I was approved for accommodations, but they have not been met yet. One of which is a chair that elevates my legs to waist level. I am in extreme pain, and can hardly move. I was working from home, and they do not want to let me do it any longer although I can do my job 100% remotely. I have emailed the HR department regarding the results of my working in office outside of my accommodations, and they asked me if I would be in office tomorrow since I mentioned being in pain. (My supervisor actually threatened to fire me if WFH was written on my ADA paperwork btw). What is your advice?

It sounds like you may qualify for Federal Disability Retirement! If your agency is unable to (or unwilling to) accommodate your medical condition, you could still qualify. Harris law firm helped me receive my OPM FERS retirement 5 years ago. I didn’t work that whole time until now. I am trying to be a 1099 worker. If I create a LLC and just take a low enough salary from that LLC to meet OPM disability retirement requirements, is that all the income that I have to claim? The rest of it would be in the business (invested back in the business or used as expenses, etc). Or would OPM count the entire amount made as the LLC business? What about if I had a partner and paid them a salary too? That would be an expense in the business so it would reduce my overall business accounts.

If you are approved for SSDI there's a very strict earning limit. If you earn more than the substantial gainful activity limit, which is currently $1,550 per month, your benefits may be stopped. At age 62, your Federal Disability Retirement benefits will automatically transition into your regular FERS retirement!

I was just recently approved for FERS Medical retirement, but I’m required to apply for SSD. If, I’m approved for SSD, my medical retirement will decrease. Can I withdraw from SSD without it affecting my medical retirement? I asked social security and they told me if I deny or withdraw, they notate it on there. So, what do I need to do to make sure SSD doesn’t approve me?

Applying for SSDI is a requirement set by the OPM. You cannot withdraw your application without it affecting your Federal Disability Retirement. But the requirements for SSDI are pretty strict and there is a very low earning cap, so if you are not permanently disabled you likely will not be approved.

If you only have 5 years service would you then get 1.7% per year of your highest 3 after age 62? (5X1.7% = 8.5%) Or do you get credit from your date of hire to age 62? Does the Government also pay out on injuries acquired on the job which led to your disability? Do you guys handle that too?

That would likely still be considered a federal organization which would impact your FERS disability annuity. We do not recommend working for any federal organization as it may risk your annuity.

Great question! Unfortunately, on Federal Disability Retirement you can no longer contribute to your TSP and you will not receive any matching from your agency. You can either leave your TSP account alone and allow it to accrue interest, roll it over into a private sector account, or cash it out, but you may incur a penalty depending on your age.

It will depend on your specific case whether OWCP will pay you in a lump sum or payments. If you are receiving another form of monthly payment, like disability retirement, you are more likely to receive your schedule award in a lump sum.

I hired Harris Federal to work on my federal medical disability retirement. However my claim just got denied. Even though I’m a VA 💯 P&T, OPM still denied my claim. I’m a little bit concerned because even though I haven’t resigned, I can’t perform my job duties due to my disabilities. The agency also won’t accommodate me to a new position. In case, I lose my case do I have to resign or I’ll get fired? Thanks

The OPM has been denying more cases so don't worry, this isn't unexpected. Your case manager is already on top of the situation and is working on the next steps for you. If u r just out of FMLA and are on LWOP for maybe 2 more weeks or so, then let go for medical reasons. if you have already submitted filing for disability. Is there a way to continue your health benefits during the waiting period ---- of: the time from when u are medically removed and until decision from OPM is made?

There isn't a way to continue your federal health insurance at this point, but you can have it reinstated retroactively to cover any out of pocket costs once you are approved for Federal Disability Retirement!

It is not recommended to separate before being approved for Federal Disability Retirement, and this is one of the reasons. But if you are approved for Federal Disability Retirement, you will begin receiving interim pay while the OPM finalizes your annuity, and you will receive a lump sum of back pay to cover any time you were out of work.

While on Federal Disability Retirement, you will be receiving a monthly payment that is a portion of your high 3 average. After the first year, you will be receiving 40% of your high 3 average every year. You also have the option to work in the private sector and earn up to 80% of your previous salary on top of your Federal Disability Retirement monthly payment. If I make a reasonable accommodation request to work remotely, and my current supervisor says they cannot accommodate me, what happens if during a basewide search I get offered a remote job that is the same pay grade but completely different than what I am doing now? For example, none of the same duties. Would I have to accept it or could I deny it and apply to disability retirement?

If reasonable accommodation efforts aren't able to find a position that can accommodate the employees limitations, but they are considered/hired under schedule A for a much lower grade level. Will accepting the lower GS stop OPM from considering their disability application?

