To further safeguard one's property ( which is often the biggest part of an estate) you create a Quit Claim Deed in the name of the Trust rwith instructions to file it with County Recorder and a Pour Over Will which simplifies the necessary Probate.

The lack of funding was a mistake my parents made, but only for one asset. I did have to go through probate in another state on the other side of the country to get those assets retitled to the trust. It was painful at a time that I was grieving terribly and not at my best. And it wasn’t cheap. And the estate attorney wasn’t thrilled since she’d given my parents written instructions on how to handle everything! I have taken note and learned this lesson up close! It definitely added a hassle factor!

And the number one question I have, is it too late to set up an irrevocable trust and get the five-year look back going if your mother is 96 years old? My father died five years ago, and they have a revocable trust. It’s only then that I realized their estate really isn’t protected. And I ask this because only recently I discovered that the five-year look back is prorated 20% per year. So if I could set up an irrevocable trust and even if my mother makes it to 97 before entering a nursing home, doesn’t this, save me 1/5 of the value of her house? if my mother should go into a nursing home, she may or may not have enough money to pay for the care before having to sell the house. I assume if she only lives to 99 she might have enough money before selling the house. Additionally, I am wondering what the law is in New York regarding a care giving adult child living in the house for the last five years and asking them to leave the house if our mother ends up in a nursing home. 33:55

In MS our Trust Code requires that we make publication to creditors (like in a Probate) for creditor claims to be made to the Trustee if the Trust owns real property. So now there’s at least a 90 delay in asset distribution in Mississippi.

I really like the note about "Successor Trustee" take his time after my passing. I've been working on selling my house so If my Son does some staging for the real estate sale he could increase the property value by 200K. Maybe this doesn't matter but not sure. I am working on this myself but not sure how long I can sustain the "sell the house" effort. A most excellent "agent" continues to be helpful. ~ all good. I hope to be "homeless". I could see that. What if a trust has been created without your expert input and having stumbled on these videos the creator of the trust realizes that his trust documents are woefully inadequate? How is this best resolved?

After seeing my sister and brother's behavior as co-trustees, and having heard stories from others about how easy it is for even generally "responsible" adult "children" to rationalize "creative accounting" in their favor, I will definitely be making use of a corporate trustee. My dad laid out trustee compensation intructions in his trust and they "said" they were foregoing compensation only to turn around and "pay themselves" far more via displacing a significant chunk of their tax burden on to my other sister and me. My father would be so disappointed in them.

What could go wrong with POD and/or TOD? Well, if you have a crooked family member they will get (trick) the person who has the TOD or POD to sign a power of attorney, then place everything in their own name and exclude the rest of the family.

Even cars have to be moved to the trust via DMV to avoid probate? I thought as long as you put the decision of what to do in the trust, the vehicle itself did not have to reference the living trust (EEK)

I am 70 years old with a 26 year old son who is doing well. Real Estate (my home) is my only Asset. Gotta have a plan. It could not be more simple. I think that I am blessed by this. So I guess a Will. - I hope that people that I know at the town office will help with this. Then set up the MOST SIMPLE RLT that I can. Just deed the house over to the new RLT, name my son as Successor Trustee. name my son as Beneficiary, etc. So skip the POA stuff. No probate. I have a heart condition. So I expect to just have the lights out event. You know, just a quick event. Absolutely no one else really matters. Maybe one of those letters for my son to open with "suggestions." But probably not. ~~~ Just getting my fbMP game tuned up to sell what I can now. Currently into motorcycles. Yep! Gonna RIDE WITH BIDEN ! ~those Fox News Zombies (republikkkans) ~~~ Super Yuck.... If you put your traditional IRA into your revocable living trust, it is the same as cashing out your IRA and you will owe income taxes on the full amount. You need to use the beneficiary designation as the video discusses.
