For those who are interested. Yes there is a POSSIBLE copyright claim in many more ways than one should think: (1) Drake, (2) the person who made a cover in the USA, (3) producers (related rights). Yeah there is the term fair-use, but that is a concept which is known in common law states like the USA. We don’t know this concept in Belgium. In Belgium there is only a limited list of exceptions in which you can use a work protected by copyright without having permission of the creator. However, I think that VTM has a smart enough legal department to sort out all of these questions related to copyright. EDIT: The starting point is that all the persons who worked on the cover can claim a copyright on the cover. Christiana Danielle and all those coaches and musicians, however, have signed a contract with the producers, who works together with the voice, in which they transfer there possible copyright claims to the producers company. Consequently, Annelies was able to perform these song without having copyright issues.

The person who originally did this cover in the US has no claim of copyright, period. First, she didn’t write the song, and second, all The Voice shows are produced by the same production company, which owns every recording made for each version of the show - including Christiana Danielle’s version of Hotline Bling, which was released as a single in the US by the producers. I’m fairly sure that if a track is released, contestants are required to sign over all claims to that track. Even the arrangement is owned by the production company, since she worked with vocal coaches and musicians employed by said company to create the version that appeared on the show in 2018. Ergo, NO COPYRIGHT CLAIM CAN BE MADE.

Deze versie werd voor het eerst gezongen in The Voice USA, jaargang 2018. Is dat dan geen copyright van Christiana Danielle ? VTM, gaarne uitleg, ere wie ere toekomt :) Ik vond het desalniettemin een prachtige versie van een (voor mij persoonlijk) k*tliedje. Super stem met veel reikwijdte, denk ik!

(blijkbaar) Daarnaast is dit een "renditie" (live gezongen en gespeeld, zonder oog op winstbejag en zonder dat een aanname wordt gegeven dat dit haar eigen werk zou zijn) dit valt dus, zowel in EU als in US -wetgeving onder de term fair use. mocht dit niet zo zijn dan is elke cover en tributeband in ons land strafbaar onder copyright wetgeving. Het nummer is duidelijk gekozen net omdat het veel facetten van haar stem laat zien. (wat een klein beetje het punt van de wedstrijd is)

@@djarre22 De uitzonderingen op het auteursrecht zijn in België veel beperkter dan in de US. Als VTM / de dame in kwestie geen toestemming heeft gevraagd, plegen zij wel degelijk een copyright infringement naar Belgisch recht. Om maar een voorbeeld te geven iedereen die met zijn telefoon een optreden filmt en op internet zwiert, pleegt naar Belgisch recht zelfs een inbreuk. Dus ook coverbandjes moeten in theorie toestemming vragen aan de artiest om hun muziek te mogen spelen. Nu dat gebeurt meestal via een organisatie, zoals SABAM, die ervoor zorgen dat een correct bedrag wordt betaald aan de artiest.

@@maartentoussaint7865 inderdaad, zoals je zegt dat gebeurd via sabam, waar ook deze show niet vrij van staat. en zoals je vermoedelijk wel weet of vermoedt is veel meer op voorhand geregeld en in orde gezet dan het publiek weet, mag weten, hoort te weten,... om de "magie" van het programma te laten overkomen. nummers worden lang op voorhand doorgegeven, hier staat een volledige team achter om dit allemaal legaal in kannen en kruiken te krijgen. indien er rechten te betalen zijn op die song (wat vermoedelijk zo is) dan zijn deze door sabam reeds geind. (dat staat los van het feit dat Sabam zelf een louche gegeven is, maar dat is een heel andere discussie.) hoe dan ook is er geen sprake van auteursrecht-schending.

Mijn punt was gewoon dat die term fair use echt iets typisch US/UK is en wij dat in België eigenlijk niet kennen. Bo voor de rest zie ik elke dag wel een inbreuk op een of ander intellectueel recht, maar 80% van de tijd komt ge er mee weg.

​@@kymad2911 still not how that works... plagiarism and copyright (fraud) revolve around you claiming something as your own, when it is not. or claiming something is done by someone other then yourself (like fake paintings) this falls under "cover-rendition" and is part of fair use. it's a live version of an existing song. (not even an original but a cover-rendition itself) and it's done for entertainment purposes IE the singer/band/network does not claim this as their own work, and no monetary gain is being made of this rendition. This is part of fair use by both EU and US law. (it's why coverbands and tributebands around the world are allowed to exist)