Good presentation, and I see a lot of good questions and answers in the comments. I used Harris and was recently approved for retirement. I know everyone’s financial situation is different but if you can afford it, I recommend using them. You may think you have an open and shut case but when you get your first denial decision you’ll be glad to have the experience on your side taking care of the process for you. My case went through the first and second denials, to the mpsb review. I was really worried by that time that perhaps despite all my beliefs to the contrary, and 3+ years of medical issues and work impact, I didn’t actually have a case after all. The lawyer managing my case reassured me of their opinion and the legal standings behind my claim, and told me to just try to hold on a little longer, and she was right. A few lessons from my case for those that may be in a similar situation: 1) I have used the VA for my medical care for the past 8 years, give or take, and as others have noted, their doctors don’t always want to put their name to anything about work difficulties that could be used as part of a VA disability claim. I’m not saying if you’re heading down the road of disability retirement that you need to go find a private doctor, but it probably would have made life simpler in my case. 2) As anyone with federal employee supervisor experience knows, the performance rating system is enormously flawed in that it’s nearly impossible to receive anything lower than a ‘3’ which by definition means “fully successful”. In order to rate any lower requires numerous steps of documented discipline over a period of time, as well as the creation of a performance improvement plan, things most supervisors don’t want to have to get themselves into as it’s just more work for them. Likewise, if you’ve already disclosed your medical difficulties and requested reasonable accommodations, it makes any discipline that much more unlikely, as there is always some level of pity for your situation, and the agency most likely doesn’t want to chance making themselves a target of a discrimination claim for ‘punishing’ you. So, long story short, chances are you won’t receive anything less than “fully satisfactory” which in my mind makes it difficult to claim a work deficiency. This is where the RA process is crucial, and Harris again knows what needs to be reflected on it to demonstrate a deficiency. Anyway, that’s a bit from my experience, and hopefully it helps someone that is trying to navigate through the decision process of preparing to file their own disability retirement claim.

whats you fee? i gave them medical records for past 4 yrs, 3 medical statements from docs recommending medical retirement, leave usage, FMLA, VA verification form and I was STILL denied.

Great question! If you are approved for SSDI, you will be limited by the SGA limit. The SGA limit for 2024 is $1,550 a month if you are not blind.

This seems a little unfair if forced on SSDI, since my illness is an automatic approval for SSDI being on compassionate list.

If you earn over the SGA limit, your SSDI would be affected, not your Federal Disability Retirement. If you are taken off of SSDI, you would be able to earn up to 80% of your previous positions current salary on Federal Disability Retirement.

If you are receiving OWCP wage loss payments, you cannot receive a schedule award for the same injury at the same time. You can wait until your wage loss runs out to apply for a schedule award. You must be at maximum medical improvement to receive a schedule award.

Current FED LEO w/15 years service + 4 yrs other non-LEO service. Approaching 62 yrs old. Does a special provisions disability application have to be approved prior to turning 62 to get the disability at 15 x 1.7%? If 62 and over when apply, will it will only calculate at 1% for 19 yrs? Agency made a mistake in hiring many LEOs past the maximum entry age, and now advise they need to keep working past 62 (no matter the age) to get the 1.7% with 20 years of LEO service. No prior military service.

If you are approaching 62 already, going through the Federal Disability Retirement application process may not be beneficial unless you have been out of work and are eligible for backpay. Federal Disability Retirement will end at age 62 and you will automatically start receiving your FERS special provisions retirement, which will be calculated at 1.7%.

At age 62 your Federal Disability Retirement will transition into your regular FERS retirement. At this time, there will no longer be an offset between your SSDI and Federal Disability Retirement. You will receive your regular social security at your full retirement age which should be around 66.

I’ve been on wage loss for two years. I am scheduled for a second opinion ime to try to kick me off of wage loss. If they do, but im still not able to return to work full duty anymore even if they second op says I can work to some capacity, do I still qualify for disability retirement? And can I get a scheduled award if I don’t go back to work? My doctor has me with restrictions and off work. Back injury 2 surgeries going on 3. Still with pain.

If your wage loss ends and you are still not able to perform at least one essential function of your job, you may qualify for Federal Disability Retirement! Schedule awards do not interact with Federal Disability Retirement so you would be able to receive both at the same time if you have reached maximum medical improvement. Great question! Your sick leave is added to your years of service in monthly increments and your annual leave is paid in a lump sum upon separation. The OPM will make sure that you receive payment for the time you accrued.
