I'm legally ignorant, but I don't understand why the jury wouldn't be sequestered. It seems like a practice that's more important than ever in the internet age.

They already filed a motion, the judge won't rule on it until the prosecution responds, and he hasn't gave them a time frame to respond yet.

First the high-res video, and now this? That's twice the prosecution has withheld evidence from the defense. That alone should trigger a mistrial with prejudice. It's prosecutorial malfeasance. Afterward, the prosecutors need to lose their jobs and face some criminal charges of their own.

Mistrial without prejudice is worthless to Kyle. They need to strengthen the language in their motion for mistrial with prejudice, or possibly withdraw it and refile to include the latest shady dealings unearthed regarding the state.

They dont need to when the judge is so obviously biased. I believe kyle will get acquitted but its obvious with the judges behaviour throughout the trial his views

@@tomitylan5900 lol clearly. If he was biased he would have called a mistrial already. There is plenty of grounds. You know a judge is protecting the side of the defendant in every case. Or supposed to be. The judge is supposed to remain unbiased, however, the state has to prove without a reasonable doubt. If not the judge (unless having a jury) has to side with the defendant. The state has to provide the burden of proof. This judge has been fair

@@tomitylan5900 its not biased if he based his arguments on the actual law ... i love that people argue bias ...when the entire premise of the prosecutions case is based on preconceived notions and blatantly lying to the public and representing a prejudiced and heavily damaged image of the defendant by hiding information and manipulating evidence to frame him a certain way

The juror who is driving the prosecutions argument (Juror 54) already had her mind made up before the damn trial even took place, it's a matter of partisanship, she sides with wokeness and had already painted Rittenhouse in her mind as an evil murderer before the trial. Don't forget that all of these jurors have been watching news reports defaming Rittenhouse for a long long time before the trial ever started.

I've been watching these rotating panelists for about 9 hours every day going back to early last week. Almost all of them have their stretches of being this good when there is something common or in their specific wheelhouse. But in Branca's case, he strictly does self-defense cases, so they're glad to have him there from time to time.

Agreed. Andrew Branca has a wealth of knowledge and experience, meanwhile Legal Bytes adds nearly nothing to streams other than the occasional annoying song (glad she stopped) and random common sense inserts.

I was shocked to hear Robert Barnes say that the Rittenhouse defense team declined to use Andrew Branca. What an idiotic decision. The most knowledgeable man on self-defense law in America? Nah, let's stick with Chair Slumper Richards and let the prosecution wreak HAV-OCCCK over us.

They also declined the behavior panel guys for jury selection, and a video expert, and polling by Rrichard Baris. They are idiots. And now we see how Kyle is paying the price for their hubris.

While listening did you at least for a moment consider coming out of retirement and begin studying law? I’m 55 and the thought crossed my mind just from listening to these guys talk. It’s so very interesting and of course you’re trying to help people, etc. yeah I was imagining myself in my mid 60s taking my first law case!

Apparently Kyle's "spokesperson," David Hancock, who's been a frequent guest on Laura Ingraham, is calling all the shots. I have no idea why or what his qualifications are, but he comes across as very unimpressive. Kyle and/or his family seem to have placed their faith in the wrong person and handed him too much power over this situation.

So can anyone from the legal council answer why it is that a prosecutor can outright lie to the judge, jury, and court without at bare minimum having their license suspended? My personal opinion is that justice would be served if they were sentenced the same way any one on the stand who commits perjury would be.

Some people, notably Tim Pool, say that "Kyle shouldn't have been there." To which, I propose, the opposite: Kyle is the only person who was there, who should have been there. He was rendering first aid, putting out fires, protecting property, and when forced to, himself. Kyle was the only person doing the right thing. Not only should he have been there, there should have been a thousand more people just like him there. The fact that there wasn't, and that we are punishing the only person who did the right thing, is a condemnation of us all.

I have four young children, and it's scary because I can't tell them, "Trust the police. Trust the system." The fact that prosecutors from across the country aren't condemning this sham tells me enough about the fallen state of our justice system from bottom to top.

