I used all these tips as a Litigant in Person and fought a case against the Claimant who was represented by solicitors and counsel who wanted over £65k from me, the case lasted two years and I won, they didn't get a penny out of me. Thank you so much 🙏

Today at 2pm I defended myself in a small claims court in Sheffield using advice from the video, I moped the flaw with the claimant and the case was dismissed. Many thanks

I subscribed a few weeks ago after discovering your channel because I love the way you give succinct advice to the rest of us who know little about the law. You regularly say something along the lines of 'seek legal advice' or 'consult a lawyer'. I would caution your viewers that not all lawyers appear honest (from my experience). I'm no criminal. I'm a paramedic who had a severe back injury at work and thought my employer was liable. A well known private law firm advised they were interested in the case but I should seek support from my union solicitors first, before coming to them. My union solicitor let the time scale for claims run out and told me about 2 weeks before the 3 year cut off for claims that they were dropping the case. Leaving no time for any other solicitor to fight the argument. So my lesson to anybody reading this is please think about the time limits the "black belt" explains. And don't necessarily trust your union solicitor to do a good job. Perhaps look privately if you're getting nowhere. Hope others have better experience of the law than I have.

If you have a work based injury you can go off sick with an industrial injury which has to be investigated by your employer and reported through RIDDOR if you follow this then make a claim your public service employer is more likely yo make a payment as they will not want to go to court where there’s a possibility they will lose. I’m surprised your Union and manager didn’t make you aware of this, as it comes under HSE health & safety at work, you wouldn’t really need a solicitor.

I agree with another contributor, really not so easy when your life, livelihood, wellbeing or financial security is on the line because of lies, deceit and dishonesty. Being up against a dishonest party is extremely difficult especially when you have "skin in the game" Mr Robertshaw @artmedialaw :)

I found them all very helpful and informative. I have heard Judges don't like people to waffle on and on but like people to stick 'to the point.' The No 1 tip was really good as to how one should behave in a court of law. Most people feel overwhelmed with court proceedings, but I think sticking to the facts clearly and concisely does help a favourable outcome.

I do get very frustrated with judges who seem to be so fragile. The general public often find the Court process intimidating, overwhelming and stressful. A bit more tolerance would go a long way, especially as more and more ppl are representing themselves.

Very helpful indeed ... one extra thought, a signed 'witness-statement' in my recent civil court case was disregarded by the judge because I failed to call the witness to make a personal appearance (to verify the content). I was astonished by the judge's expectation.

I was very surprised, because those 10 tips for behaviour in court are actually very applicable to my daily work: testing software. In my job, too, I am constantly collecting evidence, testing guidelines. In order to finally present it to a product manager, who decides, on the basis of the material provided, whether a version of software may be taken into production.

Just had one with royal mail! The post man trashed my post box losing his temper! Saw him do it from my front window,, opened the window and he got what for! 😡😡 he's also on camera! I told royal mail pay for it or I take it ferther! Thay have agreed to pay! Thankyou for sharing and taking the time to do this,

Not bad tips for life here. But more usefully to me now, I've had a fall due to the council not maintaining a foot path. My local Cllr met with me and advised me to make a claim. I am using this video as a guide as well as the WhatsApp photos time stamp to date the fall and my time in A&E.

Thanks for this, very useful. I am currently writing a journal of some anti social behaviour going on in my neighbourhood.On another note, I remember once when I had to report a record workplace bullying, with all the details of times and specific witnesses involved, when someone was bullying me, my manager said 'Don't you think doing that is bullying in itself?' so initially it was used against me. I did win my case in the end as the woman had history of bullying another manager's boss! Another manager came forward and supported me, It was pretty frustrating that all the details I gave, were ignored initially. #england #traincompany

Lucky for you there was history and you had support, my experience is that if your face does not fit as well as the other persons then upper management and HR will work against you, sweep complaint under the carpet and make out that both of you are at fault. Didnt show me the CCTV of the incident even though I was told I would get to see it.

