A lot of them reference s33 Criminal Justice Act 1972 in relation to trespass. But s33 is there to clarify the definition of public place for the purpose of whether a public order offence has been committed (or not). It’s clear in the statute. S33 has nothing to do with trespass at all, there is no requirement to fence off private land and right of access isn’t automatically permitted under s33, that’s not what it says! By his logic you could walk through someone’s open front door and start filming inside their house and claim a right to be there lawfully…

This channel is brilliant to highlight the menace of so called 'auditors' who are basically just thugs with a camera. This Marty character totally misrepresents s33 Criminal Justice Act 1972. This section defines the term 'public' place for the purpose of the Public Order Act 1936. It has absolutely nothing to do with trespass. He somehow believes that the 1972 Act gives authority to trespass and it does not. Private property is still such and when someone tells you it is you must leave..it's as simple as that.

Totally agree that Marti is the snitch. He's known for it. If he had an accomplice I would point to Kev. Why? Because you can see their envy for DJ, they pretend to look up to him. Like him or not, and I don't. DJ has been successful with his channels in comparison. Plus he's not short of a few quid which will pain Marti the pauper and skint Kev. Only bits that are confusing me is the poster in the reception office area had been put up from the inside. My theory, I think Marti tipped off IPB (anonymously) by post, sent them the posters and told em when to expect a visit! When Marti and Kev first approach the main gated they both pick up the poster in their shots but don't mention it. Usually they're all over signs and directives on gated. Also after the first two posters are removed, Kev points out that there is one on the outside of the main gates? If he knew there was one there Why didn't he mention it earlier? No-one likes a snitch, or two!

He blocked me on youtube as he didn't like me pointing out a contradiction that he made. He has said in many videos that he can film office computer screens through windows from outside as GDPR does not apply to him as an indervidual. He has also said that he has formed a company for his videos called PINAC media. I asked him about it in a comment, not to be rude to him, but just out of interest. He didn't reply but blocked me. I do wonder where this stands on GDPR, as at the point of uploading it to youtube, the person/organization responsible for the infringing data being shown can get the video taken down on a private complaint. I doubt he would get in any trouble personally about this, but I do wonder where this stands legally if he has filmed the video on behalf of his company, making things a bit different to him filming it as an individual.

However taking videos and putting things on the internet are two different things. I became interested in his channel as I have encountered many nasty security guards over the years (often in shopping centers) and it is nice to see him standing up to security. However, in a lot of his videos he targets small businesses, and it feels like he is the one trying to provoke a situation rather than the other way around.

However he and others like him overstep the mark. It's one thing to test official understanding of photography rights, it's another thing to provoke confrontations that waste police time, involve trespass and harassment, and are designed to make people appear foolish. I would suggest that the people best equipped to test and improve understanding of photography rights are photographers themselves. He is not a photographer. He is simply a troublemaker.

If the posters were put up by the firm alone, they wouldn't know if or when this gang would be attending so the poster's would have been up maybe a few days and would be weathered. Regarding when they were peeping tomming at KPMG, Im surprised the security didnt take any action, a few years ago I was in there with a client and saw them dealing with an undesireable, very heavyly. Later on when I hear the Section 33, I thought, here we go again, it sounds good, it sounds as if they know what they're talking about, I wish they would come up against someone who says they are trespassing and any rights they claim to have are revoked, if they have wandered into a trespass situation without realising, when thry are told they are trespassing, they should leave. That last point you make is particularly important. I have searched for the information about DJ Audits online from the perspective of somebody who might never have heard of him before. To find a photo of his wife, you have to know a lot about him, including his wife's name. It is possible that somebody googled 'DJ Audits' wife' and found something, but would they be sure enough that it is her to put up those posters? It seems a lot of trouble to go to for somebody you don't even know and who has never been there before. The only other possibility is that one of the anti-auditing groups made the poster and tipped off the company in advance that they would be attending that day.

