The nurse was only doing what she was told. she was not an individual but an agent of the hospital. Arresting her would not get the LEO the blood. The order has to come from someone above her. Nurses are not allowed to draw blood with out a doctors order. When given the standards that the police gave then one when blood can be draw. Exigent circumstance was on the legal document. When the watch commander was told this. He should of order a warrant to be . . . oh wait they don't have probable cause. SO they have no rights for the blood.

I disagree with you about the hospital because I has seen a similar situation and the hospital protected the nurse. The hospital lawyers, higher ups, and security was on scene to protect the nurse but this hospital higher up was talking through the phone. That this why they, the hospital, and the police department with her

I am an ER nurse and this was so illegal as to be insane. You cannot force a blood draw without a warrant or consent PERIOD. Every ER nurse I know was so pissed at this.

@@lorehammer40k4I just wish she would’ve thought to ask him what the exigent circumstances were. I think that would have really thrown him for a loop trying to explain how someone injured by a suspect they were chasing just had to have their blood drawn right then and there.

I bet his training says to make sure he says "exigent circumstances" for the camera whenever he's trying to circumvent a warrant, just like they train him to repeatedly yell "stop resisting" while assaulting everyone regardless of any actual resistance.

My wife was an RN charge nurse in a hospital and i can gurantee she would have done the same thing this nurse did. She was very good at protecting her patients well being and their rights. Nurses are special people and very devoted to their patients. My wife was a nurse for 45 years. God bless all nurses for they truly are special and needed.

They are violating a patients rights and are arresting a charge nurse for protecting the patients' rights and for following hospital policies and procedures. They need a warrant or court order signed by a JUDGE.

The fact that Payne didn’t apologize means he didn’t want to admit fault and just blamed his superior officer who in turn blamed him for not getting all the facts. may I ask you how you deal with truck drivers involved in fatal accidents? Federal motor vehicle regulations require blood tests of all CDL drivers involved in fatal accidents whether or not the driver is at fault. This patient was a truckdriver involved in a fatal accident. Now, the way the officers treated the nurse was wrong and they were trying to get the blood under the wrong laws. And the hospital has poorly trained their ER staff on the matter of dealing with CDL drivers involved in fatal accidents.

No, she was actually breaking the law if state law required a sample in the event where injuries result from a motor accident, and hospital policy can not say otherwise. What saved her and the hospital in this case was his animalistic behaviour because his ego was bruised. Would you feel the same if your child was killed by a drunk driver and she refused the draw

A nurse so concerned about you getting busted with being on drugs or drinking while driving? Or why would you not let them check your blood? I hope my nurse gives it to them so they know I'm clean or that if I am on something I will be punished for it. But thats just my take and also I dc if it breaks any amendments or some shit like that

She should have been given a, " huge Promotion and Raise!",.. especially for "Protecting the patient Rights, while he was unconscious and willing to go to jail for her patient!",... She is the most responsible and respectful NURSE I have ever seen and heard,. Considering most of the time,.. a lot of them are unable to deal with the public and treat incoming people like they are not worthy of their time or having to do paperwork,.. but don't get me wrong,.. I do have the upmost respect for the ones who love their job and helping citizens with their needs,.. it's the few who just want to sit back and earn their living for doing nothing!😮 !.. as the saying goes,;.. "If you can't stand the heat!,.. get out of the kitchen!",... In other words,.. When you feel that the job is too much for you or too stressful,.. get another job or quit!.., B4 you make yourself and your fellow workers look like they lack any kind of "Empathy!"... 😮!😢!..😢 Stay home and take care of yourself and your family,...😮

My mom once had to run outside, leading hospital staff, to break windows and evacuate elderly patients during a fire. I can picture her in the same spot doing the same thing as this nurse, along with all the other nurses she worked with. Nurses intimidate me, honestly, and I think these cops were afraid she was tougher than they were! And she was.

Yes, that was what really got my blood boiling, supervisor shows up and is basically gaslighting her "why are you involved...do you know him...etc...etc". I read a long while back that this whole thing is because they wanted to get a blood draw for any chemicals because the person/family may sue the department for the collision because of a police chase. So if they had even the slightest BAC/drug it gives the police an out in court. Mind blowing.

