Elaine's behaviour has been disgraceful. For the insane ranting during the TV interviews alone she should have been disbarred. She continued to belittle the legal process, the judge, the jury and everyone else. She should absolutely be prevented from continuing to practice law.

If she carries on, and there's somebody compiling all the statements and behaviors, then there's a chance she will be in time. I suppose it's riding on what happens next - if it goes back to court in some aspect and Elaine gets a win, be it the juror 15 nonsense or reducing the fine on AH or this business with the insurance company(ies) then she'll probably be spared. But, if she cocks up again, she's at least losing her position in her current company, whatever that is

I’m sure I saw a TV interview in the days after the verdict where Elaine stated to the interviewer that that AH could not afford to pay the “pledge” … I’m doubting AH’s finances would’ve been a post trial discussion or discovery? She seemed all at sea through the whole trial, but it looks a lot like she was just part of the web of lies being spun to the jury. I’m not sure how her career stands now, but if her credibility was damaged before this debacle, she took a wrecking ball to the remnants … hopefully there’s a mechanism to at least take her to task, preferably one that stops her in her tracks.

Elaine Bredehoff and AH share at least 1 personality trait: they never accept any blame. Everything is always someone else's fault. When pressed, they will admit to generalities like "I'm not perfect." and "We made mistakes." But never anything specific. They can't even be gracious enough for the ever-popular "While we disagree with the verdict and plan to appeal, we respect the hard work of the jury... yadda yadda." Instead, they immediately blamed the judge, jury, and anyone else they could throw under the bus, especially when they know the people they're blaming can't/won't say anything back. I wonder if some of their attacks (especially on the jury) were an attempt to get jurors to speak out during the brief window where they could maybe get a mistrial because of juror issues, especially considering their current claim of a problem with the identity of one juror.

Camille definitely looked shocked and was looking at the judge as she obviously knew what Elaine was saying was not true. I hope that there are consequences for these lies

Not necessarily knew it was not true, but definitely because attorney's fees are NOT to be spoken about during a trial.

Before Mr BBB even brought that up I'd noted that reaction when the clip was played at the opening of this video. It certainly did seem like her reaction was in response to what Elaine had just said.

If AH's legal fees were paid by insurers and Elaine lied it would then be beyond ridiculous that not only AH, but also Elaine can lie to a jury and get away with it. They should be prosecuted and made examples of. I mean what the hell message does it send if they are not.

@Gary Goldstein perjury has to be addressed by criminal court and charges have to be made by the D.A. since this isn't a criminal matter and was instead a civil matter then it would take one party to file a request for criminal charges to be brought up against the other, but it is up to the D.A. of that district to pick up the case and place charges or not. so we don't know whether or not Depp's legal team has sought or filed for a case against Heard and her attorney in the criminal circuit, therefor, we cannot assume they haven't done anything to seek criminal charges against Heard and her team of liars.

On top of this, Elaine has previously been removed as counsel in a past trial because she advised her client to destroy evidence. She deserves to be disbarred.

Camille was surprised Elaine was allowed to do this by the judge. The judge should not have allowed it. The statement was entirely false.

You've been very polite saying Elaine "mislead" when in reality she "LIED" in court! That's why Camille was so shocked! While disbarment would be a fitting end to such an incompetant lawyer... can you see her ever getting a case again? If I needed legal representation and she walked in the room I'd say NO! NO! NO WAY GET HER OUT OF HERE!

Right. When I was much younger. Got an attorney. I went back to court by myself. Judge asked if i didnt want my attorney? No Thanks, He got me into more trouble than I was in. The lawyer was a joke of the Town and courts. The JUDGE laughed and threw my case out. Lesson learned. Stay out of Trouble, take a accountability, so you don't need lawyers. To many are corrupt. More corrupt attorneys than criminals. JD had the smartest Attorneys this time. A great team that knows their stuff. The LAWS. I think the Jurors caught the Lies, probably not all of them, there were so many. How strange people get an attorney, assuming the lawyer knows the laws, people expect Lawyers to give them good advice. JD should not have been held responsible for what the past attorney reported/ or said about Amber TURD. He didn't lie and JD didn't tell him to go public and say what he did, WHATEVER it was. Not important. The lawyer is responsible.

