Non refundable deposit. Buyer had every opportunity to come to you to look at it for themselves. At best case apply the $1000.00 towards a new tractor and if not then he can walk away. Buyer wanted a perfect tractor for cheap. He wanted to have his cake and eat it too. Y’all had an agreement and he backed out. Buyer can choose to take responsibility for his decisions or not but that is on him not you. Keep on bud.

"Deserve"? That's all part of being in business. I did engineering for 35 years. Some of the clients were totally unreasonable. One city department was so unreasonable we terminated the contract after three months. If you deal with other people, some of them are going to be complete jerks.

As a contractor down here in South Florida I know exactly what you mean by difficult customers. You have the right idea…create a contract prior to accepting the non-refundable deposit, in your term and conditions it details breakdown of cost for deposit to include mileage surcharge, taxes and processing fees. Once that is signed it’s a binding contract by both parties indisputable in the eyes of the courts. Great video! Loved the parade, great decorations! Merry Christmas 🎄🎁

Reminds me of a buyer I had on Ebay. Claims the item I sold her was broken. I have never purchased a tractor so sorry if this is a stupid question. Do they come with a title? Do they come with a salvage title in the case of a tractor that has been assembled from more than one unit? Was the customer handed documents to assure no shady dealing was going down with vin # not same? Just curious.

Glad it worked out in the end, and maybe good that he backed out as probably a nightmare client long term etc. You have manufactured by adding the loader backhoe from the other machine a tractor that is now a full set up ready I think that machine to work day and night on a small holding or new contractor starting up landscaping type of work. Yes it may not be pretty but even if painted at a sizable cost after a few hundred hours of hard work it will be back to the original condition. I am certain your other 220 customers are delighted with your services and support and I bet you worked your backside off to support and service all these customers. Do not change who you are and be proud.

My grandfather (and my father until he became a pharmacist) was a potato farmer in Idaho. I spent my summers on that farm. I can tell you for a fact that implements get changed out all the time on tractors. The John Deere tractors had a front end loader that was put on and taken off several times a season. The rear implements, like plows, disks, sprayers, combines, bailers, etc. were attached and removed when the need arose. Even new equipment from the OEM dealer has implements put on at the dealer for the buyer's specific needs. Sheesh. He was a choosing beggar.

