I am from Rajasthan, and Neem is a very important tree in my culture. We have folk songs dedicated to it. We traditionally use it for brushing. We use its oil as a fungicide. We use dried neem leaves for storing grains. We use Neem bark for medicines and we use neem fruit for food during Famines.

Food is medicine. Don't eat too much. Pharmacy is derived from Greek terms similar to snake oil salesman. Starvation will kill more ailments than man's medicine will ever do. Take proper vitamins, let acrophagea do it's job, eliminating everything unnecessary to the body. You will lose muscle if you don't stay active, but your body is smart, let it eat cancer, tumors, warts, and anything else not needed. Fast often. 2-4 days. Lean is what will keep you alive. Don't live to eat! Losing weight? Good, if you are not thin. Pay attention, eat beef. Fatty, grass fed Beef. Grass fed free range chickens too.

Nah. If there is evidence to suggest that a traditional medicine works any better than placebo, someone will sell it as such and make money doing so. They will also research ways to create new compounds from the traditional medicine, like how we made aspirin from salicin, from the bark of a willow tree. Salicyllic acid is still sold in vast quantities for its medicinal properties - they are proven so people are making money from them.

I think that bioimperialism would be more appropriate. Piracy implies, that you are taking from someone richer than you, but this is more about wielding power over other's actions, how we understand nature as something that is owned and that has to be owned in order for it to have any kind of a value. Imperialism, how to cultivate (exploit) what is savage.

This has been a problem on the Canadian prairies for many decades, with large corporations creating problems for local farmers. As one example, the Canadian Organic Growers (COG) in Ottawa has been advocating for ethical use of nature in Canada for over 30 years now. I think the Center for Food Safety in Washington DC has been doing the same in the US. On top of this farm and food safety work there's still a lot reconciliation with Indigenous Peoples work to be done too.

Copyright restrictions have basically Enslaved the agricultural industry, many farmers aren't allowed to keep any extra seeds for replanting the following year forcing them to buy more seeds from the very same people taking them. The inventor of the seed should only get a percentage of profits from the farmer.

@@superskrub4209 non-copyrighted seeds are more prone to diseases and are all round worse than the copyrighted versions. GMO seeds, which are typically copyrighted, could even be more beneficial to the environment than the organic versions, as many of them use up way less water for the same amount of crop. Less pesticides also have to be used if the plant is a gmo as they can have built In protection against certain pests.

Alternately, all seed makers should just sell seeds at a level playing field. Farmers already purchase seeds, why should the seed company be entitled to a share of the farmer’s income on top of that? Further, it’s not like conventional agriculture has led to a bunch of rich farmers. No most farmers are reliant on subsidies and many are in debt due to the conventional model’s high input costs.

This reminds me a lot of the new wave of unionization that we see happening in the past couple of years. Our economy has a serious problem where the people who actually create value (the indigenous tribes in this case) don’t get a good cut of the profits. So instead of our economy constantly closing the wealth gap by raising new groups of people up to new levels…it does the exact opposite. I’m glad to hear of at least a couple situations where people have been able to correct this.

Correct. Identification of a molecule cannot warrant a patent, but the isolation of it for a specific use (as well as the procedure employed to isolate it) can be patented.

I think patenting should probably be allowed, but maybe it should come with a fair expiry date, like in the case of copyrights. After expiry, the knowledge should be made freely available. This way researchers will get their due credit, but no one will be able to monopolize over it for extended periods of time.

@@adisage no thing of nature should not be monopolized in the first place like in the case of basmati rice it was patented by RiceTech a company of USA in 1997 although it was traditionally never found outside of India. Even indian brands could have filled patents but they didn't and now they have to pay royalties to an American company for a crop grown in India marketed in India and sold in India. Patents should only be allowed for certain technologies or innovations not nature.

Being able to obtain a patent isn't the be-all end-all. The patent can be invalidated. With respect to completely new compounds, I don't think there's necessarily an issue with giving them a patent assuming we wouldn't have access to that compound without their research. With regard to compounds which are already in use by indigenous communities, these patents can be invalidated by demonstrating they were in use before the patent. There is definitely an incentive for manufacturers of generic pharmaceuticals to contest these patents so they can make their own generic versions. The problems are that it would be cheaper to let someone else do the legal wrangling and then manufacture the generic if they're successful AND the legal costs could be quite expensive.

