the defendant probably already knows from over 30 years of experience that 99 percent of property owners never actually sue him . thats the real reason he did not pay the 260 , he thought it was just a threat or a bluff like all the others in the past and he still probably thinks he will never be sued again in his lifetime and he may very well be correct .

Remember, that defendant was on his best behavior in court and still it was obvious how arrogant and disrespectful he was. What a gem he must be to deal with when the camera is not on him. If I were the landlord I would install a security cam to catch him the next time too.

Oh boy I had to pause. I work for a tree care company and EVERYTIME work is done and you have to set foot on a neighbors property or there is a chance ANY debris comes down on their property you need written permission from the owner. Not the tenant. Written signed document for every job. Doesn’t matter of it was a month ago.. or 3 days ago.. if the dates are different than what’s on the signed written contract from the OWNER..you need a new one. Going to unpause now. This should be good.

i feel that the only reason the judge ruled against him is because he parked on the plaintiff's property without asking so the judge hit him with what a trespassing fine might cost him . and the plaintiff probably felt that if a private company is gonna make a profit using his property then he wants his 260 dollar fee .

I've with Harvey on this one. This defendant clearly doesn't care about gaining permission and is way too comfortable having his crew trespass on other people's property. One day he's going to get hit hard with a massive lawsuit and is going to deserve every penny that he has to pay. He just doesn't care. The only reason why he lost his lawsuit was because he was trespassing. You could clearly see that rock hard ground hadn't been ground up and seeded etc. He lost and I'm very happy that he did. The plaintiff should have called the police for trespassing on the defendant since it kept happening after he was on notice not to step foot on his property.

His biggest threat isn’t a lawsuit over trespassing or damages like this one; his biggest threat is one of his employees getting threatened with a shotgun by an irate homeowner, and then that employee suing him if they get injured or end up with PTSD from the incident. I know plenty of people that wouldn’t hesitate to start brandishing a gun at trespassers. Especially if they don’t leave after being told or cause damage to the property.

I had a brand new house that had no lawn yet (it was winter/light snow). The neighbors were still building their house & their contractors drove across my driveway, across the side yard, into their driveway so they wouldn't have to do a 3 pt turn in theirs. Then they'd back up into my driveway, pulling mud onto it. They parked blocking my driveway as if it wasn't there- I had little kids & didn't realize the driveway/side disaster until i had to pull my car out & asked them to move. It was shocking how unphased they were. I very, very kindly talked to the home owners the next time they came by, and they said they'd ask the workers not to do it anymore. Knowing we were going to be neighbors, it wasn't worth throwing a fit... but I can tell you when the ground thawed there were HUGE craters that had to be re-paved because it had been freshly 'tilled before the snow. And I had a muddy, ugly driveway until I could actually do something about it when it warmed a bit. They never offered to fix the side yard even though they were working on their own, they didn't actually even apologize, but for the sake of being neighborly it wasn't worth drama. I'm still annoyed when I think about that. Don't park your truck on someone else's yard, regardless of 'what work still has to be done'. It's SO rude for no reason.

If he were to damage a water line or something with his heavy equipment, it would be quite expensive. I don't have that problem, but I have family members who do as a result of people who want to drive over areas of their front yards. Just because you can, doesn't mean you should.

He should count himself lucky the sprinkler system had not been installed yet. If his 26,000 pound truck cracked all that pvc pipe & the whole system had to be dug up & replaced.....big money. I agree with Harvey on this one. I really hope the defendant does it again, and this time he does destroy a sprinkler system, & they sue the pants off him.

The defendant isn't just arrogant, he's dead wrong... in CA, you DO have to get your neighbor's permission to even WALK on their property to trim your trees otherwise, it IS TRESPASSING.

Imagine being so stubborn to NOT pay a measly 250 bucks to repair the damage you did, but then go on national TV and put your business in a bad light. 😅 He could totally lose the contract for the tree trimming next door, plus who knows what other prospective customers.

The guy does not need a massive rig to chop off tree branches. We have 100 year old oaks and cottonwoods on our property....alot of them.....alot. There are tree climbers that are adept at climbing, cutting and lowering branches on pulley systems.

