The plaintiff should of gone to the state labor board in her state and if they found that the defendant was engaging in treating employees as contractors they would of been fined more severely by the state and would of prob granted the plaintiff more punitive damages for violations of labor laws. Plus, when the Defendants looked into the hours the Plaintiff said she worked, they found she was fudging her hours and adding hours when they were obviously closed or when no one worked. That's what you get when you allow employees to keep track of their own hours and just submit them for payment.

To me it can make them bias. The less money they award, less they pay out

"$12.50 for excellent work" lol No. You pay her that regardless, and for her if she sucks. But also excellent work and you're only paying $12.50?? Pay welfare wages, get welfare employees.

Small business owners: you're paying an employee for their time, the most valuable thing all of us have. If you want to pay a measly $10/hr, you'll get what you pay for. If you can't afford it, try something else.

I will say that even though I don’t like either of them, the fact that the plaintiff keeps talking over the Judge, shaking her head, whispering, making exasperated faces is so EMBARRASSING. Serious lack of composure (and memory and valid drivers license)…

@@Mbheather88 recidivism is so high because we incarcerate too much.
That’s obviously how the plaintiff pronounces her name. In the introduction of the litigants the announcer pronounced her name tie-nuh. Also the plaintiff never corrected anyone for saying it that way.

I don’t believe the memo line on the paycheck - the defendant should have had a payroll journal showing the days and hours worked.

Some "Felons" do change their spots.....To say on national tv dont hire felons....why dont you say well i didnt do background checks very good did i??? Sometimes when you do a background check and get that info you ask your potentual employees what happened....The defendant has alot to learn still in my opinion.....

If she creates her invoices in order to be paid, why doesn't she have records? I'm self employed and I have all invoices I generate so I can pay my taxes and provide proof of earnings if necessary. I do not understand what she was on about

"Her criminal record shot her credibility." It's statements like that, that poison upcoming society to jumble every crook in the same bag and say "don't trust them". Trust is a person-by-person earned quality. Con or no, she didn't have the trust to have that job!

I also disagree with what the defendant said at the end of the case, don't hire felons. That's not necessarily true at all. You could have a person who is completely spotless with the law and hasn't ever done anything Criminal and they could be a lousy employee. You never know.