The cops request should have ended right there when she read that paper to them that was the agreement between the hospital and the police. I come in the hospital and the nurse they did an outstanding job those two police however should be in the unemployment line neither one of them deserve to even be in any kind of law enforcement. I doubt if they could even make it as a security officers

This nurse should be the poster child of excellent nursing care and patient advocate. It's not always just about physical nursing care but standing firm for your patient. My daughter is a charge nurse I pray she would be able to emulate Nurse Wubbels in the face of such condescending and aggressive confrontation. Im sure she will though after seeing this.These 2 people should never have been allowed to remain in law enforcement.

Not to use the threat of arrest to extort or coerce people to give up their rights. Which is exactly what happened. They used the threat of unlawful arrest to extort and coerce a nurse to illegally violate someone else's rights who she was in charge of at the time. DISGRACEFUL.

Personal Update: Although Det. Jeff Payne was fired for the incident, he still claims he did nothing wrong. He sued the City of Salt Lake City for 1.5 million for wrongful termination. He lost and his appeal was denied. He then was hired next door in Weber County as a Jailer. - The University of Utah medical center changed their policies now to where the police cannot contact anybody in the hospital until cleared by upper management.

“…body in tow…” does nothing but make it clear that they do not view this innocent nurse as a human being. She’s nothing more than a “body”. And, SHE isn’t the one refusing the blood draw. The refusal is at the behest of the facility where she just happens to be working. These imbecilic LEOs aren’t even “targeting” the right people by trying to arrest this woman. It would be like being told to leave a movie theatre by the owner, and then turning around and punching the janitor in the face. You don’t take out your frustrations with someone who has no control over the situation whatsoever. This whole situation is miles away from appropriate conduct and is just a hugely unnecessary display of incompetence and sheer stupidity.

In the UK. the Nursing and Midwifery states that the patient's nurses are the patient's ADVOCATE. An unconscious patient CANNOT CONSENT, they had NO warrant AND the patient was NOT under arrest. END OF!! Well done Alex!!! ❤❤❤❤❤

Unfortunately she and her management were wrong in this case. The exigent circumstances apply to a situation where there is a traffic fatality and the suspect is unconscious. Under those circumstances cops are allowed to legally draw blood from the unconscious suspect to determine blood alcohol level. Hospital policy does not trump the law.

It takes 4 years to train a nurse. How long does it take to train a cop?! I‘m a retired nurse. I worked with cops occasionally while on ER duty. Fortunately I never ran across cops that have such a short fuse as this bunch does. Bravo, sister, I’m proud of you!

I am of the mind that these kinds of cases should be treated like child support is treated in the US. Base it on what we know the person is capable of making. If you made 50K per year, you need to pay at least half, if not more, toward what is owed on the lawsuit. If you can make 50K, but voluntarily choose to take a lower-paying job, you should have to pay the same amount, regardless. A refusal to pay will result in a seizure of assets, and potential jail time. In addition, the debt owed to the individual should be treated like a student loan in that it does not go away by declaring bankruptcy. The taxpayers should DEFINITELY not be the ones who have to pay for the poor decisions made by officers.

I'm a medical professional and followed this story closely when it happens. One aspect of this case not presented in this video is that Detective Payne also had a side job as an EMT. He was caught on tape commenting that he could retaliate against the hospital for Ms Wubbles refusal, saying "“I‘ll bring them all the transients and take good patients elsewhere,”. The ambulance service he worked for fired him a week of the tapes being released. I can see why it wasn't included in this video as it doesn't really raise any legal issues, but it does speak to Payne's sense of entitlement.

To add insult to injury, the cops didn't even need to chase the guy in the first place. Cops caused the accident. Unless the suspect was a mass shooter or something, all they did was put hundreds of peoples' lives in danger with their reckless driving.

