks. Yet there is a conflict between S-31 of POCSO Act and S-167(2) of Crpc. In pocso cases default bail is not granted in Tamil Nadu by POCSO Judges. Reason stated is that they are not Magistrate Courts. They state Magistrates have only such power. So accused are in judicial custody even beyond 100 days without charge - sheet being filed. Mam, What is your opinion here? Magistrate court is not a remanding court in pocso cases. Why remanding court has no power for default bail? Please clarify. For Rao Garu --- It is "Protection of" and not "Prevention of" Thanks.

POCSO act is one of the worst and poorly drafted law and highly vulnerable to misuse. Anybody can file a case under that against any man and without evidence the man is arrested and in jail indefinately. So personal scores, business disputes, property matters etc are all settled with POCSO. just file a case against any man you don't like and his life is destroyed. The law is also used as a tool of harassment, humiliation, blackmail and extortion. Not to speak about the 50 laws that favour women who are also anti men in nature.

It has completely changed my life for the worse, I have suffered alot because of this poorly drafted law was trys to secure minors from sexual offenders but completely overlooks the very high possibility of false accusations

Any law that can't differentiate between culprit and innocent will be rendered useless because of the misuse. I don't expect these lawyers to have such naive thinking. The very purpose of the law to punish the real culprits. If the law has a potential to harass innocent, it becomes legal terrorism. It is laziness on the part of law makers and failure of the system that can't come up with a law that can punish culprits with proper safeguards. Really pathetic argument in the end 7 minutes. It is disheartening to see so many likes on this video. Where our youth is going? No one has IQ to come up with proper law? is our society so dumb?

You can directly cross - exam the victim through the judge. The victims are normally juvenile. Hence it is done so.

POSCO act is a new business tool used by disgrunteled parents & teenage girls on men/boys. for example if thers a dispute between parents of a daughter with a neighbour for water or car parking they mentor the young girl to allege rape or molestation on the neighbour & his family. in this case the police directly files FIR on the girls statement then the neighbour is arrested & denied bail for 90days the session court will decide on the bail. when the trial happens the cross examination of girl or parents never done if done its done in light manner which is why the examination is useless. also in child custody cases the POSCO act is again misused by mothers of daughter on husband. wait for Mens Commission we will ensure this law is scrapped from law books 🙏
