The plaintiff told her that he called the number on the dumpster first and the guy said they’d get back to him and never did. So, he called the police to file an incident report which led me to believe that he called the next day. Also, they could have printed a bogus work order and changed the date and time since it’s their own company.

no , i know how these old bl*ck dudes are , there is one in by building and he is always looking at who is parked around his beat up car to see who he can pin old damage on , so I make sure i never park next to his car , thats how these guys act when they get old and they got something to sue someone over .

This is bs. You don't have to have a good memory if you're telling the truth and each time they were asked about the fence they pointed to the time on the paperwork which can be changed. I was a logistics coordinator for years and the software we used allowed us to input our own date and times on invoice, in fact I always had to input the date and time because I worked at night and almost all of my orders were worked during daytime hours. She missed the part at the beginning of his testimony that it happened that morning. He called the dumpster phone number. They said they would call him back. They didn’t so the next morning he called the police. He said that at the very beginning.

Yes, the driver was surprised that it said 12 noon. Clearly he knows he delivered it earlier than that. Also likely they dropped it on earlier date. However, too many holes for the plaintiff to win.

Ultimately I think the plaintiff can't prove the defendant is at fault. The plaintiff is such a cute older man, I feel bad for him. And maybe I misremember but didn't the plaintiff say he contacted police another day after the dumpster company never got back to him?

I wish the plaintiff had someone to help him present his case better. There were missed opportunities because he should have questioned the validity of the defendants documents. He should have also stood firm that he tried to report the incident the same day but no one called him back. Therefore he contacted the police. He should have presented his call log and asked neighbors if they had surveillance cameras to help his case. I don't think he lied about anything, and genuinely believed the defendants damaged his property. His mistake was giving the police the wrong date.

Judge got it completely wrong on this one!!! The driver said he called ahead and no one was there to receive the dumpster - at noon?! Then the company guy answered the judges question faster than the plaintiff about whrn the call to police was made - now why the hell would they know that and how?! That driver absolutely hit that fence and then a fake delivery report was created based on the police report they conveniently had! I cannot believe Milian sped through this case the way she did denying that poor guy justice!!!! Totally unfair!

I have found that liars/ people trying to omit the truth always says says " Not not i recall/ Not that I remember" which is a tactic that I know for a fact that defense attorneys tell their clients to say. With all due respect the judge got this wrong. 1 million percent they hit his fence. The judge clearly misheard things because the elderly man was very clear that he called the number on the can and he was told they would get back to him AND then when he did not hear back from them he called the police to at least get a police report so he had something for court. The owner gave me a very very slippery slimy vibe and so did Anthony the driver. The paperwork was clearly doctored up prior to court OR they were telling the judge the wrong dates on purpose to make themselves look good. Either way that company is very slimy and at the very least should have offered to send a couple guys over there to fix the fence in good faith. I have done a ton of renovation and have always asked for a dumpster to be dropped right away in the morning, never at noon!! The judge should have rewound the tape and listened to the plaintiff OR placed a call to the man who ordered the dumpster to confirm dates OR placed a call to the police dept to confirm the statements given by the plaintiff.

I doubt that they hit the fence. The damage on the fence post is only about i8 inches up from the ground. That is too low to be caused by any part of that big truck except its wheel. Even the bed of the truck is way higher than that damage. And it is unlikely that the truck would cause that sharp bend in the fence post if it was reversing into the driveway. The truck would be driving slowly as it reverses, and the force pushing against the fence post would cause the entire fence post to lean back from the ground...thereby uprooting it from the ground. I also doubt that those heavy steel dumpsters would cause such minor damage to only the fence post if the dumpster mistakenly got dropped against it. The truck unloaded the dumpster inside the driveway & if the worker made a mistake & placed the dumpster too close to the fence so it was struck, the weight of the dumpster would push the fence outwards towards the road, & not inwards. And those dumpsters are so heavy that it would also cause more damage to the post, maybe even uprooting it. Construction is going on at the property & it is likely that the fence was struck with a powerful but much smaller object that has an edge about 18 inches up from the ground. maybe a vehicle with a low metal bumper or one that is towing some type of cart. But that truck & the dumpster are both too big & heavy to cause that minor damage to a flimsy fence.

Depends on the situation. If it damaged the fence to a point that you have to replace the whole fence, not just a post, you get the right to the whole fence. In a case like this if they messed up that one pole so badly that the alignment of the whole fence got off. Sometimes a fence company will say to re do the whole fence because it is cheaper and less labor intensive then trying to make sure the entire fence is secure because of one pole.
