If you knowingly walk onto property where a firearm is prohibited with your firearm in Oregon, it is criminal trespass, up to a year in prison and $6,250 fine. ORS 164.265¹ Criminal trespass while in possession of a firearm If you carry on my property I will know if your firearm weighs over 16 oz. Entry onto my property with a firearm without my permission will not meet your needs over time and may not be made right in your lifetime.

I live in Ohio and I choose to ignore the signs. This is my choice and I'm not advocating for others to do so. My method of concealment was carefully chosen and I'm confident that my firearm will not become exposed unless I present it. The last thing I ever want to say to another friend or family member is " If only I'd had my firearm none of this would have happened ".

I'm in Ohio as well. I'll avoid a posted business if it's something like a gas station and I can go across the street to another, but if the business is the only one of it's kind for 40 miles then I'm going in while carrying.

As an officer in Texas...this is a law I will not enforce. Our law does not say SHALL arrest, and I don't agree with a business deciding to make its customers/ employees LESS safe!

If you are carrying correctly and are not using your gun criminally, nobody should ever know. If situation arises where you need to shoot, do you care? I carry everywhere I go. Period.

Amen. Everyday, everywhere, except when I use an airline, which I avoid whenever possible. If the gun is properly concealed, the issue never comes up for discussion anyway. If you must use it, you will still not care that you are breaking someone's rule.

@@lokiprepper I can because New Zealand doesn't have that kind of constitution yet human rights are guaranteed. The biggest issue I have with the US constitution is the gun rights, it's like a legal reason to shoot someone unprovoked. Is it any wonder mass shootings are ridiculously high there.

@@explosivebest3703 As a US citizen, I can say with confidence that it’s a people problem, not a gun problem. Didn’t you guys just have a mass stabbing recently? By the way, if you shoot someone unprovoked, you will go to prison for life if it was intentional. I have a permit to carry a handgun at all times, and they strongly emphasize to never use your gun unless there is absolutely no other option. The statement you made regarding the second amendment allowing us to shoot anyone unprovoked is pure hyperbole.

@@lokiprepper it was a mass shooting 2 years ago but the difference is that it was completely unprecedented. It's like the normal state of affairs in the US. Besides it is a gun problem with an element involving people though I don't understand how you lot don't see it for what it is. Our government made immediate changes to legislation after the mass shooting within weeks to further mitigate against that. New Zealand is anc always will be a safer place to live than America. Why are so arrogant to think that because of your constitution, you're the only country in the world that affords human rights and freedoms. That is just arrogant and ignorant.

If a business doesn't want you to carry concealed, DON'T DO BUSINESS WITH THEM! Let everyone you know that they shouldn't go there either because only criminals are safe there. A huge part of standing up for your rights is not helping people who would deny you your rights.

I ALWAYS have my gun at the movies. It is a "fish in a barrel" situation and I would rather not see the movie than sit through it without my pistol. Common sense: Keep it concealed and if you have to use it they can give me whatever charges they want to, better than being dead.

99.99% of the stores that have no gun policies in Virginia, like AMC movie theatre and subway and safeway and chipotle and so forth.. Ive never seen a no gun sign on the doors. Which means i can carry a gun in there all i want, despite them having policies online stating no guns. Reason is because in VA the store has to have a no gun sign.. if they dont, their policy means jack shit.. Only if the manager asks me to remove the gun from the premisis do i have to listen. Otherwise if no one says anything i can go in all i want.

Just because there is a situation where a firearm is presented in a public place dosent mean you have to use your firearm too. You would have to be very careful on what actions you do. I would say even more so than any law enforcement. I hate to say it but the best course of action may be to just leave the area as quickly as possible. Its not a cowardly thing to do its a "Im not protected by my laws in this country well enough to do anything" situation.

@@nonyabiz9487 problem with the usa. Is we have states.. each state is different... In virginia for example. If i feel like ny life is in danger from someone who is charging me with a weapon. Or if im being attacked. I have the right to shoot to kill. In other states though you have to try to run away or de escalate the situation.. But the problem with that is.. how are you to de escalate someone wanting to physically hurt or kill you.. in those situations you may only have seconds to react.. which is why i like the laws in Virginia.. shoot first ask questions later. Now in Virginia IF YOU started the argument. Or joined it from someone else.. and you had your gun on you.. then you can get in trouble because the one with a deadly weapon on you starting or joining in ob a argument. In ny opiniin there are just way too many laws in this country.. and states to know all of them.

