His story about divorce is exactly the same one as my sister's. She was constantly threatened divorce. Her ex husband and his parents would beat her WHILE she was pregnant. After FINALLY getting divorced, she's restarting her career as a dentist and has all the love and support of my parents, alhamdulilah. I just read a hadiths (Bukhari, Book of Divorce, hadith 5273-5277) where this woman jamilla was like to the prophet " My husband is very good in character and he is very religious but i just dont like living with him and she was granted divorce lol by the prophet himself who was in charge of affairs ! all she had to do was return the land that was given to her which is fair because she literlly divorved her husband for no real reason! If a woman who got to divorce her husband because she just didnt like him anymore then why are sharia courts today preventing women from divorce ???????????????????????????????

@BattleCatSRT Indeed. And Allah only increases His Fadl for whomever He Has Given it to and does not Command or Support abuse or violence. Also, many women today work and are many times the sole contributors to the household, especially seen in poor households (maid servants, etc) which means they would be the heads of their families as well. However, it's never about being the head, it's about being equal partners in Islam. Islam believes in justice and fairness and even fadl and ehsaan (favoring the other a bit more) which is what ibn Abbas and many scholars say is what the ayah "and men have a degree above them" means. The Quran also says don't forget goodness and fadl between yourselves while discussing whether half or the full mahr should be given/forgiven by the man or woman respectively if divorce occurs before the consummation of a marriage. Indeed the Prophet Sm said treat your children equally and don't favor one over the other and if anyone should be favored (exception) then it can be your daughters.

The man can divorce his wife simply by word of mouth, and does not even have to provide REASONS, or prove her worthiness. On the other hand, the woman has to go through courts and hearings and PROVIDE REASONS THAT MUST BE FROM A VERY SPECIFIC LIST OF FAULTS. Like adultery or absence for four years!!! And she has to PROVE THOSE REASONS TO VALIDATE THEM IN COURT. And then if she wins the case, the court will GRANT her her FREEDOM. What part of this seems FAIR to anyone under the heavens?????????? Ps. Also keep in mind that the husband is allowed to have four wives at the same time!!! So hurrrrraaay for men!!! He mentions other solutions for women to obtain a divorce but doesn't explain why women don't have the right to divorce their husbands the same way husbands do, so he didn't answer the question but seemed to be answering a different question which is more along the lines of " what can women do if they want a divorce then? The woman had to go to the prophet and request a divorce, and then the prophet had to tell the husband to divorce her since only the husband can do it. I'm wondering though, did the husband have any choice in the matter? Or does the prophet telling him equate to an order, in which case it would seem that the prophet is unjustly interfering with a married couple's affairs.

She has to ask her husband for divorce or get someone to convince him to divorce, or get a judge to rule a divorce if he was abusive or something. It doesn't take much effort to see that what a woman has to do to get a divorce is more difficult and NOT guaranteed to work, whereas the man can do it whenever he wants just by saying a word to her. It makes so much more sense today in the western world where you have BOTH the husband and wife having to sign for the divorce to be valid. Islam giving the husband all this power to divorce is absurd.

So some scholars view men divorcing their wives three times in one setting as to only count as one, whereas other scholars would say it means she is permanently divorced. Which view is correct, and why wouldn't Allah make this super clear for Muslims so that they wouldn't have to suffer with this? What if the husband's family viewed the triple divorce thing to be a permanent divorce but the wife's family didn't? What resolves this difference in interpretation?

