Not good enough! Clara should have sued them not just for the money lost. She should have appealed to the court for additional compensation, so that she can settle the legal fee, plus recompense for all the emotional distress she has had to endure because of her family.

I'm not a lawyer. Just a guy who dealt with helping administer some estates that are a bit on the complex side. There was probably no need for a lawyer. (At least in the US.) Initially she just had to meet with the Clerk of Court in the county the estate was settled in. She then brings up the failure of the Administrator to properly manage the trust fund per direction of the will. The administrator for the trust would have been legally designated by the Clerk of Court as such as part of the settling of the estate. The Clerk of Court would likely file a summons to the person assigned as the administrator to address the claim of mismanagement. Clerk of Courts can't give legal advice. But as soon as that person starts to shift uncomfortably in their chair, that is your notice to fully restore those funds. Because the next call he or she makes will likely be to the local Distract Attorney. With a charge of embezzling funds. If you are lucky, the Clerk of Court will schedule another meeting to go over the accounting of the trust. Which gives you time to restore the funds. And to be fair, it is in the best interest of someone like the OP in this story for the Clerk to do this. Because once the person gets charged with a felony, odds are very low the OP would see the funds restored. So you hold off on the criminal charges, give the administrator a chance to either restore the funds or hire an attorney to legally argue that each and every withdrawal was done to fulfill the wishes of the descendent and roll the dice. And once the money is restored pray like hell the Clerk doesn't take it any further than to remove the administrator as the administrator for the trust. (Wouldn't be an issue with the person receiving the funds is an adult.) This is where things get dicey. If the person reporting the embezzlement is a minor they may not be able to sign a contract with an attorney. At least in my state, minors can't legally sign contracts. So the court would have to assign an attorney to represent the kid. Or at the very least assign a Guardian ad Litem to look out for his/her interests. Who can then work with attorney if needed. If the person is an adult, then he/she can have an attorney address the matter with the Clerk of Court. But filing a lawsuit in civil court? I just don't see that necessarily happening unless the funds can't or won't be restored. But I'd argue this is purely an estate matter. And if the same Clerk of Court is still in office that signed the initial Trust Fund administration order, he or she is going for blood. You don't want to be in that seat.

The biggest apology should've come from the parents. They never thought that Clara would take legal action against them. Giving her the cold shoulder, seriously? There are parents who "like" one of their children more than the other, but they also know to be fair to all their children. They knew what the grandfather wishes were and are lucky all they had to do was restore the money back instead of spending some time in jail.

Your children should be loved equally. And the grandfather made it clear that that money was for Clara‘s education and nothing else. How dare her parents take it for Mandy and her failing business. That’s not important what’s important is your daughter wanted to go to college and the fact that her grandfather left her money for it you don’t steal it. I’m glad she took her parents to court and got the money back. How dare they?

Well they were stealing thousands of dollars from her. It’s not like taking a quarter. Why should that be tolerated? If they were willing to take $50,000, what else would they do? And throwing money at a failed business too. How would that be helping the family in any way?

There is no guarantee without the court case Clara would've ever regained that education money. Wait a year could've been another and another year and there is absolutely no guarantee in year there wouldn't be another excuse or just we don't want to strip 50K from the store in case something happens

Nothing was said about a will. Looks like that a fund was set up and the parents controlled it, or grandpa did not keep it a secret. The parents got control because she was a minor. No mention of the money being in a trust. Either way, a crime was committed. The sister benefited from the theft. Equally guilty. Maybe forgive and forget when the last cent is returned.

In the end family is only family when they are supportive of who you are and fair to all members of it. It was terrible that the parents were willing to steal money meant for their younger daughter's education. Especially given that the money hadn't even been provided by the parents. The favoritism had to be extreme if her grandfather felt compelled to put away a college fund for her. And it seemed that her family was completely wiling to destroy this girl's chances for a college education and a good life because they only cared for the oldest sister. In the end there is no reason to feel any loyalty to a family that will sacrifice you to give their favorite all that they ask for. Family is a 2-way street and yes, you do sacrifice for family when you know they will sacrifice for you. But you do not have to be stupid and ignore the evidence that the people who claim to love you think nothing of you as a person. In this case this girl's family made sure to show her time and time again that they did not love or respect her, and she believed them. She was a rock star for taking them to court. This was not family

In my opinion You should always feel respect, dignity, love, understanding an a good morale understanding of yourself in your life. You shouldn't need a word like (empowerment) to tell yourself your strong because the (strength) you seek is not something easily obtained by telling yourself your strong!! An thinking its gonna make it true i f u tell yourself that it is. Start by "Bettering yourself if something in you heart or mind is lacking" but do it in a positive way!