Amber had the money 13 months before she was even sued. She had plenty of time to make good on her pledges. Knowing she didn't even use the money for her defense and that her attorney lied to the court about it is even more problematic. So many lies...

I remember getting pretty angry during closing arguments because Ambers lawyers straight up lied several times and made arguments they were told in the past not to make. It felt like they were looking at how much they could get away with knowing that usually not many objections are made in closing. Also I vaguely remember an explanation at the time by a lawyer that they never established during the trial that Amber paid 6 million in fees, therefore the argument was against what you are supposed to talk about during closing. The amount of questionable stuff Ambers lawyers and in part her experts did is just insane. It's concerning to me just how much they got away with. Johnny had an amazing team that knew how to handle them but most people can't afford that and should have some protection against this.

Amber wasn't going to pay the six million. She got two insurance companies to pay for her but now they're suing eachother and one is suing her so she may end up paying her judgement and her legal costs.

Originally I thought Elaine was just a scrappy litigator. Her misrepresentation of the UK case on tv was IMO an ethical breach. Now I think she needs to be brought before the Bar. Elaine KNEW it wasn't true & said it anyway.

@Ivy Nyx You may be under a misapprehension concerning the function of Bar Associations: They exist almost exclusively to protect attorneys from the clients they've cheated, defrauded, or otherwise failed. They DON'T exist to punish misbehaving lawyers.

I find it hard to believe that the justice department won't go after AH for perjury because they're already backlogged with other cases... it's basically signalling to everyone they can commit perjury and get away with it because they won't get charged.

Isn't it a well known fact that she already was having the 7 millions with her for 13 long months before the lawsuit was filed? Yet Elaine asserted it was owing to the suit that Scamber wasn't able to pay up despite the pledge. This in itself points to a big lie, let alone the payments made by Travellers. Both should be taken into perjury considerations and subsequent legal action against them. I hope the Marine insurance company takes them to task immediately.

Yes AdM I remember specifically Mr Chew gave Ms Vasquez a postit note. Ms Vasquez then made the point Amber did have all the money 13 months before the lawsuit.

If you pan away from Camille, Johnny also has a look of surprise or disbelief. I think Camille's looks to the judge said, "are you going to let her get away with lying?" Everyone (legal teams and judge) must have known something about these insurances. I do believe there should be some form of significant consequence for a perjuring attorney, as well as those under oath in testimony. Thanks for pointing to Andrea Burkhart. Her video is very informative too.

How is Elaine ever going to recover from this performance? It's been as abysmal as Amber Heard's acting on the stand. I can't believe Elaine has been so led on by AH. But there's also due diligence and actually reading the papers AH gave her. I get the impression of ineptitude in the Heard legal team. Between you, Andy Signore, Chris Melcher and Emily D Baker I've begun to understand the case a little so thank you🙏

When I watched the closing arguments, I was shocked to see that Elaine said Amber has already paid her attorney fees of $6K and when I saw Johnny's attorney look at the Judge when the statement was made. I knew something was wrong. That's was my initial reaction -- whether or not that was her intention, I do not know.

People kept telling me that it was a civil case, but if it was a criminal case, then accusations would have been brought against sicko amber. I still think no matter the reason of the case, it is still lying under oath.

Wait wait wait I thought the paid fees when AH said that on the stand it was stricken from the record?? Good god. (I’m a law nerd from EDB’s channel 💜💜💜) I had to click off of Elaine’s argument because I was about to smash my face against a wall. That woman infuriated me so badly. I need to go back and rewatch that day where AH was talking about her legal fees being the reason she couldn’t pay her pledges.