At 1300 -1305 MB says “the shutters are down today, they were open just the other day.” So did Martin B visit a few days before to put the posters up. The company then closed their shutters expecting trouble within the week, but left the posters up for police to see as evidence? I don’t know about the ones inside, were they the same? Or did the company put two acceptable posters up inside ages ago, simply so that staff could recognise the auditor, then MB did the outside posters containing more details and the wife. It would make sense for the company to put an identity poster up inside reception, but it would seem silly to put them on every fire exit door as well, who’s going to see them? That sounds like the sort of thing someone with learning difficulties might do, someone who doesn’t know what the Quay is.

@@OliverWoodphotography I doubt that many auditing videos would qualify for the special purposes exemption on the ground of 'artistic' work, but putting that aside, my answer anyway would be, 'No', but your question requires adjustment. Professional appearance fees would only be a relevant consideration if the individual had contracted to appear (whether expressly or impliedly) for that purpose. Somebody wandering in shot or coming up to speak to them is not an 'performer'. I think what you may mean to ask is whether anyone appearing in the videos can claim damages for breach of privacy or data protection. My answer would be, 'Yes', in that they potentially could, but it's also worth noting that in nearly all cases there is no commercial exploitation of the images, it is merely that the auditor earns personal income from it. This is the sometimes helpful distinction between 'business' and 'commercial', the latter involving exploitation of the image through licensing and similar endeavours.

They employ trained journalists. That does not mean they always do things right or ethically - they don't - but it does mean there is recourse and some measure of accountability. Totally different from auditors.

Some of these guys audits has improved over time. They have stood up against some abusive staff and reinforced the understanding of some laws and rights that help everyone. However some of the behaviours in other videos definitely show a paranoid, low confidence, antagonistic bunch and shows them using the camera and rights to film in public bla bla, as giving them the balls and confidence in life that at some stage they've all been lacking. To fair though, watch a good selection of video's sometimes these guy's do show a good and respectful side, they've often paid accommodation to homeless people they've randomly met as well.. not many think to do that.

@richrichie378 Sorry, but I'm not impressed by them giving money to good causes - it's a common tactic of wrong-doers to conspicuously give money to the needy. Don't misunderstand: I have every sympathy for the homeless, but the reason auditors give money to homeless people is because they are cruel narcissists who think you are thick and will accept them as nice people if they just pretend to help a sympathetic cause and ensure that you see them do it. If they really cared, they would give their money and help off-camera and we would never know about it. To give another example, I laughed when Auditing Yorkshire recently started doing videos with someone called The Pink Runner, some sort of mental health campaigner. I am sure that Auditing Yorkshire does care about mental health - his own. Just like he cares very sincerely about civil liberties - his own. Auditing Yorkshire is a cruel, callous, thoughtless narcissist who cares about himself and no-one else. If he cared about other people's mental health, he would stop damaging the mental well-being of the random people he victimises when out auditing.

Paying for a room for the homeless .....yeah that's a good investment if you think how many of them have gone on to set up Xmas " help the homeless " grifts asking subscribers for donations which have more often than not ended up ( deliberately) with confusion on how much was collected and when followed by back slapping night visits to the homeless giving out cheap hats and scarves and food ..... but the big ticket items they promise to give out are never distributed !!! Marti collected 1k + ( his words ) , spent £50 at Costco on cheap sandwich ingredients then handed the food out along with hats etc etc ALL videotaped then said he would be handing out sleeping bags in the next couple of days bought with the remaining approx £950 and the video of it would be up soon ........ never happened and hes banned / blocked anyone mentioning it in his comments , hasnt given an explanation to this day !!! Filmboy did the same last Xmas ... the confusion over how much was collected , handing out small items etc etc all videotaped , then promised on the last live homeless visit to get 2 people off the streets in the next few days and promised the usual big handouts ...... never happened ...no explanation given etc etc , they are not the only ones Live Free grifted the homeless a couple of times , Buzztex charity grifts are legendary and others , in fact I can honestly say I've never seen 1 auditor do a trouble free spend and handout of subscribers money garnered from subscribers for the homeless..........ever .

I think that's the wrong way of looking at it as most viewers/fans of auditors will forget them inside a week and move on to watching something else. I think KZbin may also be assuming (hoping) that auditing dies out organically as some other trend develops to replace it.

