Filming is already precluded as grounds for suspicion by the ACPO guidelines; therefore, the 1st premise is invalid. You handled them exactly how you should of and I really hope you do sue them for their unlawful search using the terrorism act. They didn't have reasonable grounds to suspect you are a terrorist, in order for them to have grounds they would need some kind of evidence that you are engaged in terroristic activities and being that public photography is not a crime and they had absolutely no evidence to suggest you were engaged in hostile reconnaissance the search was unlawful in my opinion, Suspicion is just an opinion and not a crime or grounds. The police cannot just walk up to people taking picture and quote the terrorism act at them in order to search them. That's like stopping a jogger and searching him because he was running down the street. They swore an oath to protect your human rights but violated them instead.

Once they quote the terrorism act, they leave themselves open to action. If they quote it, simply ask them to provide written and signed authorisation from an assistant chief constable or a rank above that, stating that particular geographical area had been designated as an area under threat of terrorism. Such a designation is only valid for a period of 24 hours and then needs to be reissued. If they produce such a document, obey their orders. If not and they still continue to act as these officers do, they are committing a criminal act. sue them.
When he tried to explain the grounds for the search he mentioned you failing to ID and so pretty much admitted that his intent was to violate your right to anonymity. Was anything ever done about this?

At 2:42 PC1461 clearly states "He's (security) just said, he said that you haven't been aggressive". At 5:55 PC1188 clearly cites a reason for the detention and search as "we've been told that you've been aggressive at this site..." This allegation had already been confirmed (by PC1461) to be a false allegation. That fact alone is reason enough to prove this to be an unlawful detention and search.

The complaint must be made to the Warickshire professional standards dept it is they who investigate 'procedure' complaints the IPCC only investigate the more serious incidents. In this particular incident it is all captured on video and to be honest the officers were caught abusing their powers, telling out and out lies, etc etc and I am aware of officers being sacked for less than this. The senior officers ought to be made aware of this incident so they can see for themselves what these officers said and did. Extremely unprofessional and this video should be used as a training video for other officers on "how not to do it", after all it took place outside Ryton on Dunsmore which is one of the main police training schools. Maybe they should have an hours lecture on "Public Photography " to stop this type of thing happening and educate the new recruits.

In England, Wales and N.Ireland, Police Officers are crown agents. They do what the Queen's legislation tells them to do. As it is other Crown agents who investigate, Crown agents are free to break the law and abuse their positions. In Scotland we have Constables who are public servants. They combine these duties with their duties as Crown Agents. Often they will abandon their public duty to uphold the law and commit a common law offence in order to enforce legislation. I now deduct the portion of council tax I pay for policing. I tell the council I'm not paying for a service from an organisation I believe to be corrupt. I suggest we all withdraw funding until they stop being an organised crime gang.

In your example of 5 hours outside a home that could fall into a stalking or harassment issue but would be near impossible for police to prove the intent. Definitely. The trouble with the police (well most humans), is that their egos prevent them from admitting they are wrong. They have to 'win' ahead of actually doing the right thing. Almost 100% of the channel’s content is him being kind, argumentative and nice to police who try to infringe on his rights. Then when he refuses to have his rights raped he is unduly detained and searched for no reason. So far so good, but when he rightly threatens to sue these tyrannical pigs to teach them a lesson and set an example for the other tyrannical pigs, and he leaves it alone and does not sue anyone, it does the opposite. Police officers gain even more confidence to continue tyranny.

I follow A LOT of american auditors. They sometimes win but they have to sign NDAs and its almost never get public what they get. They ALWAYS SETTLE OUT OF court, the state just has to dangle money on front of them and the taxpayers pay for the cops wrongdoings and they get a few days of payed vacation as a thanks for violating peoples rights. There are also LOT of empty threads, and auditors just never suing. I do not know about the UK laws and how it works but I bet he actually never sued because he just want to make money on youtube, does not want to risk the lawyer money ... my guess is there is actually some tyrannical law on the UK that allows them to do this and claim that suspicion is justified in this case. I hate this about auditing. I would be happier if they would sue, lose and TELL ABOUT IT rather then this BS. Watched so many videos where the audience wants to know what happens and the anditors never answer ...

As you say, 47 requires a senior police officers say-so and 43 requires the search be halted if a reasonable reason for the actions of the individual is presented to the officer... 3.4.9. If, as a result of questioning before a search, or because of other circumstances which come to the attention of the officer, there cease to be reasonable grounds for suspecting that the person is a terrorist or the vehicle is being used for the purposes of terrorism, the officer may not conduct a search under section 43 or 43A. In the absence of any other lawful power to search or detain, the person is free to leave at will at that stage and must be so informed.

If this criminal genuinely thought you were a terrorist BEFORE his illegal search, exactly what was it that allayed his fears AFTER he had carried out his illegal search? The fact that this petty bully was satisfied that you were not a "terrorist" after illegally searching you and finding NOTHING proves that he never actually suspected you in the first place. You - legally and rightly - said "No" to him and he didn't like that, so he suddenly played the terrorism card in order to get your ID. When that failed the lying little shit knew he was beaten, so stopped trying. An HONEST suspicion with nothing useful either way found in a search would have lead to arrest and further investigations to establish your identity. Please, PLEASE, follow up on your threat to sue them. Contacting CRIMEBODGE would be a great first step. Keep up the good work. 🍌👍