So, Amber got Defamation insurance before the trial? If so, this makes more sense as far as Amber's counter claim, using the insurance to defend herself from Defamation instead to press her case of Defamation against Johnny. Oh gosh, the plot thickens! I was appalled that Elaine appeared on television following the verdict of this case. The level of her disrespect towards the jury, the judge and JD’s (outstanding) legal team was highly unprofessional behaviour, outrageous! Indeed, Camille appears very surprised during Elaine’s closing speech……little wonder!

It's really sad that Elaine a former prestigious lawyer was swayed by her clients mental tactics of persuasion. She seems bright enough to know better based off her history as a lawyer however it appears in this particular case she has become of hive mind with her client and that Elaine isn't actually acting like lawyer but how someone might behave if they were representing their selves.

Eventually, Ben Chew DID object to a bunch of things that Elaine said and there was a sidebar. He won that at least one of the things in the objection. I think the judge said that it was too late for this particular reason (however, why couldn't she tell the jury to disregard that but I'm not an attorney).

I won't speculate as to whether her look was surprise, but it was definitely an immediate reaction that meant something important. Camille generally remained stoic during closing unless it was an outright objection. I think she wanted to object but hesitated because she looked at Judge Azcarate and maybe sensed she should not at that time. THE CASE THAT JUST KEEPS ON GIVING.

Did Elaine know of the insurers' dispute? It is a viscious cycle of intertwined events. Amber called the tune so she must pay.

The look on Camille’s face was more a look of realization more than actual shock, which quickly gave way to a clear understanding that it was wrong, prompting her to look at the judge as if to say “you going to do anything about that?”

Elaine and her firm are becoming desperate to recover from the initial lost case. Digging themselves deeper and deeper in the hope they can get something out of the loss. I'm sure they know AH can't afford their fees so they're trying to get her a 'win' in order to get paid. Sadly, this means that they're continuing litigation - and ensuing costs. They must be aware that if they continue, they could bankrupt the firm!

Of course, the files this last motion 5days after she actually had legal right to do so and 3 days before Johnny couldn't (11th of July being the last day Johnny could file any motions about the case)... The reason Amber didn't blame a human person for the shit in the bed was it would anger said person and they'd tell everything on her and provide proof... She didn't even accuse anyone that works for Johnny as she was doing for other things in the trial. That's why she accused a Tea Cup Yorkie... If it was a Fully Grown Rottweiler okay... That could've been believable. But she claimed a one of those small dogs are some weed and that's now what happens. I've seen a Golden Retriever after it ate pot it just told us all whom was holding and lying to us... I miss George that old lovable weed smoking pot head dog.

"Hasn't been able to pay ... because she spent 6 million dollars in attorneys fees -- that is unrefuted" She is proof that liars believe they can insinuate a falsity and it will be accepted as fact, unrefuted. What was most jarring about those closing statements is that she made them after many hours spent exposing her lie in 2018, that she had donated the total then.

I thought Camille was looking at the judge in surprise during the trial, as I mentioned in my previous comment the money wasn’t paid by Amber. Travelers Insurance was paying the attorneys’ fees and they were expecting NY Marine to pay. Amber had been getting free rides all along, she’s never held accountable. The question should be is Elaine going to be disbarred for trusting her client and Not having information checked by her office? Or for playing just as dirty (as AH) as evident with how she has handled herself with this entire case? JD was carrying AH, her friends and cronies why would she have paid anything out of pocket at anytime?

Camille was shocked because not only was the subject ruled on in motion in limine already, but when Amber tried to sneak this info in during her testimony, Camille immediately raised an objection which was sustained. See ~8:21 in Andrea's video you linked in the description. IMO, Camille was clearly looking to the judge in hopes of some consequences to Elaine for such a blatant disregard of the court's ruling.

