For anyone saying “Shooting the guy isn’t proportional”, in a life or death situation, if you could have the upper hand, wouldn’t you want it? Never fight fair when you fight for your life.

AMEN. I am a second degree black belt in Tang Soo Do, not that that means a whole lot. But when I was younger I used to think, I will just fight them man to man, with fists, and square up. You know, the gentleman's fight. That shit is out the window nowadays. Not only are we in a different time but I now realize that I have NO CLUE what the other person's intent is. I also have kids now so my perspective has changed. I still don't carry, at least not yet, but I know I should. Regardless, if someone punches me on the street I am not going to square off like a good little boy and box, it's just not practical. If me or my family are ever threatened with violence the perpetrator better hope the cops are coming quick otherwise they aren't going to live. I don't have the option of sitting in a hospital after a beat down, or possibly losing my life. I have a family to support and protect so it's life or death regardless of your weapon or lack there of. Don't break into my house and don't ever attack or threaten me or a family member. Otherwise it's on like Donkey Kong. I am not saying that I would escalate force if I was carrying but... If you enter my house then you are dead, period. If you attack me on the street it depends, ever so slightly, what you are attacking me with. Fists? I am breaking your bones and eliminating the threat. Knife? Either we are both dead or you are. Gun? I will give you whatever you want unless I am carrying, then see the previous statement lol Okay enough posturing for me today, just wanted to get that out lmao Seriously though... Street fights aren't fair, never were, and can be just as dangerous as a home invader, don't ever let your guard down or go easy on someone, they could have a weapon, be on drugs or intend to seriously hurt you now or later, don't take any chances, it's way too easy to end a life and sadly that can't be fixed in a hospital. ALWAYS TAKE THE UPPER HAND, NEVER GIVE UP YOUR ADVANTAGE.

At that point he is considered armed and dangerous regardless of if he is or not, I have a daughter and a wife to protect and I won't hesitate even though I would genuinely hate taking a person's life. It would be awful and would probably mess me up but my family is more important than the life of the idiot that thought this was the right house

@navyeodguy16052 жыл бұрын
I completely agree with Tolman Creek as well as Walter Knight. But I would like to add something which I think is also relevant. I was a Texas Peace Officer in a small town, within a fairly large county. The county was approx 22 miles E to W; 30 miles N to S. After 6 pm we were lucky if we had 2 deputies on duty. The town where I worked as a LEO was approx 8 square miles. After 6 pm we only had 2 officers on duty; one working N and one working S. The city was almost equally split by a major highway that ran E to W, with a train track right beside it. Imagine if you will a deputy is in our area N of the tracks, and our 1 officer working N of the tracks. A deputy working south, is 11 miles away; the officer working S is a stones throw away. The officer or Deputy working S calls for immediate back up. The Deputy working S is minutes away. The Deputy and officer working N call out and start heading S. But, there’s a problem (which happened fairly often) a train is stopped and it blocks all three crossings from N to S in the city. So yeah, even LEOs needing back up in a life or death situation have fellow officers for back up……..just minutes away. Depend on no one for survival. Each one of us, in a dire situation, needs to and should be ready to defend yourself by any means available (hopefully that “any means available” is equal to or is greater than the threat in front of you). Stay safe out there folks. The world is not going to get more peaceful.

@EarnedSalvation2 жыл бұрын
Right and responsibility as two sides to the same coin is SO TRUE. you have a right to self defense, and a responsibility to train and educate yourself until you are no longer a threat to others with your weapon(s) of choice. people almost always want to focus on only one of these aspects, but without both, you don't really have either. Think, in court, if you shoot the bad guy and some innocent bystander, you still get time for one count of murder even though you just missed your target there are cases where a defender was a defendant in court because they missed and their stray round impacted property. so you absolutely have to focus on both "its my responsibility to be able to defend myself and innocent life without causing undue harm.

This case illustrates the value of stand your ground laws for the home, and the absurdity of “proportional force” requirements for self defense in public. I agree with commentators below that we need a uniform national standard for self defense in the home - if another person attempts to enter your home unlawfully, you can not only use deadly force but are immune from civil liability. Far too many instances where criminals have bankrupted honest people with civil litigation. Public is a bit trickier but I generally think our self defense laws date to a period when random violence was less pervasive, self defense prosecutions were rare, and lawsuits were also less frequent. The idea that if another person threatens you with harm, that you may only use proportional force, was invented by judges who never took a punch to the jaw. My state does not have constitutional carry and restricts permits, but I strongly believe that if you are in public and another person starts a confrontation, and you cannot easily - and I mean easily - walk away or drive away, then you should have the right to defend yourself with all tools available. Folks are not just polite in southern states because they are nice. In a society where many folks are armed and willing to defend themselves, folks have a compelling reason to avoid asshole behavior. No one should ever have to “take a beating” - to quote the buffoon who prosecuted Rittenhouse. Fights between grown adults generally result in a hospital visit if not worse.
@armsdirectory2 жыл бұрын
Couldn’t agree more! Were it knowable that all the intruder is going to do is take your TV, then you can have the argument about proportional use of force. But it’s never knowable, right? When someone breaks into your home at night you must assume the worst!
@trevort83882 жыл бұрын
@@armsdirectory right??? I think self defense laws are a perfect example of what happens when people insulated from reality get to craft the rules we live by. I was taught from a young age never to go where I wasn’t invited - particularly another persons home - not only because it was wrong, but because I was likely to end up dead if I did. When I read that Rittenhouse transcript and saw that line about having to take a beating - I was no fan of the judgment Rittenhouse used but to suggest he had to let himself risk death - is that what we have come to? Would the prosecutor say the same thing if his mother were being chased by three men and had a firearm?

I live on a very isolated rural farm. In the 36 years that I have lived here, the Sheriff's deputies have had to be call 3 times. Our county Sheriffs are top notch. But their response times to me were from 45 minutes to an hour and 15 minutes. We have taken every precaution we can afford. From infrared driveway sensors on the driveway, to sensors around the house that give a different tone. Dogs in the fenced front yard. Good locks, hardened doors, and an alarm system. Recently added cameras. OH YEAH, when I get up in the morning, my pistol,in it's holster, goes on my belt. It stays there until bedtime. If I am going to the barn , or to the back side of my property, a Mosin-Nagant rifle (7.62R) with 210 grain soft points is slung over my shoulder for feral hogs.

I had a conversation with my friend and his wife a couple of months ago about police response times. I told them that it could take 4-5 minutes or longer to get to their house. I asked her to start the stopwatch on her phone and come through the door as she usually does coming home from work. She closed the door, hung up her keys, put her purse up on the shelf, checked the mail (all of this while giggling at me) went upstairs to say hi to the kids, went in her room to change (wouldn't let me follow) and I yelled stop the clock. 4 min and 20 seconds. My point was that a burglar could make it to all of the key rooms well before they are detected and police are called. She didn't like my experiment. I hope it gets them thinking!! The man had no fear in his voice as he ordered the punks to drop their knife and the sawed-off shotgun then ordered them to lay on the floor. Both my and a neighboring department were there in about 1 minute (the neighboring department had a unit closer than my units, and we shared a dispatch frequency), and it still seemed like it took forever for the units to arrive and secure the scene.