Me personally I would love to see private business owners or managers charged with negligent homicide if a gun was brought into their business and a person or people were murdered. While the business had a gun free zone sign posted. With rights comes responsibilities. If you choose to exercise your right to have your business a gun free zone. Then you have the responsibilities to ensure that a gun will not make it pass the entrance. Having armed security along with metal detectors at entrances. You are not required by law to have this level of security when posting. However if you neglect to do so and a shooting accrues inside your business. You are responsible for their death as being negligent. It is not murder but rather manslaughter. I think you will see less businesses post crap like no guns allowed.

I agree. Those signs basically amount to "Easy target here" markers for the criminals. If a business wants to put those up they should be liable for any damage or injury caused due to them creating a risky environment and not taking prudent precautions, aka armed security to look after the now disarmed public.

Merendel idk it's hard to agree with that IMO only because that's kinda like placing it towards the narrative that a gun killed somebody and it reinforces in a false-positive type of way of people that say the gun killed ______. You've heard the famous "guns don't kill people I kill people" which is kinda why I wouldn't agree with the business being held responsible cuz it focuses the root of the crime being because of a gun instead of focusing it on the actions of an individual

+John y Well a business is held liable if a person is injured in their store for faulty shelving as an example. The shelf is not what caused the injury but rather the business failure to fix the shelf. It has to do with responsibility. If a business forces me to be unarmed. Now my safety is the responsibility of the business owner and or manager.

Here in Oklahoma we passed a law a few years ago to protect us carriers from getting charged with trespassing if we carried past a sign. Now the signs really don’t mean squat. If I am caught carrying past a sign the business can ask me to leave and if I refuse and they call the police I will be asked to leave and if I refuse the most that can happen is I could get a $200 ticket. I carry past every single sign I see unless it’s the places I can’t like the court house and such. So glad we passed this law. Now we are still covered under the self defense act if we carry past a sign and shoot someone lawfully. And we have all the castle doctrine here as well as our stand your ground law. The people that put up no guns signs are just fools. Thankfully we at least have one business in the town I live that is a pharmacy and he has a please carry sign!! I guarantee his place will never be robbed!

Becca Zam Nope, I can say with absolute certainty that I will NEVER feel different about this particular issue. Criminals don't follow laws and therefore if one decides to try and kill myself or a family member, I absolutely will do everything within my power to prevent it. itscork Well you won't be doing your family any good when your sitting in jail. Or are stripped of your rights. For violating the law, and treading on the rights of others. I live in a state were those signs don't cary the weight of law, as they do in Ohio, and some other states. But you still have to leave if asked to. Or face criminal trespass charges. To me it isn't worth the risks. So I avoid businesses that put up these signs. I feel if they don't trust their law abiding customers, and respect their right to feel secure. That business doesn't deserve my dollars. Reading some of your opinions, and the way they are expressed. Makes me wonder if you're in the 1% of legal gun owners who carry regularly. The 1% that ends up with a crimal felony conviction for a firearm related offence. In the end, what you chose to do is your choice. I don't need to judge you. As I said. I expect one day a real judge will be doing that.

Yea, i had a punk one time start a argument with me, and before i knew he started charging walking quickly with a knife in his hand concealing it with his fingers.. it was a small pocket knife but still a knife. The moment i put my hand in my pockets to reach for my phone he stopped and backed off, he thought i was pulling a gun out. I didnt own any guns then, but i do now. And just the simple motion of me reaching made him stop.. imagine if i actually had a gun.. I wouldnt even have to pull it out.. just reaching makes people think.. Im in northern VA btw, and in virginia stores have to have a sign saying no guns allowed.. If they dont then you can walk in there open carry or conceal carry, it doesnt matter, state law even states that store policy means nothing if there is no sign. ONLY time you have to remove the gun from the premesis is if a manager asks.. otherwise they cant do anything if there is no sign