@@baldisaerodynamic9692 Not exactly a payday, and it would have been a lot more if she had sued the Police Department instead of accepting the Settlement that was quickly drafted to cover their behinds. She also donated a portion of the money to other victims of police wrongdoing who can't afford the fees to get the body cam video. And then there is the 30% or more that went to her attorney, and then Uncle Sam and his State Tax variant got their share too. She probably ended up with less than $200k, and ended up emotionally scarred forever.

Another reason why all police officers should be compelled to undergo Constitutional law training before being certified as an officer. A 4 year law degree would eliminate many of these tyrants before they get to strong-arm people and violate basic, Constitutionally protected rights.

Thing is, if the rules are clear cut like that in the hospital and its stated clearly. You should all stand by it. If you get arrested its a pay day. Its like someone getting hit by a city work truck or company vehicle, its a form of lotto. The cops were trying to exploit a loophole but the hospital records had no gray area, it was black and white. 1 of these 3 conditions had to be met and neither of them were. Instant lawsuit win for the cop trying to arrest someone following hospital rules which almost always supersedes the law because of HIPA.

Cops do not like being told no and that triggers their aggressive behavior. This is a perfect example of that. Before any of this happened the cops needed to review the law and the hospital guidelines along with the circumstances of the case. If they had done this none of this should have happened but they let their anger override all of that.

He would follow my mom around town, in his cruiser, pulling her over when ever he could. I couple years back he pulled her over and tried to come up with something to get her in trouble with so my mom brought all this up to the police chief and now he’s not allowed anywhere near my mom, if she ever were to commit any crime/ infraction and he’s the responding officer, he has to call another cop in because he was absolutely obsessed with her. 🙃 he’s also a huge racist and I’m mixed so… that’s probably a part of it too

This guy specifically, he got caught messing around with under age girls while he was on duty, in his cruiser, and got suspended with pay for like a week and he’s still on the force somehow 🙃 not to mention when he hit my ex fiancé (who was driving my car at the time) with his cruiser and then tried to ticket my ex 3 days later for scratching the paint of his push bar, as if he didn’t crack my whole front bumper

Best part of the video: 6:34 where the other officer there asks the Detective (quietly), "Why don't we just get a search warrant" and the Detective says "Because we don't have PC" - in other words, he knows he has no probable cause to get a warrant to get the blood - that admission right there shows the officer knew he couldn't get it lawfully so he is trying to use threats to get it instead.

If I'm unconscious in a hospital, i want this nurse in charge of my team. This hospital should have had its attorney on the spot immediately to defend itself, as well as its employee.

She touched my heart by taking patient care to a higher level. She is a beautiful and courageous woman inside and out. She deserved to win her lawsuit and collect her settlement or judgement. Makes me happy for her. Justice has been served while in most cases we bring are not won.

Fun fact: the U Hospital doesn't let officers beyond the lobby of it's hospitals anymore. They held deliberate training on how to handle this in the future: you call the U of U police and ask them to escort the "officer" off of the premises. It still happened a few times after this event took place but eventually SLC PD got the picture. Another fun fact: SLC PD hopped a fence into someone's private backyard and shot and killed their 6 month old doberman puppy because "they felt they were in danger." The dog was 30lbs.

Police are dumb AF. 3 out 5 homes in America have a dog. People who deliver mail, amazon, carriers, pizza, Uber etc who encounter dogs all the time and are not allowed to carry weapons. If you are to scary to deal with a random dog, then you shouldn't be allowed to be a police officer.

Another fun fact: a slc pd sergeant was caught having sexual* relations with a homeless woman multiple times. The woman claims she was forced and the officer claims it was consensual. The officer was fired luckily but the homeless woman was paid to shut up and not report it by the police department. The officer was also married.

This incident is a perfect example of why you should know your constitutional rights, especially when dealing with law enforcement. Most of our police do not know any titles and details of any amendments. My heart goes out to the brave nurse for protecting, hers and everyone in that hospitals rights!

Unlike cops, nurses receive extensive training on their moral/legal obligations and patient rights, plus the criminal, civil and employment penalties they may face for misconduct. I trained in the 1970s and even then those were made very clear.
