It is only about them ASKING and enticing you to do something you would not have done without them asking. Also, neither you or I have any idea how the undercover officer went about asking for drugs. If he walks up to people and says "Man, I need drugs bad ! I will pay $500 for a tiny amount of crack." Somebody who might have drugs at their house might agree to sell him some of their own drugs. Generally vice agents never say what they will pay but wait for the person to set a price.

Edit: for clarification he coerced me into doing something illegal claiming it was legal because I genuinely didn’t know if it was legal or not.

Wrong. It has nothing to do with having a way out. Entrapment is the practice in which a law enforcement agent or agent of the state induces a person to commit a "crime" that the person would have otherwise been unlikely or unwilling to commit. A cop can't walk up to some random girl, offer her $10,000 to have sex and then arrest her if she says yes.

I am a retired police officer and paramedic and I can tell you some crazy stories. Towards my end of my career, I became a mental health police officer which here in Texas, I was responsible for dealing with the mentally ill and people in mental crisis. A lot of training but I would not changed a thing.

The reason that they were fighting was because the girlfriend found out that her boyfriend was having an affair with his half sister. No joke!!! Another one was I was dispatched to call about a suspicious vehicle and my dispatcher was laughing. When I arrived the caller said he saw a UFO flying low in the sky and wanted me to after it, I asked the caller what did he want to do with it if I found it, write it ticket!!! Needless to say I didn’t go looking for the UFO.

RTA. This is just a semi educated guess. I think the guy was asking for an RTA (Right To Appear) ticket instead of taking him to jail. Essentially it's a short dated summons to appear before the court. Basically it's a way of allowing someone to stay out of jail until their initial court date. These are usually given to people with minor crimes or people who have a serious reason why they need to be out. It's kind of like the cop is saying, "we know this person messed up but we don't believe they will commit any other infractions." I've seen them given to people who were found with small amounts of weed (the pot is confiscated) and in one instance I've seen a guy who was the sole caregiver to his aging handicapped mother get one. It gave him time to get alternate care in place before he went to court.

Entrapment, I believe, depends on who proposed the illegal act. If the guy on the bike just rode up and asked to buy some dope then that might be entrapment.. If the guy on the bike (just riding his bike) saiding nothing and the dealer sees "what LOOKS like a potential buyer", asks if the biker wants to buy some dope...then that is not entrapment. That's why the police had the biker look all dirty and "addict-like". It's like in "soliciting" prostitution....who suggested money first. It's all about who instigated the act.

When it comes to answering whether or not you have anything illegal, the best response is to not admit anything as honesty if you're in the wrong is an admission of guilt. You can refuse a search of your car unless there is probable cause to search. A hunch is not probable cause.

There used to be a show on tv called "Bait Car". You've got to watch some and react to them. I laugh everytime I've watched them because of the absolutely ridiculous statements the thieves give for stealing the vehicle! 🤣😂 There was one I watched where two guys were checking out the bait car and the one guy even commented that it looked like a bait car set up, but stole it anyway! Entrapment is totally different from ‘stings.’ I used to work for a police department doing undercover stings. Basically to see if they would sell alcohol to a minor, and the places we usually hit had reports of underage kids buying alcohol. I looked like myself, no heavy makeup or clothes to make me appear older, and I used my real ID. I was sold to many times because some places honestly didn’t care if they were breaking the law. I have no guilt and felt it was important.

True. I screwed up once - did some time. I was always honest, and gave all Officers respect. I RARELY had any problems. And earned respect from officers and inmates. [ 12 years in - 6 out-on -Paper (Probation)]. Officers in the U.S. almost always ask if you have anything illegal in the car. It’s common practice, so it doesn’t mean they’ll search the car. If you’re being arrested, your car smells like weed or alcohol, you’re clearly on drugs, or you know that they’ll search your car though… definitely best to be forthright about what you have (unless you have a great hiding place and they don’t have drug-dogs haha).

I got pulled over as a teen with weed and alcohol (going to a party) and he smelled it I knew he smelled it and I said yup it’s right there he searched, found it, ground it into the grown, dumped my shitty bottom shelf liquor out, called my parents cause I was under 18 and they (my parents) followed me home.

They will just call the K9 unit and when it alerts, they then can search your vehicle and no warrant is needed. If they see anything that is in plain view that is illegal or suspected to be illegal, they can search the vehicle as well.