Krytern UK - Despite your disdain for American lives and the cursing apparently intended to underscore that disdain, let me point out that people in danger from threats shown to be likely have died with a Temporary Restraining Order (TRO) clutched to their bosom. This while waiting for written permission to purchase a firearm lawfully, after which, of course, they would have had to wait for arbitrary permission to carry a sidearm, if that permission would ever have been given. The "slight delay" you scorn as if irrelevant has cost the lives of law-abiding Americans. But then you might say, "It's only Americans. Who cares?" Good point, as you obviously don't. You probably aren't even grateful for the intervention of NRA members who donated their personally owned firearms, that your armed forces might have *some* weapons to stave off Nazi invasion following y'all's disaster at Dunkirk (American spelling of the French locale). Chances are, you wouldn't be writing in English here were it not for the unselfishness of American firearms owners, yet you would disarm those very same people who, but for the 2d Amendment to our Constitution of the United States of America, wouldn't have had the weapons to give y'all so altruistically. Every state is different. In Tennessee you can carry in a private business with a no gun sign. If they see you have a gun and ask you to leave, if you don't then you will get a trespass charge. That's it. However, if you do not carry in a private business with a no carry sign, and you are injured and a gun could have prevented that... the business can be held liable for your injuries.

Colorado is: "If asked to leave and you don't -> trespass", NOT a firearms offense. I would love to see someone sue a CPZ business for damages if you do decide to disarm and something happens. There's no law here either way.

2nd Amendment says that KFC and Taco Bell can't tell me I can't have a concealed weapon in their store. That's ridiculous. When I have a concealed carry permit, I should be able to carry anywhere, at any time in the state that I have that license.

No the 2nd doesn't. It says the government can't infringe, it doesn't say anything about a private individual. It's the "My house my rules" statute you hear thrown around with social media. The government can't say you can't carry in KFC, however the owner of KFC can, and the government will enforce that, the same way you would enforce someone entering your home with gun who you didn't want to be there. It's private property that you are aloud to enter under specific rules, if you break those rules you are now trespassing. Same as free speech. The government can arrest you for saying fuck my boss, but that doesn't mean your boss can't fire you. The bill of rights are rights that THE GOVERNMENT can't infringe upon, not private individuals.

Walter Strong. That's Why I love Texas. Only signs that matter are 30.06, 30.07, and 51%. All other signs (so far) are just suggestions.

Spushed Texas law is very specific about the wording and sizes of no go allowed signs. If a posted sign is not as large as the law specifies and is not worded exactly right then it is not legally enforceable.

where i live, Alabama, the AG said last year that "no guns allowed" signs must be taken down as they are in violation of the 2nd amendment of the US Constitution and Article 1, Section 26, of the State of Alabama Constitution.

Why is that a County Clerk gets lambasted and jailed for refusing to sign gay marriage licenses, for religious reasons; but Sheriffs can refuse to process concealed carry requests and NFA letters, for personal or political reasons?

William Robinson while normally I'm all for following laws. But one could morally argue that not all laws have good intentions and they do change constantly. Slavery and discrimination were laws. Does that mean they were morally correct? I think not. Heck even in the army i have a duty to disobey certain orders if they are deemed wrong. Even though you swear to follow all orders of those appointed above you. It's a predicament i guess. Best course of action would be to try and get the law changed

Because it's their property. They don't have to let you on their property in the first place. "My roof, my rules". Should a church be forced to allow free speech and let anyone off the street speak to the congregation on Sunday morning? Now, as far as local governments go, you are absolutely right. But private citizens can do whatever they want with their own property.

I noticed a sign in the entrance of a business in Ohio yesterday that represents a major policy change here. It stated (and I paraphrase) that persons may not carry in the business unless authorized by Ohio Revised Code. Ohio's concealed carry laws are part of the Ohio Revised Code (ORC), so am I correct in the belief that this allows me, as a licensed concealed carrier, to carry and the only restriction applies to people carrying a firearm illegally, without a license. If so, this is a refreshing change to not criminalize legal gunowners. Kudos to the Ohio legislators who have seen the light and "Thank you!"