Usually we’d go to the hadith and sunnah but when it comes to controversial topics that there is no evidence for, you have to do your best to pick an option to the best of ur ability. So probably look at the diff opinions of scholars and their reasoning and pick one that makes the most sense (not the one that suits ur desires) and inshaAllah itll be ok. Wow. Let's be careful. My take away from this is he is saying that we can follow the Quran when it's convenient and not to follow it if it's not, according to how we feel at the time. I think there was no strong answer given here and only added confusion for many people. As a Muslim, you must follow the Quran and Sunnah as it is applicable for all times. Are there moments when a fatwa (ruling amongst the scholars) can be given for certain circumstances that would require such a ruling? Yes. Like consuming intoxicating substances. Normally you would not be allowed to take it. However, if you are going into surgery, then it is understood that you are allowed to take it to relieve you of pain and even Prevent death, etc. What should also have been discussed and was really not mentioned here, is that a woman is indeed allowed to seek divorce given that there is legitimate reasons. And those reasons can be as simple as she is not attracted to her husband - from my understanding. If she seeks divorce on a whim or seeks it due to her husband following Islamic teachings, then that is not a legitimate case for seeking divorce. For example, if a woman seeks divorce from her husband because he is telling her to keep covered properly, or to be home at a certain time, then that is not legitimate. And yes these examples I have personally observed. It is the man's responsibility and right over the woman that Your creator has given him. As he has given the woman different rights and responsibilities. If you don't see the wisdom in what your lord has decreed, that's your issue, not his mistake. What will we question next? Why God has made women cover up more than men, Is it fair? Why did God make me a man, should I have the right to have a sex change? Point is that it becomes endless. If you think that you know better than God, then you are no longer a Muslim. Just making this comment, but not accusing anyone that they fall under this. But we must be very careful. The Prophet Mohammad, Please be upon him, said, If you follow 2 things, you will never go Astray. The Quran and his Sunnah. So why are we even debating whether to follow the rulings in the Quran or not? Unless certain rulings have been abbrograted, they were meant to be followed in all times. And Allah, subhanallah hu wat'ala, knows best.

@@hussainismail2080 I believe ijtihad is required for this because what you are referring to is the interpretation of a hadith relating to one Sahabiya who wanted to divorce her husband for no other reason that because she didn't find him attractive, there was no fault on the husband's part and therefore the Prophet PBUH advised her to return the Mehr which she was happy to do and was fair under the circumstances. The same scenario can't be used when the husband clearly is at fault surely. And if anything this could easily be taken advantage of by an abusive husband - he refuses to give the divorce knowing that if the woman is forced to, she will have to give back what is rightfully hers. I'm not a scholar either but that doesn't make sense and doesn't seem just at all.

When the rumor regarding the Prophet's divorce spread, Hazrat Omar went to Hazrat Hafsa and asked if that was true. She was crying and said, "I DON'T KNOW!" How's that possible? The only explanation is that she did not know if the divorce was actually filed officially or not. I believe there was a process in place for REGISTRATION of both the marriage and divorce, and that meant a compulsory mediation of authorities in case either party wants a divorce. A sect of Muslims have been carrying out this practice even today. It ensures equality and removes any misuse of "right" to divorce.

Islamic law is the first legal system recognising the right of the wife to seek dissolution of marriage. There are many types of dissolution that the wife could seek. First, khuluk which the wife proposes to the husband to pronounce talaq with monetary consideration provided by her. Second, talaq ta'lik where the husband breaches conditions attached to the ta'lik. As an example, if the condition states that talaq will occur if the husband fails to pay maintenance, then talaq will occur. Third, fasakh where the wife could ask for dissolution if for instance, there are abuses commited by the husband. In essence, both Islamic and Civil legal system make it difficult for divorce to occur because in principle, both do not encourage divorce.

@Ganga Din she is considered half witness as you put it only in a financial situation. Otherwise gender does not matter when it comes to acting witness in other aspects. And financial is because Islam makes it compulsory for a man to earn for his wife and kids. Woman don't have the duty to earn it is the man's duty to feed, cloth and provide for her. If the wife has a valid reason to ask divorce (husband is sterile) does she still have to give her gold jewellery back? The husband took all the gold jewelry by force from the daughter of a friend of mine and he does not want to give her divorce even though she has legit reason to have one and now she has to try to get it via court and those would be great help to pay a lawyer. I am not sure if the Surah 2 verse 229 is also "talking" about this or not and I think that I have read somewhere that the wife should have compensation for the time they have been married. 🤔

No. If she has a valid reason, then simply ask him to give a talaq. Any decent man would give it, then she would keep her gold. And that gold would only be one that was part of her mahr in the time of the nikah or any thing that was given to her as a gift. When it comes to a khula, she forfeits her mahr in return for a swift divorce.

because....the women can't divorce whenever they feel like it...Let's not also forget that culture is a big deal, in most muslim countries divorce is seen as something bad and divorced women are looked down upon, now which woman would like to go through that? Let's also take into account that the countries where there is the lowest divorce rate - women are statistically more afraid of speaking up against domestic abuse AND because it is *hard* to get a divorce in those countries.

