My personal opinion on the CPZ signs is this : if I’m CCW right, no one will know. I’ll deal with the legal aftermath after I’ve stopped an imminent threat and my family safe. If there is not metal detector or pat down/ security checkpoint, you can bet I’m carrying. There is no such thing as a gun free zone if I’m there.

WAkE UP Gun PEOPLE! They want you to violate the signs and any other law so they can legally take all of your Guns! WE HAVE BEEN AT WAR SINCE THE BRADY BILL WHEN REGAN WAS SHOT! I am a Veteran and the only time I do not carry is when I go to the VA. I have come to my truck after appointments to find my truck unlocked and my console gone through several times! My console was locked when I got out of my truck to go to my appointment and it was unlocked when I got back into my truck. To call someone a slave because they refuse to risk everything they own and to risk not being able to legally protect your family for the rest of your life as well as yourself to me is very smart! They want us to break the laws so they can put us under the Jail! Once your in jail and every weapon you own has been removed from your home how can and will your wife protect herself and your children? What happens to her and your children when the crooks your in jail with tell their family and friends about you and that your family is not able to protect themselves? How do you live with what happened to them while you was in jail? You will have your hands full as it is trying to protect yourself! What happens when you do get home and several armed men walk in on you? Do you say welcome! Take what ever you want, oh yeah my wife is in the bedroom! What if you have a young girl? Do you offer her to them too? Whet about if you have a son? None of our children are safe being harmed now! Oh No I am Billy Jack! I can defend my family no matter what threat comes at me or comes through my door! WRONG! What do you do when your threatened by someone knocks on the side of your home at 2:30 AM while your walking to the door to let your cat inside? KNOCK KNOCK YOUR DEAD!!!??? What about when your just over one hour away from home and your alarm goes off? The alarm company tells you and the cops that your cat(s) set it off, there is no threat! You have had this same alarm for over two years and the new home set up is four months old. The cats have never tripped the motion detector! Nope the cats made the motion for just over one minute! When you get home the cops refuse to come clear your home? There was no threat, they didn’t even come check on your home! Then you wake up the next morning to your wife yelling about why is there mulch on her clean dining room floor! Then you go look and you find the mulch is not only in the floor but also inside the two window seals and then you see the two frames of the screens have been bent! LOOK AT THE HOME PAGE! “No Content!” They have shut down and are erasing everything they do not want us to hear and breaking the connections of those that think and feel the same way! Break the connections and make it so you can not talk to anyone else that feels the same as you! Make it so the only news we get is the what they tell us! Like it was before the internet! Hide the Corruption and TRUTH!

If I get confronted about carrying in a "gun free zone", I just ask the manager, supervisor, etc, "Do you honestly believe that a sign will stop a criminal from shooting this place up? If it happens when I'm here, my gun will stop them from causing numerous casualties. Do you guarantee my safety otherwise? If not, you open yourself up to a lawsuit, for failing to "protect" me." This usually results in the sign going away, with a quickness! MOLON LABE!

I ask myself that very question every time I walk into a Whole Foods market to use their Amazon Returns booth. That's the only reason I even walk into that place--I refuse to give them dollar one because of their "30.05" and "30.06" signs (I live in Texas) signs that prohibit guns in the store. If someone were to come in and shoot that place up while I was in there unarmed you can bet I'd be first in line to sue them.

Here in Arizona we had someone sue a restaurant last year for improperly displaying the sign, then calling the cops on the guy when they saw his gun. They had it on the host podium and the guys lawyer successfully argued that the owner “manufactured an environment in which my client couldn’t know he was breaking a law until he’d already done it” and then added punitive damages for his detention. Lemme see if I can dig up the case... I think the guys name was Sanchez- the defendant.

In my state "No Gun" signs do not carry 'weight-of-law.' Except in a few places (like courthouses) that are specified in legislation, anyone found carrying in a posted area must leave peacefully when/if asked by the property owner/manager to do so... or face trespassing charges [NOT gun-related charges, unless other factors (like brandishing, for instance) are involved].

I was told by a lawyer that it implies a company policy, not law. Just like no shirt, no shoes, no service. If they see you carrying a firearm and ask you to leave and you refuse, that is when you’ve broken the law and not just a company policy. Of course I mean for private establishments, not the obvious no carry zones like hospitals, government buildings etc..