In German we say: wo kein Kläger, da kein Richter. Meaning - when it's not prosecuted the person goes unpunished. Since US courts have witnesses take an oath but at the same time this oath is more or less a "melodramatic remnant of the past" as perjury is very rarely prosecuted, nothing is going to happen. I doubt very much Elaine really is in great trouble. She might , however, not be on the list of Virginia's best lawyers any longer... I wish she and AH would really have to answer for their lies and manipulations though.

Things work a bit differently in the states. I spent the first ten years or so of my legal career in insurance defense for one of the big 8, so I'm familiar with how that works here. All of the major insurers have in house counsel, meaning that they form and maintain a firm specifically to defend for them. That firm is still obligated to represent the client's best interests, so if the client's interests and the insurance company's interests diverge, the firm is bound to represent the client, and at that point the insurance company will go and find an outside firm (or "of counsel") to defend them. Our checks came directly from the insurance company but we often represented an insured in court while another attorney represented the insurer, who was our employer. People are under the misapprehension that insurance defense attorneys always work for the insurance company's interests, and that's simply not true. When the insurer has to hire of counsel, the commissioner of insurance in each state sets the rates that the of counsel can charge and that the insurance company can actually pay. I'd be happy to answer questions or talk more about this if anyone is interested.

Having seen the trial quite a bit, it appears she is looking at the judge. To have looked at Ben, she would have had to turn her head far right and look directly past JD since Ben is to JD's right. She may have tried to register the judge's facial reaction since the most important information before a trial can proceed is the funding and its sources. Love your channel!

Amber didn’t pay attorneys’ fees Travelers insurance paid and is suing the other insurance company for money to pay but that’s where AH actions of not accepting the free attorney and intentional actions are grounds for the claim to Not be paid per their provisions, is what the argument is about. AH and Elaine are grasping for the verdict to be thrown out and a new trial so the insurance will pay, any which way they can.

Insurance companies have lots of little clauses that will limit their liability. Amber was found guilty of deliberate malicious defamation. She isn't going to collect on this one.

@@topshelfstuff The attorney AH was offered was independent counsel, yet free (paid for by her policy) It’s not an insurance “mix-up” the policies don’t have the same limitations; NY Mariner specifically indicates they are not responsible nor required to pay out due to Amber’s actions. Travelers is arguing they should be accountable for the damages but because of the intent with malice verdict NY Marine is not responsible. As for her legal fees NY Marine is claiming that since AH refused and fired first counsel they are not responsible for further attorneys’ fees. Bottom line is Amber is causing her own issues but wanting everyone else to be responsible for cleaning up her mess. She doesn’t want to pay out anything from her own pocket, never has, never will. She preys on others to get what she wants

They did interrupt Elaine’s closing argument twice for misinformation given to the jury. They should have done it again!

The same judge was dealing with the insurance dispute because they are now asking her for a determination on the matter. Also Elaine would have been aware of these proceedings. I wonder how much professional indemnity insurance cover Elaine's firm has for when Amber comes seeking to sue them for screwing up her case.

That's interesting. If that is the case, then the Judge should definitely have not allowed Elaine's closing argument statement since she would know it was entirely false.

Of course they did. For the whole six weeks. Rurd said herself. "His lawers did a better job distracting the jury from the real isses". She wanted her to represent her,because she already lied for her in the UK trial,so she knew that she would do it again. I wouldnt be suprised if she blackmailed her

I remember that comment. But I think Turd was projecting again. I don't think JD's lawyers were trying to distract. They were head on calling her out on her lies with hard cold facts. It was Turd and her team trying to distract from the real issues - that she was the abuser, not JD.

Your posts are appreciated to help us navigate legal matters. 👏 One question that needs to be answered is if AH pre-planned her “defamation” against JD far in advance, wouldn’t that nullify insurance coverage precisely because she was planning what she knew was a malicious crime against JD? Given the VA verdict in JD’s favor, isn’t that another reason not to cover her?

That’s exactly why the insurance doesn’t want to cover any cost after the verdict. They argue it was done intentionally therefore they shouldn’t have to pay.