@@eddier9455 You are very right there. I remember being targeted on another occasion, someone must have complained 'that I was late' each morning. Bear in mind it was a toxic environment so they were desperate to find something on me. So I had this ridiculous conversation why I was 'late', I was surprised as I am very conscientious although it was a toxic environment I didn't want to be there early. So I said well, let's go now and check the office clock, as 'this was a bit of a puzzle, the office clock was Wrong lol I said I go by the correct British time lol The HR woman gruffly had to change it with no apologies, and it was changed in front of the toxic colleagues. You would think HR with their brains and experience would even check the clock in the first place, they've got the degrees. Looking back she should have realised I was being targeted for some reason Just having facts was great and it was right in front of them. They didn't have the evidence sorted properly. I am out of that place now, the company was taken over, so HR and my colleagues lost their jobs, I meanwhile managed to find another job before that time.

I’d add, based on workplace disciplinary hearings (which run a lot like court cases, but with a much lower bar (balance of probabilities) for evidence), “Show up”. It really should not need to be said, but it does. I’ve seen in a number of disciplinary cases (here I’m referring to any sort of disciplinary case, not just misconduct, so including things like sickness, performance &c) where someone has thrown away a winnable case by just not bothering to show up. If you have a valid reason you can’t then tell your advocate why immediately you know, they may be able to get a differed time. I trust that it’s OK for me to share the link to this video with union colleagues and members. These points are as valid to hearings and employment relations hearings at work as they are to legal proceedings. The point about getting things in on time, for example, reminded me of a case where the member introduced some new documents on the day of the hearing. The chair of the panel allowed it but that then opened the door for the management side to introduce documents that I’d had excluded on the basis of being out of time, not relevant to the case and contradicted by later documents. That leads me onto the second thing I’d add, get an advocate and don’t think you know more than they do. I’ve been lead advocate on a couple of hundred cases over the last 19 years, killed off all but a dozen before they got to hearing, won all but one of that dozen (the member didn’t show up to part two of a hear that was booked 3 months previously, at the end of part one, and had not complied with any of the stipulations of part one). I’ve also second chaired on about 100 more hearings and provided advice and guidance to other reps on many more cases. Prior to becoming a shop steward I appeared as a McKenzie friend a number of times and was granted rights of audience. I know more than the members I represent, for most it is their firs (and hopefully last) case, still if I were subject to a case at work I would get an advocate.

Very interesting. In reference to getting paperwork in on time, I who have basically minimal experience, was told by a judge that it is important for a judge to have the relevant facts of the case for the judge to properly consider the case. If that means, submitting evidence on the day, so long as it is material, a judge should allow it. I am really not sure that that works in practice either, but the rationale is sound.

Tip number 1 is vital. In the Christie / Timothy Evans the Police ' persuaded ' witnesses to change dates on which they visited the murder site. An innocent man was hung and a murderer was free to carry on killing. Also as Christie had been a Police special during the war he was considered above reproach and not investigated despite having a criminal record

I was in small clames for someone turning into the side of me on my motorbike and i was polite the hole time and offered my knowledge on a fact that cleared a matter whitch proved that my opponent whas giving fauls information. It didnt help me as the judge ruled 50/50 as the opponent "didnt have a furm grasp of the english language" there words not mine. My fath in the system in this conturys leagle system is verry little and from my own experience i can say that i dont aggre with being polite. It was my first time in court and if i ever have to attend again i will be very assertive. If i have something to say i will say it and if i dont aggree with something i will speek up. I do realy like your videos and fined them very informative

An excellent & informative top 10. As for #10 if time permits, do you that obtaing a free certificate of posting from a Post Office counter staff member is also be useful as evidence of posting, for as they are independent.

I needed these when I took the local council to court, they won and another accident has happened. I used chronology and was ripped apart by the other lawyer who said because I had all this information I’d planned from the beginning to go to court! The lawyers for myself & the council came from the same chambers, I got the wet lettuce they got the sharpie personally I think the outcome was decided in advance. I hope not but fear that when another accident happens on this road service they will be held accountable but if a life has been lost it will be too late !