It's the best part of a 7 hour round trip for him- I cant see him doing that unless he had a plan for some "explosive" content. While I don't endorse the actions of some auditors, especially when they're provocative or retaliatory, I do think your audit of these auditors is dishonest. You conveniently left out the posters that are not accessible from the outside. Are you suggesting they had an inside man or maybe they somehow snuck in when nobody was looking? What's your explanation for the internal posters and why omit this from your video?

I have not left that out. I've already explained it, both in comments and in a follow-up video. This happened because I simply forgot to mention the internal posters in the first video. We can't be sure those were the same posters anyway, or what was actually on any of the posters - we only have the auditors' word for it. How did the company know Marti and the other auditors were going there that day? Maybe they were alerted to an announcement on social media - that's possible - but would they really go to that effort, including finding out personal details of DJ Audits (someone they had never met)? And how did they confuse Random Outings and DJ Audits? Why single out DJ Audits? Why did all the auditors pass posters at the main gate without mentioning them? How did Marti know what was on the poster before reading it? It is possible the company was tipped off by someone other than Marti and that person also sent the posters. I think either Marti sent them or they found a poster left there by Marti earlier in the day, or someone else sent the posters but Marti was involved or tipped off about it. In any event, it was not an organic interaction, it was a set-up, possibly even with DJ Audits in on it.

I just watched your 2nd video. Just so you know, I did check your description and looked for a pinned comment to see if there was a follow-up video from yourself. I even held down the page-down button until it stopped and did some keyword searches. I'm sure I did more than most so it maybe helpful to others to pin a comment about your 2nd video. Thanks for your reply but you have too many whys, maybes, possiblies & what abouts for me to be comfortable with your way of thinking. I agree there are questions to be answered but there are too many guesses here for my liking. Is it possible that one or more of them were in on it? Of course, but as you point out here, it's also possible that some disguntled person also got wind of this and passed the information on too. Most of the auditors I've seen do overstep the line. DJ Audits is the only one I have been able to watch so far in the UK, and I haven't watched many, but even he has uncomfortable moments now and again where he overstays his welcome or is too nosy. He's not much different to Jeremy Vine in a weird sort of way, generally polite and staying in his lane saying, 'if you crash into me then that's on you!', going on to say he's acting within the law and the motorist was wrong. Maybe I'll watch Amagansett Press in the US too in their current format. The point being, if there's more to the video than just the exercising what the law currrently allows ie, some background information about a company or town then there's reason to watch. Obviously I respect your right to draw your own conclusions on your own channel, as I'm free to share my thoughts, for the moment anyway 😆. I thought you were maticulous covering Jeremy Vine but regarding these two videos, for me anyway, I would need definite answers and proof of a setup before making any accusations, implied or otherwise. It would seem sensible, after a dispute, for a company to put a basic picture and you tube name on a poster inside their reception area for all staff and visitors to see inside and outside. This would be so staff knew the person was aggressive and should be avoided. Inside reception would be a perfect communal place to put a couple of posters like this. The ones on the fire exits and on external store cupboard doors were just stupid and possibly very different and added at a much later date by someone with learning difficulties, not realising how illogical and pointless it would be for the company to do such a thing. An employee doesn’t need to see a persons face on “every” door, they only need to see it once in reception, to know to avoid them. The posters outside may have been very different to the ones inside, and put up by someone else ( not an employee) at a later date.

It seems more likely the posters would put up for a specific purpose. I find it hard to believe anybody could confuse DJ Audits with Random Outings. They sound completely different. It is you who has been caught out as you clearly are not aware of a previous video in which Random Outings had a lengthy conversation with individuals from IPB outside their premises. Once you know this, you realise that a mix-up between the two by IPB (or really by anybody) is unlikely.

We all make mistakes with the pronunciation of words from time to time, but 'quay' is a word in common use and 'Coutts' is the name of a private bank that has recently been all over the news. I think it odd that a man in his 30s can't pronounce such words. It's not as if he's mispronouncing a Latin quip or some technical or scientific jargon. The slight relevance of it is that he couldn't remember the name of the company, even though he'd traveled nearly 100 miles to visit it, and the name of the company is a simple three-letter acronym. Maybe he genuinely couldn't remember, and in his defence, his poor literacy would suggest this is a possibility - which is why I mention it - but I think that was an act. I think he knew full well where he was going and what they were doing there.
