I got sold a truck with bad brakes I don’t know much about cars the sales rep told me it was because our roads were “icy” at the time and because it was snowing I believed him. Turns out I was driving on half a pad, Firestone told me it’s a miracle I didn’t get into an accident . Cost me 600 bucks because I needed new rotors too. I never thought about suing because there was no way I could prove it she should’ve known she needed that

Exactly. When your breaks go out, they don’t just work one min and the next min they are just gone (unless the break line was cut &/or new breaks are installed & the breaks weren’t pumped before driving, but if that did happen, they would jump pump the breaks til it stopped). I’ve had my breaks go out a TON. I ride my breaks. One year I had to change my break pad twice within 9 months but that had a lot to do with not having my rotors replaced when my husband changed my break pads & he told me I needed new rotors, so that’s my fault.

Usually, that's true. But twice I had the breaks temporarily go out. But afterwards, it was fine. I actually had that happen with two cars; an 80's Mustang and a 70's Cordoba (I loved that car). With the first car, I lucked out when the light turned green. With the second car, I geared down, pulled into a very steep driveway (upwards), then just put it in park. Then it was okay. Neither was my car (they were my mom's cars) so I don't know if anything was done afterwards.

So, she made up this ridiculous story about her brakes failing. She didn't have any proof at all. Then, she got a nasty attitude when she realized, she wasn't getting any money.

I knew she was a bit shady when she was asked by the judge how the accident happened. She skipped right over the question and tried avoiding it at all costs. She was even offering up evidence that wasn't requested!! She tried to avoid the question so bad until the judge asked her a second time. Sorry she had to lose her money like this, but that's just how it goes on these road and in these streets.

Before buying a used car have it checked by a mechanic that is not involved with the sale. Don't trust their mechanic or their buddies to give an honest opinion. The defendant seemed to try to help her when I don't think he had to. Buyer beware!

I don’t believe that the plaintiff got into the accident due to the brakes failing, if the brake light wasn’t on. The defendant tried to fix the problem multiple times, even still tried to get the plaintiff another car after an accident that was most likely her fault. Unfortunately this is something that happens with a lot of older cars, they seem fine at first and then multiple problems arise after awhile...

I've had the brakes lock up on me while on the highway, but only once and the back wheels only. Thankfully it didn't cause an accident but nearly caused one in my pants. 😉 I've never had my brakes just fail completely for no reason and no prior warning.

She brought written proof and audio proof that he agreed to pay her back, and he was even honest enough to admit it, & the judge still dismissed it. She should've had a mechanic write up that it was brake failure, but knowing Milian she'd probably claim it was just a mechanic she knows lying for her the way she goes by what she thinks & feels when she wants to (e.g., her feeling like he was just a nice guy feeling guilty, so that's why he agreed to pay)... Regardless of his reasons, if he agreed, then that shouldn't have been ignored.

I'm judging the FACTS presented, which is that the SAME way he can take her money acting as an agent is the SAME way he can reimburse her money acting as an agent...If he agreed to pay in writing, then regardless of you and the judge's personal feelings - he should be held to his written agreement he admitted to in court. The only contracts judges can't uphold are those that are illegal (e.g., written agreement on an illegal drug deal, or loan sharking where someone agrees to pay 60% interest back considering it's illegal to charge more than 20% interest, etc) but this wasn't illegal...He had an obligation to find out if her brakes failed BEFORE he agreed to reimburse her; that's on him if he didn't. We will NOT agree on this. You can't convince me otherwise, & I don't care to convince you or anyone else of anything, hence why I don't jump up under other people's comments trying to counter their opinion as if they give af what I think or it will change what they think...

@@marleonetti7 Maybe she was thinking that, but that's why it's faulty to rule based on biased thoughts, opinions, & feelings. A judge could think a plaintiff will gamble away any winnings but if they brought evidence, then it still needs to be used. This is civil court, not criminal, so the burden of proof isn't nearly as stringent. She was being biased based on feeling sorry for the defendant who she saw as "the nice guy".

Someone should explain to both the plaintiff and defendant what "As is sale" means. He tried to do her a favor and she got entitled, then ended up with nothing. Also, I'm not so sure it was faulty brakes. She would need that proof for the insurance company, so surely she would have it for court? Sounds like a good excuse for tailing too closely or just not paying attention. When your brakes are about to let go, you can distinctly hear it wearing out. Having had the brake light on was the perfect excuse for her own mishap.

