The plaintiff is beyond silly. He’s so desperate to to win he literally admits to trespassing… He definitely only did the greasing in preparation of the lawsuit. This looks really bad for his business.

bottom line is NEVER give a small independent business your credit card info or bank card info . u should pay cash to those type businesses but if u need to use a credit card then go to a larger more reputable business that will be less likely to put random charges on your card or be unorganized in regards to how they bill and charge.

I don't think it was a crime. If the Defendant boat was being stored in their drydock then he has left the boat in their care & on their property. It may not be proper etiquette to board the boat but probably not illegal.

The defendant shouldn't take his boat back the the plaintiff....ever. The photos of the greased prop shaft show that they greased it on the day they went to take the photos, it doesn't show that they had done it when they say they did. If they really wanted to prove they'd done the job they would have videoed the prop removal.

You guys are trying to put to much nefarious intent in this case. Those guys are used to verbal approvals of work after having the charging info gathered annually. I bet those guys come through & say this/that is happening and they go take a look when they get a chance. The Defendant stated as much, when he stated that someone came onto his boat in December. Did he think that was free? I have experience with that high oxidation on certain engines or metals, because they're of the grade of aluminum. If you replace a battery & it just sits for months, you have essentially wasted your money, the oxidation going with his overall system will oxidize the battery as well. I. The future he needs to disconnect the batteries completely when he stores the boat.

@@panamafernandez4641 100% of my work is done on verbal approvals so I know, but this guy is running a crappy service. I've been doing it for over 20 years without a payment issue, but I provide a good service at a very good price so people are happy to pay. Dual prop drives are known to have corrosion problems because of the high amount of stainless steel, but it doesn't happen in dry storage. That propellor nut hadn't been touched in a very long time. If a customer asked me for a new battery and I knew his boat wouldn't be used for a long time I'd try to convince him to wait 'till he's planning to put it back in the water, but most mechanics won't do that and I don't think they're wrong for just doing what the customer wants. A standard lead acid battery will go dead after a few months even if it's switched off. It should still take a charge and be serviceable, but some people just opt for a new one. I put those on a special charger that brings them back to like new condition and use them for my toys or sell them cheap to people with less money.

once they sent the defendant the new work order and the defendant did not contact them soon after that telling them not to do any work , then he was already on the hook to pay because he gave them his credit card info up front already . the defendant tried to use what he thought was a technicality to get free work and in the end he admitted the xtra work had been done so i dont care how the plaintiff got his evidence because he was in the right anyway and for the judge to make an issue of that is ridiculous . i believe if a person sues you and you know they are lying then do what u must do to get the proof they are lying .

They could look at the meta data if it has any and see exactly when and where the photos were taken. Most people don't know that Edit: that was a messed up thing to do taking those photos. If I was him I'd get the boat inspected to see if they damaged anything when they took the photos.

I would never live in a place where the landlord pays for the electricity and/or gas unless there was no other option because the landlord can dictate what the temperature should be set at.

Nope - we live in an apartment where utilities are included and our landlord has never said word one about anything. Of course, we are careful as if we WERE paying but it's never even been mentioned. I've also lived in utilities included places previously and it's never been an issue. But I agree with you, if them controlling use of utilities was part of the bargain, I would never go for it either.