I live in California and he's right, it's not trespassing just to walk onto someone's property (however, it is trespassing if they ask you to leave and you don't). I thought it was the same everywhere but maybe not. You definitely can't park a monster piece of machinery on someone else's property though, or drop branches, etc. I can't believe at the end he said they would ask if there was anyone to ask -- the implication was that if there was no one to ask then they'd just do it again. Looking forward to seeing him on People's Court at some point in the future!

Defendant is arrogant and has no right to place his trucks on private property. That said his evidence did seem to indicate his truck didn't cause the damage the plaintiff is charging for.

Tree companies, like lawn maintenance companies, routinely act as if they have eminent domain and trespass without a care in the world. A girl I knew called a tree company for an estimate; she told them she'd think about it and let them know, and two days later they were on her property cutting down trees WITHOUT HER PERMISSION - SHE NEVER AGREED TO THEIR ESTIMATE!

By law, the plaintiff has the right to trim the parts of the tree that is hanging over into his property. If it’s a problem for the defendant to do so…. Hell! Do it yourself!!! That’ll cost him more than 300

a city's equipment isn't allowed on your property or any private property (parking lots etc.)only public places and land.. when they street sweep ,road work ,plow and move snow etc. it can never be on private property.. the contractors that are hired, have to follow the same rules..if not, they have to go back and clean up their mess at their expense within 24hrs..they have to get certified to be able to put in a bid for the job.. if a problem happens with the equipment and leaks on private property ,wow , it becomes a huge issue. you have to follow all enviromental laws.an enviromental officer can come and watch the repairs being done.. that defendant was %100 wrong and will end up in deep trouble..

Any person with morals would ask for permission from the land owner because what happens if last year there were different tenants than when this occurred....And to think he has the right to enter without said permission because he didnt have his number is stupid....The defendant felt entitled to be on the property to get a job done....He should have been on the land owner's property that had to have the tree removed...then to fight a 260 something bill....that's just plain stupid...now the defendant should take up gardening as a hobby because clearly there's no common sense flowers growing in his garden...

Ok im divided here. The defendant in my opinion was right about his lawn not being tilled and it did NOT look like it had yet been renovated. The defendant is a lawn care person himself. But because he felt like he could trespass due to his arrogance he got fined for it. Basically. He shouldn't have had that huge rig on someone's property & he would've never been accused.

This is how people end up in body bags, the first thing his family will say is, “he was such a good guy”, I’d play this video at his funeral. The landlord has every right to file a criminal trespassing report, he’s told him more than once. He is lucky a tenant lives there that hasn’t pulled a gun on him. The defendant is biggoty, no one has a right to somebody else’s property, I don’t know wtf he was quoting, but we have a document here, it’s called the constitution. I have the distinct feeling that this man will get what he deserves.

Yep, this guy is the exact reason we should have stricter gun laws in the U. S.. It’s insane that his first thought is to shoot and kill the tree guy bc he parked his rig is on their property. On the flip side the first thought of a rational person would be to take him to court and sue him for damages. This would hit him where it hurts and there would be no funeral or a lifetime in prison for the idiot that decided some temporary damage to his yard is worth killing a man over.

@@kac4klhc977 I think that would fall under premeditation. I was considering a tenant who saw someone trespassing who shouldn't be there. While they rent, it's their property, not knowing if some guy will just show up in your yard at any given time is a problem that the defendant has created.

I'm divided on this. The guy shouldn't have trespassed but the Plantiff was clearly lying. They're both at fault and the plantiff shouldn't have gotten a dime just because he lied and the judge missed that part.

As someone who works in the industry, plaintiff was not lying. That tree guy knew he messed up and went. Ask and recorded the ugliest parts he could close up to try and show no work was done. You cannot… just park your equipment in the neighbors lawn, without written HOMEOWNER permission. The defendant probably does this often to avoid paying for climbers to get the work done properly.. (what you do instead of using a giant rig)

The reason he lost the case was simple. He was trespassing on the plaintiff’s lawn. It doesn’t matter if work had been done or not. He never got permission from the owner to park his rig on his lawn in the first place. Getting permission from the tenant doesn’t count, that’s why the judge ignored it.