Soon the police will be the ones who will be knocking on our doors to arrest or fine us for saying gender isn’t a social construct or not allowing our kids who got brainwashed in school to want a sex change at the age of 7, like they’re doing now in the UK. I know the panel does not think this will be a critical case as case study for law, but this case and the polarizing publicity of this case is highlighting how corrupt the judicial system can appear from the outside for political motivations. This case also shows the need for true layman explanation of the sometimes confusing legal terms or conflicting laws and rules. This case also highlights how the historical and Social medias have shoved their way into "becoming" a 4th branch of the American government, and media institutions have created numerous biases and narratives pushing a political /societal views. Reketia Law and his panel have been doing a great job of breaking each part of this trial down while explaining what the law states or how the court procedure works. They also take the time to play devil's advocate and use simple, easy to understand examples to explain US and states constitutional laws.

Yes. It will mostly be a case study in the circus surrounding the case, rather than how the case unfolded. When the DO show clips from the trial, I assume "Yakkity Sax" will be playing in the background.

In a way it was always intended for "The Media" to be a fourth branch in a way. Jefferson believed heavily in the idea of free press and news. That is why freedom of the press is part of the first amendment by name. It's purpose is to be the voice of the people and the check on the government's power and a way for the government to communicate back to the people. But big money interests and the like have, like in all things, corrupted it. Taken it from the voice of the people to the voice of who ever has a big enough wallet. As to the Layperson explanation, I agree whole heartedly. Not just for trail proceedings, but for most laws. If you can't explain to someone with a high school education what the purpose of a law is and how it is to be followed, then there is either a problem with the law, the education system, or both.

As a resident of Jacksonville, we now have one that give slaps on wrist for gun charges and wonders why crimes are up. There’s got to be honesty and trustworthy on all sides. If you’re guilty the evidence will show if you’re innocent the evidence will show.

We know schroeder isnt biased for kyle because if he was he would have finished his sentence and gift wrapped the mistrial for the defense

Schroeder isn't biased either way, but he's a coward and that's the problem cause there's no way that if this trial wasn't being televised and wasn't being followed so attentively by the media he wouldn've declared a mistrial by now and would not have accepted the blurry footage that juror 54 is now focusing on into evidence. The only reason we're in this situation is because the judge wasn't prepared for the high stakes of the case and is being a coward when faced media scrutiny which he admits he has been following.

Don't you see what this really is? It's a challenge to 2nd amendment. If Kyle is convicted for taking his personal firearm and that is considered premeditated, then any legal carry becomes grounds for intentional /premeditated murder, doesn't matter if self defense. You'll be guilty of premeditated assult or what ever.

Half right. The first domino is eliminating the right to self defense. From there, I agree that it suddenly becomes even more scary to walk around carrying in the event you have to defend yourself.

It's not even that. It wasn't Kyle's gun. It was someone else's gun that they let him use that night. That's why the entire story about him "crossing state lines with a firearm" was completely false from the start.

It is not a challenge to 2nd amendment. It might be a challenge to open carry but those are two different arguments. the 2nd amendment doesn't prevent the regulation of firearms and open carry can be legislated.

Kyle is going to to go to prison and it will be his lazy defense attorney's fault as well as the judges fault. The judge has said multiple times that there better not be one more issue or incident from the prosecution, yet there was. There has been issue after issue, incident after incident and the defense just sits back, makes a face, grabs the table, and doesn't do anything else. The judge just allows the prosecution to do and say what they want.

Lawyers think with the mindset of an "individual" most people are "followers" they have no desire to know anything outside of what theyre told or desire to lead..its simply too much ..and the ones that actually take the time to dissect events like this and exercise judgement we are labeled "conspiracy theorists" which is the EASY way out of any argument for people who refuse to have a conversation ..they are in simpler terms EXTREMELY COMPLACENT

The incompetent judge is hoping the jury saves his ass with a Not Guilty verdict... The jury is hoping the judge saves them with a mistrial Yet the jury is now split 6-6 (it was 2 hold outs) and i think they will convict, despite the malicious prosecution all the obvious bullshit, multiple rights violations and the wild entering of even wilder evidence

I watched highlights of the Zimmerman final closing arguments and to see the emotion that the lawyers had is unbelievable compared to Kyle's complete lack of emotion from his lawyers. Kyle deserves so much better