My question is, if I walk into a store with my concealed weapon and for example an active shooter situation comes up, and I have to use my weapon. Will I be criminally charged for saving the lives of others?

Depends. In California for example ignoring the sign is not a criminal offense if you can legally carry otherwise(now getting the permit in Cali is kind of hard). Same here in Missouri. Some more strict states like Ohio and Texas this is not the case.

I know many disagree with me and judging from your comment about private property I'm guessing you do too...but my opinion is that any gun free zone is unconstitutional and should not exist, including any private property that is open to the public for business. If it's your private property and you don't want me bringing my gun over for dinner that's fine...that's your prerogative and right, but if you are a business open to the public you should not be able to strip me of my 2nd amendment right and discriminate against me forcing me to have to choose between disarming and patronizing you or finding another business to meet my needs. I'm not asking you to invest yourself in my event or bake my special cake or decorate or do the flowers for my wedding. If you are open to the public you need to respect a constitutional right like this one. Just like you couldn't say you won't allow blacks or handicapped into your place of business and you're required to make certain accommodations for handicap access, it's not exclusively your private property to do as you wish. There are certain expectations and requirements to be open to the public for business. One of those should certainly be respecting peoples 2nd amendment rights.

You need to read the Founders thoughts on how sacrosanct private property is. As much as I hate the practice and disagree with it...government has absolutely no legal right to force anyone who owns a private business to allow gun carriers into their business. If they can...then it is no longer private property and we only own it at the behest of the government. Remember the sign..."We reserve the right to refuse service to anyone." Liberty is not supposed to make us comfortable, you don't like it...take your business elsewhere or set up your own shop. How can we expect people to respect our right to bear arms if we refuse to accept their right to conduct business with whom they choose? And I am sorry...that means everyone. The free market will determine who stays in business and who dies on the vine. The idiot country singer Toby Keith had a restaurant in Virginia and had signs posted...no guns allowed. The gun owners raised so much hell and cut his business to nothing...I understand the restaurant relented and lifted the gun ban. After that...I would still never go back. His business deserved to die but by using the free market...not government intervention which is the last thing we need. Gun laws are an example of this...right? Our dollars are way more powerful than idiotic laws.

I'm all for limiting government meddling in people's businesses. But when it comes to an inalienable, constitutional right a business open to the public should not be able to infringe on that right in any way. If you hire non-family and/or are open to the public I would think there should be the expectation that you respect and honor that right, period. The "right to refuse service to anyone" is not in the context of inalienable rights. No shoes, no shirt, no service is not infringing on any right. When you open your doors to the public there are certain expectations and requirements. For example, providing adequate accessibility to all persons, including handicapped. Your private business is not allowed to ignore or sidestep that. It certainly should not be able to ignore the 2nd amendment. If your buddy and his wife, or your Uncle Bernie don't want you bringing your gun into their home when you come over for dinner that's their prerogative... that truely is their private property and you are a guest. As a customer of a business I am free to boycot them and take my business elsewhere, but I should not be forced to do that, to have to make the choice to go elsewhere, or deal with the inconvenience of finding another similar business. Free market system or not, when it's a constitutional right a customer should not be forced to go elsewhere. To me, baking a cake, or creating specific decorations or flower arrangements, or hosting an event at your venue, is a much more personal investment and involvement than just having someone come into your store and buy something off the shelf or browse. You should be free to decline something that takes active, personal investment of yourself and your emotional energy and creativity. You wouldn't and couldn't force an artist or sculptor to paint or sculpt something they did not want to invest themselves in. A very different issue than banning a customer from your store because of their race or color or sexual preference, or their choice to carry.

Gerry, I think you're wrong. I think a private business on private property should be able to restrict their clients on any categories they wish. If they don't want guns in their store, that's their business. You are squarely in the "I'll force you to bake my cake range". Just take your business elsewhere.

