I can understand being upset if you create something really unique and someone copies it and starts selling it, but these people kinda lose me when what's being copied is super basic and is already being done by many other companies. Like you didn't create it and it is nothing new.

This is why I hate this tiktok culture. There are hundreds of candle companies and THOUSANDS of scent names. Yall wanna trademark everything and its crazy. Do you know how many birthday cake/enchanted/illusion candles their are? Should the first company to ever use birthday cake sue everyone else? No because its a scent and it can vary from candle to candle just stand out on your own you don't have to try and destroy everyone around you to make your company pop.

Okay but the later labels were directly copied. And warnings are usually prewritten, if she wrote it herself I think it's worth looking into whether or not that warning label is common, if not she copied it, which is at least kinda shitty of her. The completely copied label is out of order, you can't do that.

The statement “May cause…” is a labelling requirement and the words are directly prescribed by the regulatory agency. All of the other claims eg Sensitive Skin are customer-choice. So all of the sentences and wording in a row was kinda dodgy. (I work in Regulatory Affairs at a perfume company)

@jabbermund I see the point you're making. Don't get me wrong, copying directly is absolutely a crime and definitely theft. If she is copying exactly, then she is absolutely wrong. From what I understood Markie said: everything is just too vague for either of them to make a solid case. Plus, with most of these small businesses using similar services to get their products branded (e.g. canva, chatgpt) there is going to be a whole heck of a lot of duplicate looking products that won't technically be copying.

Honestly serving in relation to laundry detergent seems weird to me in the first place because the wording implies you would eat laundry detergent. Imo they both copied it from somewhere

Brazilian Summer was a candle name I use to buy at the dollar store back in the late 2000s. She doesn't look old enough to be the person that produce it. I feel like Brazilian Summer is a common name.

As soon as I saw the instagrams put side by side, I laughed. As a former professional candle maker, these people are fighting over thin air and aesthetic. Part of the reason it is SO hard to make a living selling candles as a small business is because it is hard to stand out. There are standard candle containers and label shapes that are the least expensive-medium expensive and they ALL are the same 3ish manufacturers in the US no matter what supplier you buy them from. In addition, most people are using templates for their labeling designs, at least to start so yeah… Those designs are not unique. Also, most of the candle fragrances makers use are reverse engineered dupes for pre-existing popular fragrances, and anything original will, again, likely come from one of like 5 candle supply companies. Everyone uses the most popular scents because that is what sells, so the fact these owners are fighting over what is truly not original work either way… waste of their energy. Candle making is NOT easy or simple, but many people come up with the same ideas because creativity doesn’t happen in a vacuum. Mind your business and go keep making millions, this is just foolishness.

I should clarify, making *good, high quality* candles is a lot of work & not as easy as just putting an ounce of fragrance in a pound of soy wax, which is what many do when they start out. Formulating, endless testing, adjusting fragrance load… there is a lot of mental energy spent while owning a candle business. I do agree, it is an accessible hobby, and satisfying to make, but like I said it’s hard to make a living doing it if you aren’t a savvy marketer and have a strong & unique brand (which imo is rare, but does exist!) or you have amazing product and sell at farmers markets.

The candle market really is oversaturated that even if it's more work than just simply pouring wax it couldn't be the most difficult thing in the world to figure out. I thought maybe she meant that it's not easy making candles that are unique & stand out but idk. I want to be clear that I'm referring to pourable cup candles being the easiest to mass produce I do acknowledge that something like hand-dipped stick candles are much harder & take more time.

