An Apology From The ICO - But It's Not Enough

Further to my previous video about the ICO (link below), the same subscriber followed up with them and they have finally admitted they made a mistake and have apologised. As I explain here, this is not enough from the ICO: auditors are in blatant infringement of data protection and we need firm action.

I think this will be the year 'auditing' starts to disappear. Some of the major players are being removed or apparently quitting (kolee, PTTP, Plod) Theyre all struggling more and more for content - there are only so mamy places to visit and it's not the kind of content you can do repeat visits on. More companies, police etc are learning about auditors and the way to disable them ie be extremely polite or just ignore them. Neither of which makes good content. You can clearly see that even with the major auditors, they are either posting less (AB) or the content is becoming desperate (DJ, DJE). And this is just what they post. Imagine how many places they're going to now that result in nothing 😂 Finally, i think its just had its day. People get bored of everything sooner or later, even if all the above reasons didn't apply. I predict by the end of 2024 there will be a lot less of them, and the ones that are still struggling on will be getting many fewer views. Happy New Year!

I'm hopeful that it will start to wind down this year. Unfortunately, these sorts of predictions are made regularly but auditors are still around. We'll see.

Regarding, the ICO they should take the lead on these type of videos. Once that is done the rest will have to follow suit. As for KZbin they dont upheld there own privacy policies. I think we need a video/podcast on KZbin.

​@@streetvideoreviewerWell SVR I've had the inevitable pushback from the auditing community re your doorstepping episode with Blagborough., your channel was mentioned on a panel but incorrectly named so I corrected them 😮and took the opportunity to mention Martis doorstepping, was told in no uncertain terms it never happened and simply was not true , though I'm not out there to do your bidding so to speak it is something I would have repeated but on reflection they have a point .... I have zero evidence !!! My last comment to them was I personally believed you but I did delete my comments. Do you see what happened to you resulting in court or did you record the interaction?

It's interesting that she never got in touch with the ICO about the 2 statements of GDPR breach. Then, reading her statement on the photograph, she is going to get in touch with ICO and the company. that leaked her photo. All bit strange really. I think her hand was forced to make the 2 statements by what she may have said or what comments were made.. Are the statements fact or fiction.

Just a question that is unlikely , would they or anyone else doing the same as them, did not claim any monetisation or even an unknown doing this for no reward, would they still come under the same GDPR regulations ? . I know you have to claim monetisation, before you qualify.

See Recital 18 of the UK GDPR. If they are carrying out their activities for purely personal or household activities, the UK GDPR will not apply. Some aspects of the Data Protection Act 2018 would still apply, so it's not a blanket exemption, but for the purposes of auditing, it can pretty much be treated as such - if Recital 18 applies. The question would be whether a lack of monetised reward means an auditing channel can be regarded as "purely personal or household" activity if the content is being broadcast. My view is that generally the exemption would apply, but there will be particular cases where it arguably won't. Examples could include where somebody has been demonetised and continues the same activity or has never been monetised but can be treated as aiming to monetise. The TL,DR version of the above would be: If not monetised, data protection does not apply to an auditor - but that's a simplification, as there may be particular situations where it exceptionally could apply.

The taxman did take an interest in at least 1 auditors affairs and it led to trouble with his government handouts and housing .Marti Blagborough discussed all that happened whilst on a panel and by the sound of it it caused hardship although on hearing his excuse " I thought the taxman would contact me if tax was due " any sympathy building up from me was immediately lost .He made various comments that showed his whole intention was to have his cake and eat it . Personally I think this probably happened around the time of his " help the homeless " charade and I think this is why the sleeping bags nor the donations raised were ever distributed to the homeless , I personally believe it's the reason with his handouts stopped etc etc he used the donations for himself ..... though I have no proof admittedly .By the same token I have never seen his much promised videos of him distributing said sleeping bags and remember people being banned on his channel if they asked about it ....... if anyone that reads this can point me in the direction of those missing sleeping bag vids I'd be most grateful .Anyway David this comment was just to say the taxman has delved deep in to some auditors affairs ...

i think there is also a case of reporting these so called auditor drone pilots to the CAA as they are really spoiling it for the hobby. there is CAA legislation on protecting peoples privacy contained within the drone code. If your drone or model aircraft is fitted with a camera or listening device, you must respect other people's privacy whenever you use them. If you use these devices where people can expect privacy, such as inside their home or garden, you're likely to be breaking data protection laws.

I haven't seen any fly a drone over a home or garden yet, but I have seen a couple now where the drone is used to snoop into the windows of upper floors of buildings. What these frauditors fail to understand is that a person does not lose all rights to privacy simply because they are at work in a building that has windows.