I can attest for number 1 and 2, I raised an assault charge against someone and it was more or less my word vs his on how the confrontation started plus I had bruising (I didn’t physically fight back which also helped) but during the trial it was pretty much me saying what happened vs him denying and saying his side what happened, later I was told that he was found guilty all because he kept losing his temper and trying to make look like the bad person when I was giving my statement

What about opinions of applicability of a law? State facts A, B, C, then express the opinion that they together constitute a criminal act X. It's up to the court to decide whether this is correct, but if you just dump a bunch of facts the court may go "Okay, so this happened, as supported by the evidence but I don't see why I should care."

Hi, my son was living with an elderly man as his carer when he died, he applied for succession and late received a notice to quit that was addressed to "the personal representative" which expired on the 4th June 2023. On the 18th May the council housing officer changed the locks and prevented my son from re entering the flat. My son is on the Autism spectrum but is high functioning. He had moved stuff out so as the family could remove the belongings of the deceased as there was so much stuff of the deceased he was worried his stuff would get mixed up. His disability makes him very anxious around people he didn't know and he was not in the fault when the council turned up as the family were there the previous evening and he had fallen asleep in our flat downstairs. He had registered for council tax and had paid an occupation charge of £120.05. is there a case for illegal eviction and disability discrimination?

Thank you for an interesting and entertaining channel. I am not sure if this is the correct place to ask questions buy I would be grateful if you provide your thoughts on the following: I use a care agency to provide care at home for my elderly father. When the carers attend they often park on his driveway. Recently one of their number drove off the driveway, across the garden and collided with a garden standpipe. This caused damage to the pipe, tap and mount, also causing a considerable amount of water to be lost due to the large fountain spraying across the drive. I managed to effect a temporary repair to stop the leak and the following day returned with the necessary parts to complete the repair. I contacted the care agency, who were aware of what had occurred, and asked them to reimburse my father for the time and expense of repairing the damage caused by their employee. Their response was that it was nothing to do with them, they were not responsible and that my father should claim on his insurance. Finally getting to the questions: 1 Can the care agency be held responsible? 2 why should my father be out of pocket for damaged caused by their company? I intend to follow up by writing to them, is there anything particular you think I should write. Thanks

Thanks sir. Was just going through videos to help me face the trial in couple of days. I am the complainant though. And the asscused lawyer has asked for a trial to question me. It's a cheque bounce case which basically the accused is denying that he gave it to me. Claiming I have forged the cheque. Thanks to you sir. Your tips are very helpful specially to control the emotions. However sir, the accused never accepted the courts order and was initially had to be done through the police to get him to come to the Court. He ignored atleast 5 times. Sir the judge remembers this kind of behaviour while making the decision? Our judge seems very kind and fair but for the trial I am worried because the accused lawyer is more focused on what was taken from me that he had to give me this big amount. The accused was very close family friend who tricked us gradually through years. Never kept proof of anything. I have shown some chats, photos etc. Keeping my fingers crossed. And your smart tips in mind. We in India do not have Jury. It's only the judge. Thanks sir...

You have recommend taking photos in a couple of your videos to reference later for time and location information. However, some software allows you to change this metadata to whatever you like, so would this really hold up?

In the end it is about putting yourself in the best possible position. You can't influence the conduct of the other party, so if you have a consistent message, evidence your argument is more likely to be believed. Well, that's the theory 😬 I'd be home and dry if it were so in my case.

That thing with emotion needs fixing. I was told I had to plead guilty when I got mad because someone had given a clearly fictitious statement. Damn right I was angry, I was a rape victim in that case yet I was the one being charged with GBH.

10. Start with chronology with time, dates & places. Take photos for GPS location & time. Be specific with chronology. Keep to time limits. 9. Be Specific. Describe facts fully. The more specific one is the more creditable one is perceived. Photos, film. 8. Support facts one says with evidence. Photos, video, contemporanous note of facts. 7. Clarify Where the information came from & attribute it to source if info from another. Be specific & put it into the chronology. 6. Use plain language. Say exactly what you mean & what I am wanting to say. 5. Read court order very carefully line by line, a number of times. 4. You must stick to court deadlines. 3. No Opinions! (meaning your opinions). 2. No emotions. Leave your emotions out of it. Only list emotions as a point of fact in your statement if applicable. 1. Be Polite at all times including to your opponent.

