When they keep repeating a made-up job title that sounds like some government official you KNOW its bollocks. Same as 'TV Licensing' a made-up business of Capita and their 'enforcement officers' who are just ordinary employees with zero legal powers to question people even. Few important facts people need to know about 'court baliff's': 1) They work for private companies, they're nothing to do with the court or government, although they like to give that impression. 2) They cannot force entry into a property, they have to be invited in, but if the door is opened to them and they can gain entry they're allowed to walk in, so DONT INVITE THEM IN. Even if the police are present, you can keep the door locked, not answer and they can't force entry. 3) If you have a debt and the court has assigned contracted baliffs to collect that debt, you can just contact the baliffs and make a reasonable minimum offer you can afford to pay (ie £1 a month) and they cannot normally refuse to accept that. If they do, you can request it be referred back to the court and provide proof of your inability to pay more.

sending bailiffs is the last resort for any company/organisation. there are processes in place and procedures to follow before a bailiff knocks on your front door. In this case, clearly the defendant has not responded to the claimants requests for payment. neither has the defendant made an effort to reach an agreement or payment plan. they then record their nasty actions and post it on social media to try and justify their wrong doings. makes me sick just watching the video and reading the stupid comments. people, take responsibility for your actions, and most importantly, GROW UP!!!

That is true, but often the reasons for sending one may still not be entirely legal. Nor the conduct of companies involved. Magistrate courts and County Court judges often have no legal qualifications or understanding of the law and issuing warrants is a mere procedure. I agree though, it's always best to make contact with your creditor, not the bailiff or any third party interloping debt collection agency. The whole warrant and bailiff situation can 95% of the time be avoided if you know your rights, contact your creditor, request a copy of your contract with 28 days notice under the CCA (template letters available online freely) that will either render the debt legally unenforceable and halt any court action, else if they do have a contract and/or you accept liability for the debt, you can make an offer of payment which you can reasonable afford to pay, but that should be made to the creditor. If they have sold on the debt, they will likely not want to deal with you and refer you to the interloper, but you have absolutely no legal liability to deal with them, so again, that can nullify the debt.

If this man didn’t have a warrant, which I doubt he did as he is on his own. Then walking into your house when you asked them not to, that is most definitely threatening behaviour. As far as a court would be concerned that is trespassing, you would also be able to use reasonable force to remove them. Though it’s best to phone the police first in case it escalates. The bailiff has NO Right to stay in your home . When he say's he has the right to enter because the door was open is Correct because an open door is regarded as an Invite to enter . This simply means you cannot Sue him for Breaking in . However once you tell him to Leave he is obliged to Leave . They are not obliged to leave, once they have gained access to a property that's all that they need. Once they are through that threshold of the doorway you've lost all rights. They have a right to search the premises if you can't pay to total up the price of the items in the property.

What right do you have to enter my house? Who gave you that right? Who gave them that right? A job title does not give him a right. A law doesn't give him a right. He has no right to be there regardless of where he is from. There is no lawful obligation of anyone to ever pay any tax, it is and always had been voluntary. They also have no right to ask you to identify yourself. They could be anyone from anywhere walking into your house.

I'm lucky to live in a Block of Flats, Sure it's small here. - But if an Enforcement Agent turned up, they need to get through 2 Doors "Peacefully". If they wish to speak to me.

Good work Sir. Although I could be wrong, I think he might be a debt collector instead of a court bailiff. I've dealt with both and never have I seen a bailiff walk away without calling for police backup. Debt collectors are quite a bit weaker than bailiffs

Black Ash Finally, someone who knows what they're talking about! You're absolutely correct - debt collectors don't have the same powers as Enforcement Agents (AKA Bailiffs) and have to leave if you ask them to - this is why it's important to ask for their ID in the first instance, so you know who you're dealing with.

Door open ? Critical mistake ! And the problem you may now have, now that he's gained peaceful entry, is that he can legally force entry on any return visit.

Hobowith ashotgun If he is an enforcement officer with the weight of the law behind him. Not if he is a debt collector acting with no legal authority other than the obvious liability order which actually never exists as all they ever have is an approved application form for an application order. If he has not identified himself he is no one, if he identifies himself as a court bailiff why isn't he in court being a bailiff, if he tells the truth and says he works for, rundells or marstons and he came in your door, shove him out.

If the door is open an enforcement agent can gain peaceful entry. They cant force entry.