Yeah, it’s best to read the legal definition (shirt version 😉) of entrapment for the best understanding on what it entails and then, when and how the police are able to use certain tactics, yet stay this side of actual entrapment. In this case, the man was already dealing. The police didn’t set him up to do it. The undercover buyer just approached him like any other customer would, so he was acting “par usual”, and not being coerced or tricked into selling and then, once the police are successful, arrested.

From my understanding, the reason people aren't just going to admit to having illegal things in their car is kind of 2 things: 1) it's human instinct to lie when you know you'll be punished even if you tell the truth 2) in some cases, even if it's common sense to assume that a specific person (like a passenger) was partially responsible for an illegal item, the law often gives the full blame to only people who can be PROVEN to be in possession, which is sometimes just the owner or driver of the car

I don't know about entrapment, a dealer is going to deal regardless of who it is. I would say the Cops have probably been watching this for awhile. FYI Kabir, never be forthright with the cops. If they find the drugs or you admit where the drugs are makes no difference. It just makes their jobs easier, not make your sentence lighter. Cops are NOT your friends (at least not in America)😏 Sidenote: Be honest, a truly honest law abiding citizens CAN'T be entrapped! You're either honest and can't be pressured into committing a crime or you are a potential criminal waiting for an opportunity.

Your advice about admitting to having drugs in your car is bad advice in the US. Cops generally can't search a car without the driver's permission unless they see or smell (marijuana) evidence of drugs. Cops rely on the fact that most people don't know the law and are given permission to search by the driver, because the driver thinks they are required to allow the cops to search. As far as entrapment, it usually depends on the judge, jury or whether the defendant has a good attorney. The type of operation like the ones in this video usually get shut down once citizens find out they're going on because most people share your opinion.

It’s like leaving the keys in the car with the window down. you have the opportunity but you don’t make them do it. I don’t know how you can say if not for the cop they wouldn’t have committed the crime. That’s a dealer actively dealing. If it makes you feel any better there are restrictions on how an undercover can go down. For instance, the undercover cop or informant can’t be the first to solicit sale etc. Don’t take the dealer’s word that the guy came up and asked to buy; his word means nothing. There will be video evidence for the judge to decide what went down.

Here is the definition of entrapment: Examples of entrapment include: Pressuring a person to illegally sell their prescription drugs by claiming you have no money and will die without the drugs. Repeatedly harassing someone via phone, mail, etc. to shoplift a laptop for your “school studies” Pretending to want to buy drugs and have a drug dealer come to you to sell them is NOT entrapment by definition of law. Criminals always try to lean on this as a way to avoid prosecution, but it clearly is not the case. You have to be a person that coerced to do something that you normally would not do based on an emotional need of another person. The drug dealers have created the situation,....they are willingly looking for people who want to buy drugs!!!

For instance, if an undercover copy threatened to hurt someone unless they stole something, it would be entrapment. If a cop badgered someone into a drug deal that they were trying to refuse, it would probably be entrapment. It's not entrapment if the police simply offer to buy illegal drugs from someone who takes them up on the offer with no coercion or argument. You said it's always amusing to hear people try to come up with stories to try to get out of trouble. The smart thing to do if the police suspect you of a crime is to say nothing. In the U.S. you're under no obligation to talk to the police, and anything you say could get you in deeper than you already are.

Not law enforcement but here's my opinion, Convict informed me "A" is a bad drug dealer on 8th street. Only way to keep community safe is dress as a drug user & try purchasing said drug from "A". This may be only way police force can keep community sober & safe.

It would be entrapment if the cop asked for the drugs. If the seller asked him if he wants the drugs that is allowed. The dealers can be very forward trying to sell as they often have quotes.

9:28 pissed me off for two reasons: She was smiling and claimed no recollection and this poor kid comes stumbling out of the trees with blood on his face, disoriented, an eyewitness account of the events; the second being I didn't get to watch her arrested.

It's never a smart move to allow a vehicle search or admit to being in possession of illegal substances. Here in the US, cops can't search you automatically. If they don't have a warrant or probable cause or any grounds to search your vehicle, then they will try to coax you into consenting. You don't want to try to score "points" with the cops by incriminating yourself. On the other side of things, they can have a K-9 sniff your vehicle without a warrant/consent/etc. and if that dog signals, they will let that dog hop in and tear up your car. If you are innocent and the search turns up nothing, you are not compensated for the damages. Remember during your interactions with the police: they are allowed to lie to you and not the other way around, and is their perogative to implicate you in criminal activity.