@@samsmoot1 It's in 2 parts, the first is a private life, the second is a family life, both of these are separate if you look at work being a part of your private life, such as working in an office, if that person outside taking pictures or filming zooms in on you and you become recognisable, it does infringe on your rights as a person and your private life. The family life would include your home and garden as you mentioned, both parts covered in Article 8 of the 1998 HRA.

@auditthis ... If it weren't for the tenacity of SVR's subscriber, in pursuing the ICO, there would never have been this admission of error and unequivocal statement of the law, by the ICO. They are charged with upholding the law re the registration requirement provisions of the DPA 2018. If they now fail to act they will be in breach of their stautory duties. But, you are correct in saying we must work together on this. All auditors abusing the DPA need to be identified and reported to the ICO. Submit their details, as a complaint to the ICO, including their actual name, broadcasting name, email address and full address details, including a telephone number, as a start. Keep up the great work SVR.

I actually touch on that in a previous video: Trespassing For Dummies, Part 3 - With Banaman. It's in the video archive. I address it towards the end of that video and discuss an interesting case from Alberta (Canada). If - a big 'If' - auditing ceases to be a major force on KZbin, I may look at something else. My original intention was for this channel to be for reviewing vlogging in general - hence the channel name, but I've got stuck on auditing.

@@streetvideoreviewer you're doing a thankless task. I guess they're just unhappy with their sad little lives and want to feel like big men but I just don't get these actions on two levels. Firstly, while I'm certainly not a fan of the police, a lot of our tax goes to them so do they really want them spending time on rubbish like this? Secondly, as hard as it is to believe some of these have managed hide their personalities long enough to convince women to marry and have children with them. Why would anyone rather spend their time on an industrial estate than with their child or wife? We only have one life, is this really the legacy they want? Bizarre.

​@@davidgavin7280Yes exactly ...I bet if SVR did a study of the various " help the homeless " charity campaigns of various auditors there would be a depressing number of commonalities with them all . 1st one being not 1 of these charity campaigns was ever completed ...... not 1 , I will stop there as to point out the other things common to them all is frankly depressing when you realise their behaviour was wilful with a total disregard of the hope's and feelings of those that donated .

I see Auditing as a useful tool as it throws a light on situations that work against society. There are some auditors that set out to get an adverse reaction. DJ shows us sites that we would not normally get to see. From an interest point of view, and also as a historical record it's valid in my opinion. It has to be said though that virtually every auditor welcomes adverse interactions as it sends up the viewing figures. I'd hate to see auditing restricted as it would be yet another freedom lost. Maybe a self funded governing body with a code of practice is the way forward. Don't outlaw auditing or Pinac, it will not be good.

they all do the same, only they try to make it "look" honest. they are told to leave on many videos and purposely stick around to provoke reactions. it's not hard to see. they just copy each other. they have no certification of any laws and are in no position to quote any laws.

@@mbsl275 Well... High proportion of channel names like yours are suspect. Police maybe? Anyway... Currently no code. Replacing it with a code made up with help from maybe a legal professional would be a good start... No?. I see them as doing more good than bad on balance. Every bad cop flagged by them makes it worth while. Good policing is also shown in the rare cases where it happens. Trouble is with simps like you is that you are the ones that scream the hardest when the police and establishment act against you personally. Make no mistake that restricting freedoms is never a good thing.

I think there are two avenues that will need to be pursued to make this top: 1. Representations to KZbin, the police and the ICO. This will take time and patience and the first challenge will be to persuade them to recognise that a problem exists at all and to pursue it at a strategic level. If the police just put in a modicum of effort, they could secure Criminal Behaviour Orders against virtually every monetised auditor, which would stop it. The ICO could require auditors to register as data controllers and also fine them for not doing so before now. That could also stop it. 2. Persuade victims of auditors to make complaints to KZbin so that videos are taken down and join together to bring mass civil claims against both KZbin and auditors for privacy and data breaches.

@@streetvideoreviewer I completely agree with you also in addition to this a lot of these frauditors are making a liveable income (wage) from their you tube channel yet they're not registered with companies house or in the case of Marti Blaghhhhh bruh , BP Visits and DJE Audits and DJE Media have been registered with companies house but have since dissolved the businesses yet continue to run monetised you tube channels this alone surely must be tax fraud/evasion which is a criminal act - seriously these frauditors break so many laws its crazy they get away with so much

DJ AB Focus pocus for example are entertaining and they report or record as they see. No way should police or government have a say in this.