I truly respect Andrew Branca. I ordered his book, from his website, yesterday. He, seems to be, a truly honest man. Most other people would charge, for profit. He knows it's valuable information, that can save a person's life from imprisonment. He gives it away and all you have to do is pay shipping. Honestly wonderful.

the problem is, the Judge gave enough rope for the prosecution to run roughshod over the case, presenting tampered evidence to try and convict a young lad for purely political purposes, the defense team just sat back and let it happen, while Kyle's life was hanging in the balance, it was almost as if they didn't fully understand or care about what was really on the line, Flufferboy and Hamburgler just did as they pleased while violating Kyle's constitutional rights. If the judge had any bite to back up his bark, he should have dismissed this case with prejudice, regardless of what happens, it would be a true miscarriage of justice.

doesn't it bother you that this many brilliant minds who know so much about the law don't seem to understand the country. Reminded when people on the right kept saying the chauvin trial would be overturned on appeal or a mistrial or that he would even get off. Insanity to think the facts matter at all in these cases.

It also has to do with whether the "Mob" accepts you. Remember their was that one lawyer couple in St. Louis who were the "right" part affiliation, yet they were crucified for using firearms to protect their property within an enclosed, privately gates community inside the city.

I asked a lawyer from new york about a case where the brooklyn da took a plea for a guy who stabbed his wife to death even though he had confessed (dude got like 15 years only). he was cold blooded about explaining why they would take a deal. It came out in conversation that im from minneapolis and this lawyer brought up how sad and terrible the case was and how he had a hard time thinking anyone could be that evil. Do you understand that the facts do not matter at all. It's all 100% narrative

I've said this 100 times during the daily streams, this is literally law porn. I've never seen anything like this, and speaking for myself and all the other constitution/law nerds out there, I've been waiting my entire life to find something like this. A big ole group of lawyers debating and dissenting cases/precedents and trading war stories of cases and law school. Law. Porn. I'm so hooked on this its unhealthy.

During this conversation today, Branca I believe brought up that deadly force in Colorado (Make my day) is the only law that allows deadly force without facing deadly force or fear for your life. But in Texas Section 9.42 allows you to protect not only just your property, but the property of a third party with deadly force. Notably this came up in the Joe Horn case.

Andrew sounds like a phenomenal Lawyer from what I’ve heard from him over the past few days (as do the rest of you), I especially enjoyed his statements today about the 2A, which were spot on! America needs more lawyers like y’all and less like Binger, Krause and the lefty Twitter Lawyers. And I’m not just saying this because I agree with you all politically or on this specific case, it’s the fact that you all always try your best to apply the law objectively, interpreting it as it is written and as it pertains to the constitution, being fair and just (in the original sense of the word) and not twisting things to fit a certain narrative, much like Judge Schroeder tbh, who, although we’ve been very critical of for not ruling on mistrial and giving the prosecution too much leniency, has also been really fair and balance even though he clearly has a leaning both politically and on this case.

There's one way this case can fail to be a win-win for Binger - if the judge has him arrested for corruption or any of a variety of other charges he no doubt could be brought up on given his conduct during this trial, and he ends up in jail. A jailed Binger is a dead-in-the-water Binger as far as any political aspirations go.

The state has a certain level of immunity so this will never happen to any prosecutor. Best you can hope for is the bar disciplines him and maybe a tiny financial sanction from the judge. Pathetic, I know!

@@almond3066 The panel earlier on the Reketia Law stream were explaining handwriting analysis. Nick, Richards, and Andrew all agreed it was a high likelihood that the foreperson was an upper class female who is use to being in charge or giving commands. She is also not use to using Mister or Missus before a name as well as a few other comments about word and phrase choices. Seemed like a fair assessment of the stereotypical Karen attitude and demeanor

It is a shame and a real step backwards how States have relied on these backhanded tactics against a citizen or citizens. It shows an impotence and lack of confidence in a Judicial system that we are supposed to be able to trust to be fair and factual. When prosecutors have to act like criminals to falsely narrate upon a case, what do we do to get things back in line? Very dangerous times. I am not going to take a beating because some broken prosecutor thinks that is better than constitutionally protecting myself.