Ask the manager if he expects a police officer to obey the sign and walk his means of defense back to his vehicle and lock it up, then return to the store. If he responds in the negative, then ask him why he believes the officer should have a better chance of surviving than you should have.

Check with your state laws. For example, here in AZ, the following criteria must be met: 4-229. Licenses; Handguns; Posting of Notice. A. A person with a permit issued pursuant to section 13-3112 may carry a concealed handgun on the premises of a licensee who is an on-sale retailer unless the licensee posts a sign that clearly prohibits the possession of weapons on the licensed premises. The sign shall conform to the following requirements: 1. Be posted in a conspicuous location accessible to the general public and immediately adjacent to the liquor license posted on the licensed premises. 2. Contain a pictogram that shows a firearm within a red circle and a diagonal red line across the firearm. 3. Contain the words, "no firearms allowed pursuant to A.R.S. section 4-229".

@@MrDeviousdom to the best of my understanding, those signs that say ARS 4-229 only apply to establishments that serve alcohol. Looking into statute 4-229, it appears to be backed up by subsection D, explaining that the department of liquor licenses and control will provide them to licensees at no cost. Correct me if I'm wrong. Also, the sign only applies if it's posted on a white background and is the correct minimum dimensions, meaning one with a clear background on an entrance door glass is not applicable.

It depends on your state. Some states all they can do is ask you to leave. If you leave peacefully, there’s no issue. If you resist, they can call the cops and you can get in trouble. In other states, just being caught carrying in a gun free zone can be enough to face fines and penalties.

My weopean became exposed and they tried to eject me from the facility as we were leaving a cop just happened by seen me be escorted by security and stopped to investigate. Cop informed them their sign was not proper and I was well with in my right to be there. The cop educated on what they needed to do to up hold that policy. They still haven't put up signs.

If they see it and just call the PD. The PD will ask if they asked you to leave, and if you say no, they will do nothing?? So it looks like rules vary by state. Comments??

I hate to be this person, but in Indiana those signs hold no value whatsoever. No legal action can be taken. I do believe, the most that can happen is this. They ask you to leave and inform you about the sign, you informed them that holds no value, they call the police and went you trespassed. If you then return after being trespassed you get arrested. Although I usually do obey those signs, there's absolutely nothing to do in my town. The mall is the only thing to do, and it's full of teenagers and criminals and I feel more comfortable carrying

@jeffgiacomel792

@dragonson72 First of all, it is Concealed Carry. Secondly your statement is flat asking for trouble... unless you set up a Private, Membership Only Establishment. Just like the Christian Baker who was targeted to bake a Cake for a Gay Wedding... As to the CCW Issue, the Lead Attorney of the Texas State Rifle Association, that got CCW through, sent Correspondence to the owners who refused CCW, even though the weapons were Concealed, essentially saying that the Business in denying CCW and the Rules of the State on CCW, was taking the Safety and Protection of the Customers upon themselves. He also developed a list and informed those Business owners of such. The signs came down in the majority of businesses. So, if your business is open to anyone in the Public and you are denying the State intention of CCW then the is responsible. You don't suppose all the mass random shootings now seem to take place at facilities with "No Firearms" Signs on them since you? Like.... Schools, Bases, Hospitals, Churches... it's probably just coincidence. Why don't you pick another reason, another Constitutionally Guaranteed Right to use to exclude someone.... how about something listed in the First Amendment?

You would be surprised how many businesses are willing to take their no gun signs down if they realize the signs are costing them money. Over the last few years I've approached seven businesses about removing their signs. Five businesses took their signs down, one business went out of business And the seventh business still has the sign up. If the business is mandated by law to have the sign there's not much you can do other than to try and legislatively make a change. But as far as businesses where the owner has chosen to put up the sign You should make it your job to approach them and let them know. I simply walk in and asked to speak to the owner and the manager I give them a card explaining my position. I thank them for their time and I leave. If at some point the sign comes down I start doing business with them and make it a point to personally thank them for removing the sign.

I had a different impression of those sighs. Maybe it differs by state. I thought that if there was a No Guns Allowed sign that it’s was not a crime to enter with a CCW, it’s hidden anyway and nobody should see it. If it is spotted, they can ask you to leave and if you don’t, then you are trespassing and breaking a law. I know some casinos in NV have signs, never look for them, but have always carried there. This is why I can't understand about getting a CCW and or CHL. You are limited where to go and you are only allowed to defend yourself when you are outside of a place, in an open place, or inside of your car. I should be allowed to walk in a supermarket or pharmacy with my concealed gun. If I know I will go to a supermarket and then CVS, I would not take my gun at all and leave it in the house to avoid issues. Thanks for your videos!