I am pro se' (not by choice) So far, I've filed my complaint (6 causes of actions) against 5 defendants. Counsel has filed a demurrer and plea in bar in which I responded with my Opposition. Their demurrer is baseless and I have supported my Opposition with citations and statutes of authority. One thing I'm having trouble with is "conclusory allegations" I've read my complaint a thousand times, I've been studying law in my state for the last 2 years (unfortunately) I haven't made conclusory statements without supporting my statements. How do I stay away from these elusive "conclusory allegations"?

If only the DDJ or magistrates would apply consistency to both parties sat in front of them. On the opinion matter, he was allowed to give his opinion and when I waited for an appropriate time to speak and offered my opinion which was the opposite to his, I was silenced by the magistrate then openly laughed at by the magistrate

You can be as Specific as you like in a court or police station, they will always ignore you or call it Vexatious. I've had a court clerk lying, which is why the layman will never trust the judicial system. Thanks BBB, very good points as usual, respect.

Shouldn't a judge in a court be mature and wise enough to recognise that simply because someone is polite and nice, rather than rude and abrasive, says absolutely nothing about whether they are credible?

Oh my goodness, knowing how to tread with judges is probably 8:37 the most important piece of advice anyone can offer someone going to Court! With some intrepidation asked the Appeal judge how does a judge hear a case? He replied that a judge would use his/her "consideration*. Which is very interesting, redefining the word consideration reaching a conclusion without reading the submissions or hearing (the art of listening to what someone says) 😕

Dear Black Belt Barrister, shouldn’t law be part of the national school curriculum? In what other sphere, (outside of personal relationships), is one expected to play by a set of rules but are not given the very rules they are expected to abide by.

Another off topic idea: I gather the Government is proposing some kind of law that involves people who have been furloughed and cannot afford living in a house, so they are joining the 'vanlife' wagon. This also means that they don't pay rent, council tax or anything. What new laws is the Government proposing exactly? Apparently the vanlife brigade are up in arms. #uk

Perhaps you can answer this for me. Is it possible to take a class action against the government for means testing the state pension and breaching our human rights by invading our bank accounts. When l started paying NI at age 15 l expected a state pension at 65. I considered l had a contract with the government so that if l paid into the system for a specific purpose ie the state pension then l would receive it in its entirety. No one ever mentioned means testing and as far as l am concerned what they will be doing is classed as acting retrospectively. Also bank accounts have always been held to be sacrosanct and scrutiny only with a magistrstes warrant to detect fraud. I am not bothered as l have nothing to hide but feel that the DWP should have to give you notice about checking your account and they should only be allowed to check the account that money is paid into. Savings accounts should remain private. Your advice if any would be really appreciated. I am a retired detective and would really love to take the government to court.