The market is oversaturated because candles are easy to make, this makes being a business selling a product most other businesses have hard to do. It's hard to be "original" when majority of the market has already done it lol. Candles have been around for thousands of years it stands to reason majority of designs and scents made by a human have been done at least once

There's a candle company, called exmo candle co, that does give their candles _the_ most unique names (they're all related to mormon stuff, almost like...memey stuff, kinda...the creators are ex mormons & include a blurb about the inspo for the candle & its name on the product item pages), things like Licked Cupcake, which is named after the purity bs they pushed on young girls about how "no one would want to eat a licked cupcake" (where "cupcake" = a girl, and licked = sex before marriage/lost virginity). So, I could totally see their names being trademarkeable. However, when it comes to things like Goddess & Luxe...while some of mavwick's _might_ stretch to being more original, those two definitely could never.

Cupcakes come in all shapes (mostly round, though) and sizes. And even if someone licks the frosting off, some people aren’t germaphobes and don’t like frosting that much. Plus, most cupcakes have too much frosting anyway. Licked or not, a cupcake is a cupcake and they’re delicious. Maybe not everyone, but someone will eat it. The moral of the story is: don’t just assume that a licked cupcake is trash without checking to see if someone might actually appreciate or prefer it that way. P.S. I guess this logic could also be applied to virginity, or whatever

Yeah but that's the thing, the first girl isn't arguing about anything except for someone who literally stole her **copyrighted** names. It's the Flicker and Flame girl who's claiming she stole her names and scents and whatever else and causing a bunch of drama. The initial content thief that Maverick accused hasn't said anything and has stayed out of it. The flicker and flame chick saw Mavericks initial video about having to handle someone using the EXACT NAMES she was using, and decided to make this situation all about herself and accusing Maverick of stealing from her, which she obviously hasn't done.

It's not just the names though, it's the exact names tied to the same exact scents(proprietary blends that she herself formulated with generic 3rd party purchased oils), along with replicating other parts of her business and essentially making themselves kind of like a ghost kitchen version of her business. That was her main issue, and imo it's a legitimate one. And then the flicker and flame chick decided to stick her stupid nosy face in the middle of it, muddy the water and make it a bunch of stupid drama that didn't need to happen, because she doesn't understand nuance and would rather spend her time making catty tiktoks instead of trying to make something unique that would be very obvious if someone copied it. 😂

The point is, those items are already in process of being copyrighted and trademarked, and the main issue is this third party company that Maverick was complaining about in the first place, before Flicker and Flame stuck her stupid nosy face in the middle of it and made a bunch of drama that didn't need to happen, was that this third party company was basically copying her exact names, the specific scents, and essentially trying to make themselves look like her actual business, not a unique business that just happened to be using the same products and names. Furthermore, Mavericks names were different from Flicker and Flame so she didn't have anything real to fucking complain about anyway, bc the initial complaint Maverick made was of a company copying it EXACTLY, instead of just being kind of similar.

To my understanding, candle makers buy the fragrance oil and name the candle something similar to give the vibe of the candle. My friend makes candles and she names the candles similar to the fragrance oil and tbh to me that sounds only logical to know what the candle is 😅

Letting people know that you are in the process of trademarking a name that they have already been using is a good way of getting your application opposed on the grounds that your use is not unique to the market.

"Luxe" and "Goddess" are hardly unique enough to be identifiable to a particular brand. TBH, I'd be on the "infringing" company's side in this even if the scent profile was similar, because copyrighting single words shouldn't be a thing. If her claim was on something more specific like "Bright-Eyed Goddess" for example, then I'd give her that. But these ideas are so generic - one-word names, white writing on black labels. None of the creative choices involved in this drama are original enough to be considered "ownable". I don't think the other company is in the wrong here.

Copyrighting and trademarking are not the same thing....Not that I'm on her side for this but she's not suggesting that she can copyright those words. She's seeking a trademark (that will almost certainly fail because I seriously doubt she can demonstrate that she was first on the market and/or the one who is most associated with those names).

The containers they buy for their products are all basic...my daughter makes candles and guess what, you don't get a lot of choices in colours or styles unless you start paying up for it. That's why most candle companies all use the same drop shipping companies for glassware ..they all pump out basic designs and colours for CHEAP! acting like they are trending..no babe,they are cheap to produce and everyone has a TikTok shop..