So Bruce, I just started watching your videos (I messaged you about the large trailer you're about to purchase from Globe) and here I am on this one. As a business owner of a few businesses myself, I can understand how it's frustrating dealing with clients sometimes when it goes this way. But I would like to make a suggestion regarding this one. Personally, I understand that when it comes to selling things, you're supposed to "sell the sizzle". So, you don't want to "over sell" or sometimes "talk yourself out of a sale" which can happen unfortunately if you like to be upfront about what it is you're selling. For me, when it comes to selling vehicles, I personally like to take pictures of the under carriage as well as many areas that "most" people wouldn't take picture of. I do this because when I'm buying a vehicle that I can't look at in person, I want more than 4 or 5 pictures or even 10 so I can determine if it's worthwhile to buy the vehicle to begin with. I know many people feel that just a few pictures is plenty but to me, it's not even close to enough. So, I end up taking a bunch and when I post something for sale, I put almost all of the pictures online so potential buyers can see what they are possibly buying. Now, the unfortunate thing about that is, you may end up "weeding out" a lot of potential buyers by showing some of the areas of whatever it is for sale since they may not be as favorable for some buyers while others may not care. So, it's a toss up on what to show sometimes. But, to me, I say that I would rather miss out on a potential sale by showing too much than have to waste time dealing with someone like you did where they want to nit pick every little detail about the item you're selling because you didn't show enough. So, even though you said you sent them about 35 pictures (which should have been enough really), you probably should have sent them more unfortunately. But, where I think you made me concerned and possibly why the buyer got concerned is was when you mentioned that you told the guy that you "took two tractors and made one". You have to be honest here and understand why this would be a concern for someone. If this was disclosed upfront, then I guess I don't understand why there was a question about it after you took it down there. If they knew this info already and they still proceeded to want to buy the tractor, then it is on them for backing out of the deal. And in fairness, maybe they just had second thoughts which everyone is entitled to. But unfortunately, not when there are deposits involved. If the buyer knew about this upfront, then I don't think it's unreasonable to expect them to pay the deposit as agreed upon. But if this is information that you withheld from them UNTIL it was delivered, then I think they are not totally out of line to question things. And to be fair, I think even you yourself would probably do the same thing because let's be honest here, taking two tractors and putting them together to make one good one is not something that's completely out of the ordinary. However, it's not super common either. And as such, how do you determine if the hours are going to be accurate for the finished used tractor (I won't call it "new" because it's not "new" of course)? Were the hours based on the running time of the engine that was put into the finished tractor? If so, then I think that you were probably okay to request a deposit and stick to your guns on that. But if the hours weren't based on the engine that ended up in the finished tractor, then how were you determining that the hours on the hour meter/gauge would be accurate? How could they be accurate? The problem is, even if the hours were accurate for the engine that ended up in the finished tractor, what about the wear and tear on the rest of the items like the hydraulic cylinders, the PTO, the tires, the controls for the bucket, and so on? How do you determine how much "wear" of life they have left in them or have taken off of them so far? Look, I'm on your side here for multiple reasons EVEN IN SPITE OF whether this was discussed prior to you delivering the tractor. Even though I've only watched a few of your videos so far, I think I may have watched a few in the past as I was browsing KZbin randomly. But anyway, you don't strike me as the sort of person that wouldn't have disclosed this info PRIOR TO having the tractor delivered to the buyer. Perhaps I'm wrong here so I'm giving you the benefit of the doubt. But, I would hope that you would be honest and come back and tell us if you did or did not disclose that bit of info because to be fair to the potential buyer, that bit of info matters no different than you would want to know if something was combined together from two different tractors for your own info. And so, for that reason as well as others, I don't think the buyer was way out of line for asking for at least part of his deposit back "if" you didn't disclose that info upfront. If you did, then no, the buyer DOES NOT GET ANY of their deposit back. But also, the other reason I say they don't get any of their deposit back is because that portion goes towards the cost of hauling the tractor down there whether they purchase it or not because even if they decide not to purchase the tractor, there are still costs and/or expenses associated with delivering it to them. In my opinion, if the person doesn't want to potentially lose out on a $1000 deposit, then they can make arrangements to come up and look at the tractor or, pay someone else to deliver it so it doesn't cost you anything. But either way, as you pointed out, not only does that deposit go towards the cost of fuel (which isn't free) and the cost to pay your employee to drive it down there, but it also goes towards the expenses of operating and maintaining your equipment. But also, and maybe more importantly, the risk you're taking by going down there and potentially having something happen to your truck or trailer. As you mentioned, how bad would it have sucked if you blew a tire on the way down there or back and you don't end up being able to get the tractor sold? Or, worse yet, what if you would have had a major break down like an engine or transmission or differential issue? I work on vehicles and although I haven't worked on semi trucks, I know what the costs are for fixing some of these major issues. But also, this isn't something that you can typically do on the side of the road and the tow bill to get a semi truck and trailer back to your shop is in the thousands and not hundreds like a typical car or pickup would be. But even though nothing may have happened (thankfully), YOU WERE STILL PUTTING WEAR AND TEAR ON THE TRUCK, TRAILER, AND TIRES REGARDLESS OF IF THEY BOUGHT THE TRACTOR OR NOT. So, for this reason and many others, it's fair to get that $1000 "non-refundable" depoist and keep it which is what you should have done. I know that you probably wanted to think that you were doing the right thing because word of mouth can go a long way but the reality is, as you pointed out, your business is right along a major highway. Not to mention that you promote yourself with KZbin videos and I'm sure you do other things to promote yourself on Facebook or in some local and regional marketing media like print, newspaper, radio, tv, or wherever. And as such, it would be completely stupid for you to try to do something "shady" which is essentially what this buyer was trying to imply you were doing. So, I think going forward you have to be firm with your clients and just tell them that the cost of delivering the item is non refundable NO MATTER WHAT. Send them all the pictures they can handle and any documentation you can provide and overload them with info. That way, it's on them if they decide to pull the trigger but then later back out. Whether they end up buying the item or not, they have to understand that they are paying for the fuel that goes in that truck, the pay that you have to pay your employees to drive that truck and trailer, the wear and tear on everything, the additional miles put on for the tires or maintenance for fuel and oil filters and fluid and the high risk of having something break down on the way there or back THAT WOULD NOT BE POSSIBLE had you not used your equipment and employees to haul the item to them. So, they have to understand why this can't be refundable. I know it's hard to stick to your guns for some of this stuff but with this one, you should have. Fortunately and ironically, it worked out that you ended up getting it sold and it's weird how that happens in business sometimes. I have weeks where I'm slower and other times when I can't figure out why we got as busy as we did. Sometimes it just doesn't make sense.

I don't know what it's like over there in regards to VIN's and stuff but here in AU you can easily look them up to see if the vehicle has been stolen or owes money I think too, just part of buying a used vehicle, if the buyer is too lazy to do some simple legwork when buying something they're probably never going to be happy.