Dr. Shabit Ally's answers created more questions than he tried to answer the question; in my view. Not happy with his explanation. His answers will play directly into the hands of Munafiq and Mushrik. He should have done a better job here or reserved his answers for some detailed explanation than asking to do Ijthihad on such a serious matter. I was expecting more from him but got disappointed.

Divorce is not allowed in islam for women if they have not suffered physical or emothional abuse. Most imams will not agree to divorce without these types of conditions for women, whereas men dont need any excuses. So situations like mentioned here about not being in Love with her husband, under islam law, you dont have the right to divorce. I have heard so many imams talk about this, and everytime it comes to this. But i believe men and women, doesnt matter what religion or culture, arent fully educated on marriage. Although it seems islamic stay away from sin for sisters, please think about yourself and the double standards you might face if you end up in a divorce. If anyone has more info about this please share. So we can talk about these very serious issue that surround women in islam. There is more discussion on youtube about what to do on wedding night then these issues, and we need to change that together.

There are several couples who changed their mind after 1 divorce it would have been very difficult if they had only one chance. There are times you think things over when you have space and I personally know couples who reunited and get married again. No, I don't think it is sexist because the woman also has the right to say "no". There is only ONE way to divorce, there is no past times and current times. The way outlined by Allah is ONE, and that is when a man says talaq three times in one go, it is THREE. it may not be the prescribed method, but it takes effect. Just like when a man did not intend to kill someone but that person died, he will be tried for manslaughter.

Muslims are marrying and having families from the start of Time of Adem AS. You should just state the facts and educate the muslims about these truths, not according to our own and our societies whimps. I hear many of you 'sheiks" talking about this hadith related to the lady of "Sabit". You "imams" have to clearly communicate the specific situation of their marriage and asking Rasulallah SAV for divorce. Do you not know the full story or you are hiding it on purpose. Q. When did she found Sabit not attractive, starting from what time, before the marriage or after the marriage. Do not you know that most divorces are filed by women. They do not need your encouragment to go and file for a divorce. Fear Allah. Do not miss guide the believers under the cover of beard and being an Imam or a Shaikh.

I think there is an even an balanced approach in Islam and their are different pros and cons for a husband or a wife ending a marriage. I don't believe a divorce rules are 'unfair' to women - I think they're just difficult to invoke whether you are a husband or a wife. Example - a husband can only divorce his wife after living with her for 3 complete menstrual cycles - that's tough - supporting someone while you have made the decision to divorce. Similarly if an Islamic Judge grants a woman a divorce - it happens instantaneously. I think the title of this youtube video is a bit misleading.

Except if the man was not to support her for those 3 menstrual cycles the ex husband could come back and accuse her of adultery if she were to become pregnant during those 3 months. So it makes sense to protect women from that. Also... in cases of khula women have to complete 1 menstrual cycle before they can physically leave. Also... the process of khula is not instantaneous... on average it takes about 6 months to get a khula... and I've heard some women have waited longer than 10 years and are still waiting. The only instantaneous divorce is talak. Men don't need intervention from the courts to make a personal decision about their own lives and have to rehash over and over again the reasons they want out in front of an Islamic council. If you really think its fair... i don't know what to say

I disagree with Dr Ally’s narrative about divorce laws or any other laws for that matter need to be re-interpreted for the modern era. It assumes the modern is somehow a “good” development for society. Stats show women initiate divorce in 70% of cases i.e. given the opportunity women would single handed account for the majority of family break-ups. This is clearly not desirable. Hence the wisdom in allowing the right to divorce to men alone who are very unlikely to actually use the right. It allows for far more stable family structures in society. Dr Ally again appears to fall foul of the post modernist narrative about what the real nature of the human species is. There surely is an absolute truth and current society is surely far removed from it.