I was surprised at Judge Millie's ruling on this one. I agree with it, I just thought she was leaning the other way. The plaintiff had zero evidence. The defendant did seem to be a good guy who just wanted to please his customer. It's true the brake light thing happened, but his answer to that was believable. She drove the car with no brake problems for 8 days. And in my experience, when I was much much younger, brakes usually don't fail completely....they just don't stop you as fast....and you are already well aware that the brakes have needed work for awhile.

After this woman's true character was revealed in the hall I strongly suspect that any man who makes the mistake of marrying her is going to face a nightmare of being blamed for everything that goes wrong because this woman has never known the feeling of taking responsibility for her own actions. She buys an auction car from a barber shop/car sales, trusts an alley mechanic to fix a brake problem. As soon as that came up I knew that there was no work done on the brakes, merely something done to turn the light out, and then that was confirmed later by the barber investor. Then she doesn't bring evidence from a mechanic that the brakes were faulty. All we know is that someone took less than five minutes to turn off the light. We don't even have to get into what caused the accident because there is already a mountain of things that are her responsibility, but instead of facing her own mistakes she makes personal attacks on the guy that she chose. As Humphrey Bogart said in Casablanca “Of all the gin joints in all the towns in all the world, she walks into mine.” She chose him. Her mistake. Her fault.

The brake light can come on because of the emergency brake or brake dust on the brake light sensor very common problem. If you have bad brakes the light won’t come on.

As the judge said, the note didn’t state guilt, she saw the defendant as trying to maker the defendant happy and the fact that she didn’t bring proof of the shop doing a bad break job , or having a witness stating that the breaks were faulty and unsafe, that’s why she lost , no proof .the defendant tried to get her other cars , because he knew she had school, he didn’t have to.

It is patently clear the brakes were not the issue, or she would have said: can i call up the shop now or come back with evidence. The judge would have told her off but at least it would have hinted she might be telling the truth. The most likely truth is she caused she caused an accident and wants to pin it on someone else.

This is a surprising outcome. I think the plaintiff caused that accident, I don't think her brakes failed. But at the end of the day...the defendant signed a paper saying he was gonna get her another car, or refund her money. JM always calls herself a "contracts person." Well...isn't that a contract? She always says you can just grab a piece of toilet paper and a pen and thats good enough. Even if he was just trying to be nice, isn't he still supposed to honor that contract?

I'm nice so I promise to give you one million dollars. It's all right here in writing. Now, I've changed my mind. Try suing me for the money. Do you really think you can win the case? A promise, even if in writing, is never a contract because there is no consideration involved. Now, had the defendant said "I will give you a warranty" before the plaintiff had purchased the vehicle, that's an enforceable contract.

I believe the plaintiff. HOWEVER, she should of done her due diligence and shopped around for legitimate used car salesmen/ company before rushing into a more cheaper and convenient option. Idc who disagrees with me on my opinion, shady ppl are everywhere. And I do agree with the judge's decision.

You honestly believe that her brakes just completely gave out after 9 days of driving it with no brake issues? If she had a mechanic look at it and conclude that the brakes went out, it would have been VERY easy to bring that to court. He could have wrote up an estimate to fix the breaks and write on their "total brake failure" or something. There is a reason she didn't have that paper.

In Australia a car under 10 years old has to be sold with a 3 month warrantly and all cars must have a roadworthy certificate which also includes brake tests

She says a new battery is $130. If you are wondering why it's so much, I had a Stratus and you have to remove the wheel to get at the battery. Chrysler says it extends the battery life by not exposing it to so much heat. So it costs extra to replace.

Ya'll keep saying he wrote her saying he would pay her back, butt the plaintiff whole reasoning why the car failed were due to bad breaks which she had NO EVIDENCE to PROVE, & that why the judge dismissed that written agreement..She had no proof because she wasn't paying attention driving & caused the accident herself at her own fault.

People who don't know much about cars and don't want to spend money to have a certified mechanic to check their car should stay away from cheap used cars. They may end up needing costly repair.

It is called, buyers beware. It is up to the person who is looking to purchase a car, to first have a certified Mechanic look at it and give it a good Inspection before any cash changes hands.
