If I make a reasonable accommodation request to work remotely, and my current supervisor says they cannot accommodate me, what happens if during a basewide search I get offered a remote job that is the same pay grade but completely different than what I am doing now? For example, none of the same duties. Would I have to accept it or could I deny it and apply to disability retirement?

If you are getting reassigned, but you are currently a law enforcement officer being reassigned to a non law enforcement position will you be able to keep the law enforcement retirement because it is due to a disability?

If you are reassigned as a law enforcement office your new job should be at the same pay and grade level, allowing you to keep your law enforcement retirement. Federal Disability Retirement would allow you to receive your law enforcement retirement once you turn age 62.

Due to having a disqualifying medical disability you can not be reassigned as another law enforcement position. That being said, the reassignment will not be a law enforcement position, because of this will you lose the law enforcement retirement if you they find you a non law enforcement position and you have to take it, you will lose the law enforcement retirement and will be transitioned to the regular FERS??

Thank you! One more related question, please. If the illness is not due to something that happened on the job and is an unrelated illness that has been deemed you “medically unfit”, will the Fair retire act still cover you? It seems it is only for job related illnesses. If not, then you would lose 6c LEO coverage and retirement?

It is likely that an unrelated illness would not qualify under the fair retire act. You may lose your special provisions retirement in this case. It may be beneficial to explore Federal Disability Retirement in this case.
