Bodycam Of Captain Arrested For BUI during Airshow - Florida Fish & Wildlife Officers were conducting traffic control for the Blue Angels Airshow with emergency lights activated in marked patrol vessels. Two marked FWC patrol vessels and a Coast Guard vessel, all with emergency lights activated, were positioned on the east side of the Pensacola Land Cut. Another marked FWC vessel with emergency lights activated was on the west side of the land cut, assisting with traffic control. A black pontoon boat with multiple individuals on board was observed traveling west in the ICW on plane. It is not legal to proceed faster than slow speed with minimum wake within 300 feet of an emergency vessel with emergency lights activated. All other vessels in the area were traveling at slow speed with minimum wake.
One officer hit the siren, and they approached the black pontoon vessel to address the violation. The vessel slowed down but continued south towards Ft. McRee. No registration numbers were seen. The operator, a white male in American flag shorts and a blue long sleeve shirt, was later identified by Florida driver's license as [REDACTED]. The officer informed [REDACTED] that they were going to pull alongside him.
The officer instructed [REDACTED] to turn to starboard and navigate to deeper water. [REDACTED] acknowledged but continued south towards Ft. McRee. The officer gave loud verbal commands for the captain to turn to starboard, but he continued forward rather than turning. Passengers on the vessel also pointed to the starboard side as the officer continued to give loud verbal commands.
[REDACTED] commented, “You can pull beside me. I’m fine. I got 9 feet of water right here.” The area had a sandbar with approximately 2 feet of water, causing the patrol vessel's propellers to touch the sandbar. The officer instructed [REDACTED] to move his vessel to deeper water again, to which [REDACTED] responded, “I ain’t broke no laws right here.” He began moving towards the channel into Ft. McRee.
The officer maneuvered the patrol vessel to the port side of [REDACTED]’s vessel and boarded it, instructing all occupants to remain silent and seated. He instructed [REDACTED] to beach his vessel, which he did on Robertson Island near the entrance to Ft. McRee.
There were 7 individuals on board [REDACTED]’s vessel. The officer asked him to show 7 life jackets, a type four throwable PFD, a whistle or horn, and a fire extinguisher. [REDACTED] pointed to his fire extinguisher near the console and showed 7 life jackets. The officer reminded [REDACTED] to show the other equipment, and [REDACTED] complied after some prompting.
The officer observed a 5-gallon bucket full of empty beer cans on [REDACTED]’s vessel. [REDACTED]’s face appeared red and sunburnt, his eyes were bloodshot and watery, and an alcoholic beverage smell was detected on his breath.
The officer asked [REDACTED] to perform a seated battery of standardized field sobriety tasks (SFSTs). Initially, [REDACTED] refused, saying, “You are gonna ask me to walk 10 steps in a straight line after I’ve been on a rocking boat.” A male passenger interfered but was told to return to his seat. [REDACTED] eventually agreed to perform the seated tasks.
At the conclusion of the tasks, the officer informed [REDACTED] that he was under arrest. [REDACTED] repeatedly refused to board the patrol vessel, necessitating the officer to grab his wrist. [REDACTED] resisted but eventually boarded the patrol vessel. He was placed in handcuffs and a life jacket, and his vessel was left in the care of his spouse. [REDACTED] was transported to Sherman Cove Marina, where he was read the Miranda Warning. He admitted to drinking Miller Lite but claimed he had never been arrested for BUI or DUI before.
At the FWC BUI trailer at Bayou Grande Marina, [REDACTED] refused a breath test after being read the implied consent warning. He was charged with operating a vessel while normal faculties were impaired and resisting arrest without violence, and transported to the Escambia