Walking into your store with my gun on is very different than demanding that you bake a cake for me...or demanding that you sculpt me in the nude or do a painting of my wife, or videotape our orgy...if you were a baker, or a sculptor, or a painter, or a videographer. Asking someone to invest themselves into something is very different than walking in to their store to buy something. Excluding a cc from coming into your store is more comparable to saying a gay can't come in, or a black or a jew.

the posting below shows the ignorance of people and the 2nd amendment. it does not give you the right to carry a gun onto private property when it is posted. the person who owns the property has the right to tell another person that if they wish to enter the property then they cannot have a firearm. I am very pro gun and for concealed carry. But to qoute the 2nd amendment in every gun converstation is not necessary. maybe these gun lawyers should present what the 2nd amendment really gives a citizen the right to and when it is not relavent.

K Nelson private property is private property. public property would be a state or federally owned piece of property. You know like parks, streets , us forestry land. matthew conway where I grew up every body carried everywhere but when entering private property (not the street ,your truck or your own land) it was required to clearly state "I'm armed " and if requested u give up your gun , leave it in the truck , etc But god help somebody who snuck a gun into a house ,shop etc without permission , best way I ever saw to get both barrels or be banned for life from all homes& business in town

I work in a place with a bank and it was robbed by a guy who just walked in and said "Give me the money in your drawer." He then calmly walked out as they called the cops. No one was hurt but apparently its just that easy! If he is never caught then he just walked away with free money. If I was there I would have pulled my g19 on him and said "If you move I will shoot. Every pull out your phones and record this. I want the cops to know I told him exactly what I was going to do if he moved." If he moves before the cops get there? No more criminal. If he doesn't? Then he goes to jail. Hopefully he thinks about life and becomes a member of this capitalist system with democracy on the side.

Going to a neighboring County to submit your applications is a good idea in a number of circumstances. Cuyahoga stated a 6 month wait just to submit the application, and another 6-9 months to process it and issue the CHL. Called the Geauga Sheriff's Office and was told I could submit on any day they're accepting applications. Went on a Monday, I think it was. And got called two days later to come pick up my license. Awesome turn around time in the more rural, gun friendly Counties!

I struggled with the decision to carry or not in businesses which have “No Gun” signs for a while after getting my CCL. It only took one look at my wife and thinking of what I would feel of something were to happen to her or anyone I love because I listened to a sign over what common sense told me for me to make my decision.

I live in AZ and you will never know if I have my weapon on me (which I always do) until some gets stupid and then everyone will be glad there is a responsible well trained CCW owner in the place. I will handle a misdemeanor charge everyday all day to protect myself and others in a "CPZ" !!

A couple of years back my wife and I visited the R&R Hall of Fame in Cleveland, our hotel was right downtown and within walking distance of the venue and restaurants.. I was not about to be walking around Cleveland unprotected (Ohio is a reciprocal state to my Michigan CPL) so I carried my firearm with me everywhere we went.. It was only as we were leaving the hall of fame that I noticed the "no carry" sign clearly posted by the EXIT DOORS not the ENTRANCE DOORS.. I take great care to make sure my concealed weapon is exactly that, concealed, even if I had seen the sign before entering I still would have made the choice to carry into the business, the safety of my wife and myself was more important to me than that sign....

Just an FYI for Florida. We don't have strict liability laws on posted signs. However if you are asked to leave because you have been detected carrying a firearm, regardless if a sign is posted or not, you must leave immediately or you could be facing an armed trespass charge which is a felony.

Here in Florida a no gun sign has no power of law, however if an employee ask you to leave because you have a gun and you refuse you can then be charged with trespassing. If you properly conceal though this will never be a problem.

here in Texas the sign has to be VERY specific as to how it is written, "no guns" is not a legal sign. it must have the 30.06 vocabulary. then again, id rather go home alive with a criminal charge than in a body bag "legally"

I sure wish we had a down to earth law firm like your two here in northern Michigan. If I ever run into these gun phobia businesses, I leave immediately n tell everyone I know who not to shop with. I guarantee you business owners out there, that if you post a sign, you've already lost thousands of dollars of lost business.

This is key...... The store owner must see your firearm. If you carry in and he says, "hey you got a gun?" Just walk out. 1. Conceal better from now on. 2. If the cops come. Get a lawyer, go to jury trial and make the store owner describe your firearm and prove it was a gun he saw.

