As states scramble to push back their primaries to comply with the federal guidelines aimed at social distancing to combat the coronavirus, whispers have begun that maybe, just maybe, President Donald Trump will use the pandemic to cancel the 2020 election entirely. This is flatly untrue. Here's why. Primaries are state-run contests. States are given wide leeway to set the dates and times of how voters get to choose the nominees for offices like state legislature, House, Senate and governor. While postponing a primary isn't easy -- there are massive logistical challenges to doing so -- it is, broadly speaking, up to state governments to make these calls. This is not a perfect process, of course. Ohio is a good example. Gov. Mike DeWine asked the state's Supreme Court on Monday to postpone Tuesday's primary election in Ohio until June. The court said no. So DeWine -- and the state's top election official -- ordered that polling places be closed. And so, the primary didn't happen. A general election is not up to the states. It is governed by federal statute. And this language in particular:

I’m with the OP. Clearly though, it isn’t that they’re unable to do it by mail. They just don’t want to make voting easier for the common people because he’s probably depending on the electoral college to get him through like they did 4 years ago... See: gerrymandering. I don’t like either party much these days but when one wins the popular vote by 2-3 million votes that seems like a prime example of why some members of the electoral college don’t represent anyone but themselves.

Middle school taught me how to do synthetic division (because math was important to that school for some odd reason), and elementary taught me how to sneak snacks around campus. High school taught me stuff I couldnt really grasp without prior knowledge and they didnt have the funding, time, or energy to teach one kid years worth if materials.

postponing or canceling the election would not work in trump's favor, even if he could do it, because only 1/3 of senate is up for election, so remaining 2/3 would decide interim president after trump is termed out. those 2/3 are mostly democrats. 1/2 the states do vote-by-mail so unless the postal service stops, at least half the states can still vote. best trump can do is like Wisconsin, where Supreme Court forced voters to vote in person, and the governor closed all the polls, so thousands and thousands of people had to go to just 5 polling places and risk getting sick in order to vote. but that was a primary, which states can (and did) postpone, Election Day is locked so that wouldn't work

It's not a strict rule that they have to be of the same party, the senators (appointed by respective governors) just have to be favoring that person (they probably still wouldn't pick him though). Though, it doesn't matter either way because Bernie was elected in 2006, so he isn't the second *longest-serving* democratic senator, he's only the second oldest. Important distinction to make. Pat Leahy was elected back in 1974, while the second longest serving is actually Dianne Feinstein who was elected in 1992.

Martial law is unconstitutional in areas where local courts are still in session, which they still are even through Coronavirus. It selects for subservience and obedience. All senior journalists, judges, politicians and generals have reached those high positions because they are subservient and obedient to power and lack independence. No general will do what you say. Sure there is logic to setting it up and keeping it. It was to make sure that those selecting the president could meet him before making a selection. Each State would select an appropriate number of people, equal to their number of representatives (determined by their population) plus the number equal to their number of senators. This has an effect of giving low-population States an outsized influence in the vote - which was important to the slaveholders of the Old South which had few who could legally vote (you had to be white, a man, and a land owner at the time to vote!) It's outlived its usefulness. Average people can listen to candidates and politicians speak (in real time) from anywhere in the world. People can see debates, as well as read about the issues and various people's stances on the matters, and decide for themselves.

Recently, several churches have been meeting for service in person (some following social distancing and CDC guidelines, others without following guidelines). Some governments, local and state, have used law enforcement to put and end to meetings, or force fines on the groups. There is a debate on if this is legal based on the 1st amendment, and some states are considering churches and religious gatherings exempt from guidelines. What is the legal precedent established for this kind of law enforcement and application of 1st amendment rights?

On the other side, not everyone has access to the internet needed to use those methods. After all, places like Starbucks that could have provided free wifi now cannot be used for that method and going to someone else's house that has internet might not be viable either because there is no way to ensure that they have not contracted the virus. Before it was easier to just send buses to pick up those that were unable to get to church for whatever reason but providing internet for those people would be much more expensive and therefor less practical.

I appreciated this video overall, but I would love to hear more about your thoughts on the Electoral College. I think it is still necessary in order to ensure that California and New York do not decide every election. It allows other states to have a say in the presidential elections. That being said, I hope you post a video about your stance on the Electoral College so that I can have a better understanding of your perspective. Either way, thank you for the videos and the time you devote to them. They are quite informative and provocative.

Considering he operates and lives in California, his view is not surprising. People who live in California and New York generally want to do away with the electoral college. The fact that Republicans cannot win an election without it, and Legal Eagle does quite little to hide his left leaning bias, his view is to be expected, as is the condescending way he explains it. He’s certainly knowledgeable about law, but that doesn’t mean he grasps how national policy affects the entire population of a country. He clearly doesn’t.

Objection, precedence has established time and again that law curtailing executive authority is only as strong as its enforcement; and further that the failure to enforce said curtailments results in their erosion or dismissal. If a president does something and no one is effective at stopping him it often becomes legal.

The question becomes whether those with lawful force who answer to the President of the United States would decide "Hmmm, it's past noon on 20th January who's the new boss? Oh, it's Mr. Leahy let me make a call. President Leahy what would like me to do to the squatter in the White House, he won't leave? Remove him. Roger that." Essentially the reason the Executive Branch can get away with violating the law is it controls the guns. If the Executive Branch decides a particular person is not its boss (rightfully so in this case) then that individual can no longer violate the law. What happens in such a scenario depends on how many law enforcement and military personnel are loyal to Donald Trump, to the Republican Party, to the Office of President as they think it's possessed (if they don't understand succession) and those who are loyal to the Office of President as it is possessed.

Timothy Stamm sure, but every act to hold him to account by those with the authority and trust to do so that fails (and every act not taken by said parties) legitimizes his high crimes and misdemeanors. The most impeachable president was impeached on the weakest charges, effectively giving everything else a pass. The same level of weak and token resistance will serve only to cement his claim to holding office without an election, if things head in that direction.

The Speaker of the House need not be a member of the House of Representatives. So in theory, the House could put anyone they wanted in the White House, so long as they acted before Jan 20th.

I know this comment is late, and basically irrelevant, but they'd have to do it before January 3rd in a scenario where the election was prevented, not Jan 20th. After that, there would be no House to elect a Speaker, as the representatives' terms would have ended.