Women leave when they've absolutely had enough and Men are unwilling to put in any work until they feel that something is broken. Men dont care as much about a womens status because they dont need to. They can leave the relationship whenever they want and not have it affect them financially because they wont get stuck with chils raising. How many single moms we know in the world? Plenty.. Men dont always hold up their end of the deal. How many successful women we know are single? Plenty because Men are not interested in a women that is more accomplishes than them, and honestly they think they don't need to be.

And if you look at adultery statistics they commit adultery at a similar rate as their male counterparts. Also Google the Teachings of Mohamed compared with the teachings of Jesus. You will be more informed. I have personally done this and the conclusion was that Mohamed could not have been a prophet of The Most High and Holy God and The Quran is full of contradictions and mistakes that it is clear that it could not have been from The Almighty God that knows everything and cannot make mistakes.

You can see that the Quran cannot be from Almighty God. There is confusion and inconsistency in the narrative of the Quran. The Almighty God is not the author of confusion. Leave Islam now before it is too late.

بسم الله الرحمان الرحيم The way they speak about the Quran is kufr. we definitely can NOT take any advice from then any more. The matter of divorce is not unclear and to say it needs rethinking is to say Allaah, Lord of mercy, failed and his book is outdated. وَمَا كَانَ لِمُؤْمِنٍ وَلَا مُؤْمِنَةٍ إِذَا قَضَى اللَّهُ وَرَسُولُهُ أَمْرًا أَنْ يَكُونَ لَهُمُ الْخِيَرَةُ مِنْ أَمْرِهِمْ ۗ وَمَنْ يَعْصِ اللَّهَ وَرَسُولَهُ فَقَدْ ضَلَّ ضَلَالًا مُبِينًا (Sahih International) It is not for a believing man or a believing woman, when Allah and His Messenger have decided a matter, that they should [thereafter] have any choice about their affair. And whoever disobeys Allah and His Messenger has certainly strayed into clear error. -Sura Al-Ahzab, Ayah 36

Salaam I will no longer listen to this brother as many of his answers are either apologetic or un-Islamic. Women have the right to divorce in Islam as he said but he made it sound like its unfair as if Allah is unjust. Allah knows us better than ourselves and he knows the best for us. We should listen to legitimate Islamic scholars and not this brother.

Saif Hasaan he says it as it is ! Islam has made women a play thing to abuse for Muslim men ! A Muslim man can beat his wife , divorce her at his whim - how can it be right to make a human so disposable ? Islam says discount a woman’s pain and jealousy and make her share the man with other women , you can abstain from her bed but the woman was given no such right - it’s such a shame !

In the wake of the Birmingham Quran manuscript news story of 2015, Gabriel Said Reynolds, professor of Islamic Studies and Theology, published a commentary clarifying the unique differences between extant ancient Qur'an copies. He defines the lower text of the Sana'a palimpsest as ”a rare Qur’anic palimpsest - a manuscript preserving an original Qur’an text that had been erased and written over with a new Qur’an text.” Reynolds explains that the lower script of the Sana'a palimpsest ”has so many variants that one might imagine it is a vestige of an ancient version that somehow survived Uthman’s burning of all versions of the Qur’an except his own.” He concludes this finding is problematic because the Sana'a variants ”do not match the variants reported in medieval literature for those codices kept by companions” of Muhammad. Furthermore, Reynolds affirms the ”Sanaa manuscript... is almost certainly the most ancient Qur’an manuscript [and] contains a surprising number of variants, including completely different words.” Reynolds concludes that the Sana'a manuscript is ”our most ancient manuscript of the Qur’an [and] does not agree with the standard text read around the world today.”[27] However with the radiocarbon-dating of the Birmingham Quran manuscript to before the year 645 with a 95.4% accuracy, the latter is believed to be older then the Sana'a manuscript, and is seen as the oldest Quran manuscript.[28] Moreso, the discovery of a Quran manuscript by the University of Tübingen in 2014 also proved to date from the early second half of the 7th century.[29] A more recent study of one of the most ancient Quran manuscripts by François Déroche was the Codex Parisino-petropolitanus, containing 46% of the text of the Quran,[30] dated to the early second half of the 7th century,[31] from around the same as the Sana'a manuscript.