Good video I'm in Ohio temporarily so this vid is interesting. So glad my home is in Florida. No gun signs have no legal standing on their own. If discovered, all they can do is ask you to leave. If you leave quietly, no harm, no foul. If you put up a fuss, you can be charged with tresspass...

In MN it's different - it has to be conspicuously posted, but if you carry into a private establishment where it's posted, it isn't a crime, but if the establishment's agent asks you to leave, you must leave or you can be charged with a misdemeanor. If you can show you have a permit to carry at the time you're asked to leave, charge will be dropped and this cannot be used to confiscate your permit to carry or your weapon. There are some exceptions: you MAY NOT carry into government buildings including Post Office and Federal, State or local government buildings; and you may not carry into schools -- unless you have something in writing from the principal saying you may carry in the school.

This is why I like living in the state I do. In my state, NO GUN signs aren't worth the paper they're printed on, however, if the property owner notices that you are carrying a firearm, they're completely free the tell you to either leave your gun in your vehicle or leave the property immediately with threat of being charged with trespassing if you refuse to comply. i personally think it should be like that everywhere because it doesn't infringe on your right to carry but still leaves the power to decide who is allowed on the property in a case-by-case scenario to the owner.

I spoke with a Judge here in Sheridan , WY about this very subject and he told me that if you didn't see the sign and you walked into a business with a no-firearms sign , all they could do at that point is ask you to leave ( it is not an arrestable offense ) , that you weren't in violation of the law . If they asked you to leave and you didn't , then you were in violation and could face charges .

If you live in OH and want your CHP same day, go to Stark county. I drove there (because my county has a 1-3 week process time) waited an hour in line, talked to a lady for 10 minutes and they printed me one on the spot. Im sure there are a lot of other counties that do that, but I and a few of my co-workers have had great experiences with them.

In Ohio, a law was passed in 2017 that states that permit holders could be forced to leave a gun-free zone under the law, however, they would not be committing a crime simply by entering the premise while armed. However, if you refuse to leave they can be charged a misdemeanor punishable by 30 days in prison and $250 fine. Ohio House Bill 233 passed on 7/6/17

I live in Fort Worth and a local Liquor and Beer store was bought out and changed management. They posted the 30.06 sign on the front door and let's just say it didn't work out for them. You could drive by that store on a Saturday night and there would be two cars in the parking lot. That sign didn't last a month.

I'm in St Louis but thanks for the info and I do go into businesses with my weapon on but I carry a 380 and no one would know it not unless I said something or my shirt came up which it won't because it's big enough to cover the weapon

Wow Michael and Derek great timing. I have been pondering the Idea of trying to get a bill introduced here in Colorado. I want to standardize the sign and sign placement for buildings that do not allow firearms. If the goal is to keep firearms out, then let's make ONE sign that must be within X distance of every entrance (including service entrances) There are only a few in the town where I live, but having to stop and read 35 signs on the doors & windows of a store is getting old. I would like to hear your thoughts on the down side of my Idea. One I can think of is stirring the pot, if the bill gets media attention will the other side make a push to get the signs up in MORE places. Thought?

Great information I just ran across this and I happen to live in Ohio. My question is. My ccw license expired on January so I've been carry open...would I be breaking the law if I were to carry concealed? I am going to renew in a couple of weeks

in arizona they have to have an state issued sign, they also must provide you with a place to store your firearm.

I remember hearing about something changing this law of carrying in a business with a no gun sign this year. Is it still the same or has it changed in 2017 or have they been working on it in Ohio.

Your Video reminded me of an Incident of my forgetfulness. I carry daily since I received my CDW. Running errands one day I walked into my local bank not realizing that I was carrying concealed. Once in the bank, I realized that I forgot to leave my Pistol in the Car as I usually do. Then, I started wondering if they had metal detectors and if the silent alarm had gone off in my honor! Or, if the bank was robbed just then, would the robbers take my gun or shoot me thinking I was private bank security, on an on. I easily completed my teller transaction and walked out. I would have guessed that All Banks would have Prohibited the use of Firearms. Your thoughts on Carrying in your local bank as a Citizen? Thumbs Way Up, New Subscriber!