Just Go North! Without a CHL in Ohio, I can’t drive with the gun loaded and accessible, the ammo has to be separate. When carrying it has to be open carry, if anything covers the gun then I could be arrested, if I open carry into a place like Walmart and somebody calls the police and tell them I’m about to shoot it up, again I’m probably going to have 15 officers with guns pointed at me yelling “PUT THE GUN DOWN” that is why we want CHL’s because it gives you more rights with it than with not.

How about this scenario? The Mall entrances directly to the outside parking are clearly marked. The anchor stores, Sears, Pennies, Khols etc. are not marked. When you go from an anchor store into the Mall interior there is a long list of rules. Rule 16 is no gun. Is there any way that would be considered conspicuous? I have to feel the Mall is being sloppy on purpose. When I got my CCW permit in Ohio the Police Officer that did my certification course told me enter the Mall through an anchor store and no police will arrest you unless some kind of major scene unfolds, but if asked to leave by the Mall, leave.

In Missouri, it has to fit these criteria: "one or more signs displayed in a conspicuous place of a minimum size of eleven inches by fourteen inches with the writing thereon in letters of not less than one inch". I'm not a lawyer, but to me this would exclude nearly all of the signs used by businesses. The signs are always too small to be legal, sometimes the lettering is too small to be legal, and sometimes there's not even a sign. Sometimes businesses just stick letters on the glass. This is not conspicuous and it certainly doesn't meet the standard of "one or more signs... with the writing thereon...."

I was at a Meijer in Ohio, they had a blue sign with the pic of a gun with the line across. I asked a manager about it he said its for no open carry. Is their a difference?

In Michigan the Meijer stores had them too. A Meijer family member was a GOP congressman. During last year's primary this was brought up and his campaign and the Meijer chain got a lot of negative feedback. By sumner the signs were changed to no open Carry. My guess is Meijer did not want any more so the signs were changed

Are theyb all punishable offenses, no excuse I understand Government establishments and post offices are very strict, but what do these multiple different signs really mean?

@@superacer1 exactly. From my gathering, even with our constitutional carry, private (even if it's technically public place) supercedes our law. And ultimately what they will do is ask you to leave. If you immediately don't they can get you for 3rd degree misdemeanor trespassing.

In life in CT and the constitution, article 15 states “Every citizen has a right to bear arms in defense of himself and the state.” The state of CT also has a No Guns sign law. My question is dose this law violate my rights under the State Constitution? I completely understand your response is just a personal opinion.

What if there is a sign conspicuously located, but only with writing, no "gun busters" image/graphic? In other words, it's just a sticker with text on it saying something to the effect of, "firearms are not permitted in this building."

I am not a lawyer but, my understanding is it still bars you. The gun buster sign as it's called, is just the recommended sample of typical signs available in packages for business owners to place a their entrances. My understanding is they come in a package along with the no smoking, no shirts-no service signs etc. It's up to the business which signs they post and some businesses just post them all with no thought about it.

That's why I love Indiana. Those signs don't carry the weight of the law. You can carry anywhere a no gun sign is posted except for schools (gun can be left inside your locked vehicle and not in plain sight on school property though) no state buildings like courthouses etc, and the state fair among others. If you cc in any store or business and they find out it's not a crime of any kind. All they can do is ask you to leave. Which you should do immediately lol. Because if you don't leave when they ask them you can be charged with trespassing.

Does Black's or some other case law define conspicuous?
@blankblank1813
@blankblank1813 4 жыл бұрын
Why don't law makers address the definition of conspicuous? Seems like that could save us all a lot of churn. Also, if a mom&pop store posts a "CPZ sign" (great phrase!), is the shopkeeper or cashier permitted to have a gun behind the counter? Yes, it's his/her store but the verbiage on the sign says "authorized" which is taken to mean only LEOs. If the owner isn't an officer, is he breaking the law? Lastly, if I am in a business that has a No Gun sign and I am injured or killed by a criminal, is the owner responsible for failing to adequately protect me? I would think he would at least be culpable for negligence to provide a safe environment.
