Almost Hits Cyclist on Bike Box

A Uber driver almost hits a cyclist inside the bike box, besides the obvious danger, is this an offence regarless of who entered the ASL first?
This driver chose to ignore the rules and invade my space, that is why I have reported him to the police for advancing into the ASL illegally.
Response from the police is standard, but this shoul be an easy prosecution aggravated by the danger of advancing into the ASL illegally with a cyclist in it.

Regardless of the action by the driver being illegal, the action of the cyclist was reckless and dangerous. Unexpectedly swerving in front of someone is dangerous. What if you got the green light just then and the car could legally continue? Or some other scenario? I would not risk my life like that just to prove a point...