@@BlackBeltBarrister Hi. became a member and would like advice on a criminal matter. I'll try and be as brief as possible. In 2003 I was convicted and sentenced to 5 and 1/2 years for a crime I didn’t commit. The incident involved a group of men of shrilanken decent who come to my home town. They lived and came from London. They were involved in identity,mortgage and credit card fraud on a big scale. An incident happened where I was attacked with a glass by one of the group. It went to magistrates court but I was called racist and the man who's name I couldn't pronounce at the time but everyone referred to as Tony. He was found not guilty. I was warned about revenge. Time after he turned up to a club I was at with a gang carrying hammers and knives on leaving I received injuries but fortunately for me others intervened and he was attacked. After my conviction the man responsible for the crime came forward and there was evidence from the prosecution to support his confession by the way of a taxi driver picking him up by the same name covered in blood and when asked he admitted to stamping on an Asian mans head. He was then taken to the same address the man who confessed lived. The taxi driver felt it was his duty to contact the police. I was lost from legal team to legal team as you mentioned. 8 years ago I applied to the CCRC through a firm who helped a local innocent man convicted of murder win his appeal. Unfortunately It was failed a few years back but the police carried on harassing me. I decided to try and find information surrounding the complainant Tony as I knew virtually nothing about him other than he wasn’t a nice person. By this time he was a fugitive from the police as he pleaded guilty to a section 18 and received the Suspended sentence. This happened 6 weeks before my trial. At my trial that same incident was explained to my jury he was a victim of racism where a man head butted him and called him a pakki. He used a belt to defend himself. He accidentally injured the man. A few months after my false conviction Tony was raided by police and found in possession of cloned cards. He was bailed and has been a fugitive since. After incidents in my personal life where Ive been the victim of knuckle duster attacks and large vehicles drove at me on CCTV along with an arson attack the police still showed prejudice in the way of by hiding information from the sentencing judges and falsely detaining me. As I thought preservation of life must surely be a priority I could only come come to the conclusion the police or CPS were scared of some thing they had done to me. I used social media and ancestry companies to establish who Tony actually was and his current identity. I then looked at his family and there names to establish his real identity. As he came to our town committing identity fraud I knew this would be difficult. The name he originally had from birth was not the name him and his wife used in court to testify. I then found there marriage certificate. It was held in London. The address on the certificate was local. I looked at local records the same year and the names they was using were aliases. I noticed a third person at the address I learned this was his second alias. I contacted my last Soliciter and requested the paperwork back. I came across information my trial barrister had which wasn’t shown to me. There was also 20 plus statements of the incident he’d pleaded guilty to. The one held 6 weeks before my trial which he received a suspended sentence. As I explained at my trial involving him it was explained as defending himself from a racist attack injuring a man with a belt.

'Read a court order carefully' But the solicitor that i sent a court order to didn't comply and didn't sent it on oath - 'corrupt' is too softer word for him. 'Go see a lawyer' - Dont think so, dont trust them now.

I lost all faith in barristers when one offered me points for pleading guilty, this proves to me the system are not interested in justice.

Hi again, don't know if you can help again please? I have a banner in my field protesting about a local Council proposed housing development. Can the Council, 1, enter my property and remove it and take it away. 2, Can they make me remove it, it is not offensive, racist or or anything else it is also not causing any obstruction or distraction. How much verification of a 999 phone call does a police officer require before making an arrest? I was hit by a serial hit and run driver reversing along the pavement. I had to ride the car to survive without injury, the driver left his engine running, when I knocked on the drivers door there was no response, I switched off the engine and removed the car keys as a first aid action for the safety of driver and the public. The driver called the police complaining of a berserker that shuffled and was therefore drunk and on drugs who had randomly attacked his car and stolen his keys. The police knocked on my door within a minute of arriving on scene. The police asked to come in to question me, I asked if we could talk on the doorstep as I was really ill and could not cope. I was immediately arrested on suspicion of robbery. The police seemed obsessed with searching for drugs, they didn't want the keys back, there weren't any drugs, I wasn't drunk, I was shuffling because I was really ill and had attended my mother's funeral the day before.

I have a law degree but I need a barrister or solicitor to look into a legislation on what deems as indirect harassment. I live in a small hamlet and the whole village received a 2nd class Royal mail posted letter address to Dear Neighbour (addressed only to the house not a particular individual ). Thankfully my teenager doesn't bother opening the post ( nice try JWs ) As I opened it, low and behold it was a hand written letter (seemed to be) written by a teenager. She/he was advising the household especially teenagers to check their website and follow the guidance from God. It was signed by a Sami with a smiley face, with a barcode and an email address. Is this lawful or is this intrusion of privacy for myself an ex Jehovah's Witness member? Is this seen as private nuisance disturbing the occupant mental tranquility? Before the lockdown every day ( coincidently hmm ) they would sit directly opposite to where my bus stopped with their pamphlets at 8:30 in the morning. I had to walk a longer route to work from another bus stop just to avoid them nearly every day, and then they would find a way to bump into me with their trolleys. Kept the letter for future reference. Could appreciate someone advice. Thank you!

its not what you do its who you are ,keep your cards close to your chest its their story against yours ,give your self room to charge your story time and dates can be changed photo shop ! its easy to change time and dates on pictures his will make you look like you planned it, you are a liar and you will lose