If you legit google bulk buy the types of candle containers they are selling, that's all they are doing,is bulk buying, probably out of a drop shipper out of China, because it's the cheapest...and you just literally get a box sent with the same jar as everyone else.. you have to pay$$$$$ to do what say Halo Taco ( nail polish) did and that was pay to design their own bottle and have special specific molds made ... You have to pay to have a unique design or colour..and none of these people are willing to cut into their overhead and do that! They leave it to Yankee candle and those other candle shops to come up with new candle jar molds in mass, that some designer in China is willing to knock off for cheap. It's how it's done. Gravy these petty women acting like what they are doing is new or unique. I am a witch,I make ritual candles . My candles are unique because the person makes them WITH my, and I teach them how to make a mother candle and Ritual candles ... My mold isn't proprietary, it's a silicon heart cake mold.. and I always tell people to pick the perfect vessel and I explain what makes a good mother candle vessel.. acting like these jars and labels are new 🤣🤣🤣 I'm a 55 year old Witch who was taught candle making at the age of 8 by another Witch, the jars not much different if you used a jar..we poured leftover wax and made Ritual candles for our coven members in jars, if they weren't a dipped candle ..

Can't help but think that all this copying accusations regarding the packaging could be avoided if they hired a graphic designer ( or at least someone with knowledge on branding ) to make the labels and all the company branding, packing and stuff. Like yes, even as an actual graphic designer is possible to do something similar as someone else, mostly if it is the same market and you're trying to follow trends, and I'm not saying this people didn't consult one or did this, but if you're both using chat gbt, ai tools and canva to make labels without really "innovating" the templates then... I'm sorry, but is on you and you can't really claim originality on those things 🤷‍♀️

This type of stuff is why social media is miserable most of the time. I’ve started doing candles, to act like someone within these spheres are original when there are millions doing the same thing and getting mad is so pathetic. This situation goes beyond petty to just plain pathetic on all sides. It’s like if Tide got mad at someone for similar packaging and saying all purchased products are to ruin them 😂

I used to do markets, both as a stall holder and as an organiser. This sort of thing isnt new. A lot of craft markets try to limit the number of similar stalls unless they're in high demand because of this sort if thing and a lot of smaller markets don't care. I've had jewellery copied, seen very similar crochet and knitting designs that sold well for a stall holder one month, appear on the table of a different seller the following month. One month a candle maker had candles in tea cups, the next month, so did another one... As well as all the same frgrances. This person had found out the supplier of the other candle maker and basically duped their entire range. It doesn't make it right, and it sucks when it happens to you but the drama is basically identical on a smaller scale. Some people that make and sell "crafts" can be really weird.

If that was genuinely her intention to steal your products and designs then it would’ve been released shortly after (around December or January). I just think that this is a case of someone who can’t accept the fact that someone might have slightly similar tastes and interests as them and that multiple brands have similar products because they’re following the trends.

Surely there is no way you can copyright a fragrance that isn't even her own blend?? Someone else created it and she changed one word of the name they had already given it. Goddess and Luxe are not creative names. Of course there will be several repeats. FFS, witchy candle companies undoubtedly have one called goddess. luxe has been a popular word for well over a decade. Unless you're making up words, or spelling them weird, I promise your one word named candle is not unique.

The craziest part of this whole controversy is that every single one of them stole “their” ideas and styles from my candle line. This really surprised me because I only just now decided to make a candle line so whatever time machine they're using to steal my ideas needs to be found and destroyed or they may steal your ideas you haven't had next.