Most of the industrialised Nations are rich financially but poor in biodiversity and traditional knowledge. In contrast the developing and the under developed World is rich in biodiversity and traditional knowledge related to bio resources. So rich Nations exploited the bio resources to develop modern applications and they saved time, effort and expenditure during their commercialisation. The big multinational companies and other organisations use the bio resources without proper authorisation from the countries and people concerned without compensatory payment.

Arguing generally against patenting of any traditional knowledge is very different from arguing that communities having those traditional knowledge should be given patents or compensation instead. Latter is nonsensical and impractical. We Indians don't mind if some company is using our traditional knowledge to make money, but if only some company/companies get the right to use our traditional knowledge without us having any say in it, then it's just plain wrong but more importantly, it's bad for all, especially for the people to whom these products are sold and for the countries who are allowing such patents. Ethics aside, it's in the countries own self-interest to not allow such patents.

In the USA the original patent law was for 7 years and then any invention or discovery was to become public domain, same with copyright laws. Largely argued because new discoveries were advancement of enlightenment and science. Not only should there be protection, acknowledgement of traditional knowledge, but we need to re-establish the concept of „commons“. Our current patent and copyright laws are an anti-enlightenment institution.

I would say that we need a new type of system for biological innovations such as GMOs and medicinal compounds. Patents were not built with them in mind and can be a bit too restrictive, when, In some cases, it is no feasible to create another compound that can do the exact same thing without complications.

The Philippines have fallen victim to biopiracy in the past wherein scientists working for multinational pharmaceutical companies smuggled out of the country specimens needed to produce extracts for use in producing breakthrough medicines. Sad thing is these patented medicines were able to generate millions of dollars of profit for these pharmaceutical companies without compensating the local indigenous communities who had long been using these extracts as part of their traditional medicine.

From the science I have read, rain isn't caused solely by air cooling, but from the tiny particles released by trees. Example: plant a grove of trees, some with pollen. 9 kms or 5 miles away the rain comes down. The wind currents, using thermals, takes the pollen and other particles up, the moisture droplets are clustered around the particles, once the amount of moisture is sufficient, the droplets become rain drops. Same phenomenon as snow flakes.

In case of neem oil used as fungicide, patents are not the Great Evil. Just having a patent doesn't mean you can profit all over the world from it. If your company is set in the US and you want to sell your fungicide to be used in Germany, you ask for a patent in Germany. Doesn't mean people anywhere have to suddenly stop using neem oil as a fungicide everywhere in the world. Also, it depends on what exactly you write in a patent claim. Also, patents expire.

In all seriousness, of course this video is more activism than journalism, but they do raise some good points. I think it's fair to say that you shouldn't be able to patent something nature has already invented, even if the indigenous people are also benefiting from this corrupt practice by sharing in the monopoly. Patenting an extraction process or formulation is understandable. An even better comparison to pre-modern history would be laws where there were certain types of animals that only the king could own, hunt, or eat.

I grew up in South America in a culture deeply influenced by the native indigenous people and their knowledge of the land. Have indigestion? Boldo tea will do. High blood pressure? Pop a couple Surinam cherries. ED? Diarrhea? Nausea? We gotchu. It's sad that companies only care about our culture when it is to exploit it, appropriate it, and make money at our expense. We were told our culture was nonsense for ages by white people, but we saw the value in it and as soon as we proved the world that we have something valuable to offer, they start taking it away from us. But hey, it's all fair in capitalism!

They did same for turmeric as well. It's pathetic how one uses loopholes, gets patent & hence rights. On the other side communities with traditional knowledge of nature remains "barbaric !"

I didn’t know you can patent nature. I understand inventions and recipes, but not the ingredients themselves. I make cookies, am I breaking the law by using the sugar, salt, flour, and butter without permission?

There is nothing no wrong with using natural resources however reparations shouldn’t go to the people it should specifically be targeted at the land that surrounds the natural resource your taking. People shouldn’t claim ownership of nature. However certain things shouldn’t be allowed to be patented for example things someone is already doing. Things like if you make a medicine out of specific ingredients is a little different

I understand your philosophical reasoning, nobody owns nature, but the fact of the matter is that, as demonstrated in the video, many of the plant resources being extracted and misappropriated are coming from areas where the people are preserving and living in their natural lands at the expense of not having access to the money and resources that may be found in more industrialized areas, so I honestly think any reason to force companies to acknowledge and reward their stewardship of the land and ecosystem is a good one. No one owns nature, but many of these communities have been living and harvesting sustainably for generations and to offer an incentive to continue to do so, both by funding the communities and initiatives within them to protect their ecosystems seems like a good compromise.
