The sheer idiocy of thinking that being able to walk around a gate or by implication, through a hole in someone's fence somehow means you have free access to the property behind it.... What the auditor is essentially saying is "if I remove all common sense, I'm doing nothing wrong by crossing this obvious boundary designed to keep me out." It's like when they say "what if I can't read?" When police point to their tag instead of verbally saying it. "You have to treat me like I have no common sense." Because that's the only reason these auditors can fool themselves into thinking their activities aren't just a massive waste of time.

The whole auditing movement was originally only carried out by photographers from a public place to highlight the rights of photographers to film and photograph from a public place. Not trespassing on private property and trying to exercise public photography rights. Great channel.

Another load of BS that AY spouts is 'unwanted contact is assualt'. Assualt (or more correctly battery) is about 'unlawful' violence or contact. Removing a trespasser is perfectly lawful under common law, and therfore no assualt occured.

Worth looking at more recent legislation which has the interpretation of a public place contained within it. For example, section 16 of The Public Order Act 1986 has a defenition for a 'public place'. Note the reference to express and implied permission, with regards to access. Auditors often overlook (or ignore) concepts such as implied or express permission in regard to access to 'public places'. It could be reasonably agrued that there would be no implied permission to enter the rear yard of a police station anyway. (Edit> I see you covered this). However, it's a bit of a moot point. These defenitions are there to help interpret the legislation that these defenitions are contained within. They have little relation to anything the auditors are doing. Even if you were to take the defenition as a general guide for all situations, auditors don't seem to accept that areas that may meet the defenition of a public place, can also still be private property. I've even heard auditors claim that a shopping mall is 'public property' until it closes, and only then does it become 'private property'😂

Ugh sick and tired of the completely irrelevant s33 Criminal Justice Act 1972, which is not even relevant to trespass. These people need to finally get themselves a decent education and maybe a job. As for the definition of 'public place' in the law its clear through case law that anywhere there is no routine public access is not a 'public place'. Gaps between fences or barriers in police station carparks is no invitation to trespass and is clear to any reasonable person that there is no implied right of access.

It's likely if this sort of thing continues: that large organisations (in the private or public sector) would demand another law; or that existing laws regarding rights to privacy are reexamined; to rid themselves of the "drama queens" (which would inevitably result in further restrictions). Or since: trespass; wasting police time and disorderly conduct (verbal abuse) and obstruction (refusing to leave) exist on the statute books, the police "throw the book" at them; based on their own evidence...because they give journalism a bad name.

Start with calling him a "muppet" ... after that, you don't really expect the cops to treat you with respect. Respect is earned ... whether auditor, cop, baker, taxi driver, or whatever you may be in life. Just an auditor (who likes to show the bad behavior of the cops) should set a good example... Aggressive behavior does not achieve anything, on the contrary. In this way, you indirectly harm other auditors. You should think about this beforehand before you are against something and do not act better yourself. And pleas: in this Video are so many stop and gos ... its hard too watch.

@@Testchannels-z8j The basic problem is that most people online can't be trusted to use the personal information of others responsibly, so it's a 'slippery slope' issue. You end up with auditors being harassed, which harms the credibility of any 'legal' efforts to deal with them. There is a certain group on Facebook who expose the personal information of auditors and boast about how they use their personal information. They don't see the contradiction in their actions. They even started on me because I criticised them. One of them was getting up in the early hours of the morning to post psychotic rants about me. The reality is that a lot of the people you encounter online are just not right in the head. That's especially the case amongst people who support auditors, but it's also the case for some of the people on our side. I'd rather stay on the right side of the law.

Trespass is a civil matter but aggravated trespass is not. It is private property as it is managed in the interests of the collective on our behalf by West Yorkshire police. The notion that a building funded wholly or partially by taxation is ‘public’ and therefore open to use by all at all points is not supported by UK law.