I used to make candlesas a business. I RARELY buy other people’s candles. Even now…if I have the stuff, I will just make it. Could be because I am sensitive to chemicals and know what went into mine and trust that I won’t get sick, but I also loved the scents I created. If I happened to come across an awesome candle at a fair or event, then yes, I would ask the questions I needed to for safety and buy it. But the thought that I don’t like to smell my own candles is crazy! If you don’t like what you are making, don’t make it. Sounds like a weird made up excuse as to why she was doing research and development on other candle makers work. 😒

This was just as enjoyable to watch as Emma In The Moment’s videos about crochet-tok/crochet-tube drama, and the absurdity of various small creators trying to claim that they invented the concept of vests or chevrons or sloppy sweaters. the claim comparing disclaimers is WILD, of course Tide laundry detergent is going to have pretty much the same warnings as literally any laundry detergent lol. it's also truly wild to admit you used chatGPT to help you make the WARNINGS on your candle, which historically, can be dangerous, these two are both a bit wild.

The contents of a disclaimer can be the same while being worded differently. I thought the language she used sounded a bit unusually flowery. I don't think she was annoyed the other girl copied her warning, but was using this as an example to show that she was at the very least heavily inspired by her, which highlights the hypocrisy of the OG girl's post about another candle brand "stealing" her scent names.

I don’t know how candle or scent businesses thrive online, because you can’t smell the item until it arrives Maybe I’m weird but I’m really sensitive to smells, I need to smell the candle first, to make sure it won’t give me a headache. So I could never just order something that might stink up my home and make me feel ill. I have to go to physical candle stores. It can say “raspberry with blah blah accent” and it smells like burnt tires😂 Maybe because they are all buying scents wholesale and then just renaming it to for their company, the buyers know what it’s going to smell like? I wouldn’t take the risk.

She took ideas and ran with it from the blonde girl but then wanted to cry when someone did it to her. Do you know how many candles there are out there called snowflake or midnight or whatever else? This happens with just about every small business. I used to make a product that I put so much time and effort into making and was successful with for about a year before people who bought my products copied them. There's several now, and they use poor quality materials and price it accordingly cheap ... but people don't know there's a difference, so mine just look expensive for no visible reason. It's sad and frustrating, but there's very little I can do without lawsuits, etc...and I don't have the money for that.

If either of these people spent a fraction more on unique packaging and put some thought into differentiating their brand from every candle sold in Home Goods for $5 they would've had a more legitimate complaint and higher profit gains. Also, these jars aren't necessarily on trend, they are cheap for manufacturing/production so it's what's pumped into the market.

This is why you have to create your own brand identity that can only be tied to your brand. Using a specific color scheme, font, very distinct labels and packaging. Don't do something generic or trending. Do something that is unique that will immediately be associated with you and only you.

I live in a town of 1000 people. My whole life except when I went to school I lived in this town. If you start a pizza shop & do well. Everyone in town starts selling pizzas at their restaurants and even at the gas stations too. Whatever you do that makes you “look” more successful than others they will copy. They say copying is the finest form of flattery but it can be very frustrating but it pushes you to keep things fresh all the time then. If someone copies you that makes YOU the trend setter.

Black labels have been around for a long time. For example with alcohol it tends to be the companies most expensive bottle. In general it's been used to make products look more premium or to appeal to male customers (skin care brands often use black or dark blue for their male product line). It's a very basic concept in packaging design.

Personally, this "candle scandal" is just so wild to me. There came a time when I was into candles and have been buying from shops who uses books as their inspirations. I'm so used to seeing a lot of similarities in almost everything. Even restaurants offer similar items in their menu. Steal Like An Artist is a good book and eye opener about originality and art/craft. It's fun to listen to these dramas but some of them are just not worth it. 😅

As someone who loves candles, I never remember what the heck their names are anyways😂😂 don’t get me wrong, I love a clever name but recognizable branding is way more distinguishable to me than what you decide to name it, especially when I’m going to be staring at the thing while I’m enjoying it and want it to look nice. I’ve got more candles than I can count and I’m way more going off the wax/jar colour, smell and then label when looking for the one I want than the name, especially when they’re so generic like these ones.
