The fact that the defendant claims his son and friend did a great job, is NOT the right answer, as he is now advertising that his employees do a bad job but he thinks it's great, he should have just admitted that his son and friend did a lousy job and that they are no longer employed by him...

He could be billing for $100 an hour but he can pay his son or other employees $25 an hour & he can keep the rest. He could have wages of $50 for two workers for one hour. The other $50 is his for taxes, insurance or something like that.

If at 20 you can do a good professional job, you should get paid whatever someone is willing to pay. There's 50 year old novices and 20 year old professionals. It's always about skill so why people think you can low-ball young people is beyond me. It speaks to lack of class

When I was a kid my father built houses. He did it all and it was quality. Now it's quantity. So many fly by nights ripping people off for no work or crappy work.

Yes , now a days it’s so difficult to find good help they’re there for the money and wanna run I think this should be applied in schools more Not easy A class .. no actual teachers teaching kids to work on and value their work things like tire changes oil changes repairs of small furniture hang up a mirror little things that in life come in handy and this would spark interest in children to take on this kind of work and take pride of it. Along with teaching how to fill out taxes. Real life teachings for real life needs

And spent days cleaning up that sheetrock dust. It's like its alive and not fun to clean up. Not to mention having to go through it a second time but at least the second guy knew what he was doing. I don't think Marilyn gave that woman enough money back. She screwed the pooch.

too many contractors out there just drop people off to do the work and they dont do any work themselves . the plaintiff asked the defendant from the beginning if he did the work himself and he lied and said yes . so he breached the contract from day one and she should not have to pay him anything because the bad work they did caused the area to need a second demolition .

When I get a quote from a professional on something, my first question is always, "Do YOU do the work, or do you subcontract?" and then I'm able to make a decision. The Plaintiff hired him- not two 20 year olds who had no clue what they're doing.

We've seen many of these cases and what I don't understand is if you see them doing a bad job on Day 1, why would you not say anything? I had that issue with a painter and I had to stop the job on Day 1 and point out how sh!tty of a job they were doing.

unfortunately this type of situation is more common than rare because most contractors do not do any work themselves and they just drop other people off to do the actual work .

1st contractor is a hack. Sending in a 20 year old to do a job that takes years of knowledge and practice is a waste of time and parts.

The question at the end when the fan had asked what he should do about the kids running on his lawn.... I think judge John was hinting to the guy either get a big dog and don't pick up after it unlike a little kids run freely in your yard until they step in it!!....OR.....get an electric fence put around his yard!! If you think about it, that would definitely keep them little brats out of that man's yard for good!! LOL 😂

Kind of crappy advice at the end when the 2 judges are discussing. Not everyone has money to build offense but putting up a no trespassing sign and enter at your own risk would cover the liability.

They did a shite job. The old man had kids doing men's work. They're going to need a hell of a lot more training to do expert tile work. Not just anyone can come in and do a job that some men have perfected in 20 or more years. Not everyone can draw a straight line, we are all so different.

nah she listens while he's talking. he was at the end of his sentence when she kind of cut him off, but she acknowledged what he was saying. she has a lot of respect for her husband, and even with her attitude that she shows, she wouldn't do anything to disrespect him

This is why it is oh so important to find the right people to do a home improvement project no matter if it's inside or outside work. But this defendant did a horrible job then on top of that ghosted her which was the wrong thing to do and made matters worse. Plantiff deserved a full refund as I saw it. $600 refund was a joke

The wet tile cement was a giveaway .He should of been payed for the demo work that's dirty dusty hard work and you have to cop some dust it's a easy clean.The outside walkway was a rort this lady knows all the scams I hope his son learns from this its a cheap lesson for a young fella👍👍

So if the mortar according to the witness was as wet as the day it was laid, why didn't they just lift them up, clean the mortar off and relay them instead of demolishing.

They DID lift the tile up and removed the wet mortar but that is considered demolishing because it had to be redone. Some of the tiles were cut with a dull tile saw so they had to be replaced which cost more money.

13:30 This is where the Judge bullshit comes into play! It was a written contract and if the plaintiff did not acknowledge it, then it's void! The plaintiff not responding to the texts doesn't make it a contract. PayPal was correct to refund her the money. The texts between them showed communication between the parties about a contract and in Paypal's eyes it could've been discussed in person or over the phone! JM lives in a fantasy world that I would love to visit!

The text asking for an amount, him giving the amount, and her paying him the amount (or a deposit based off of the amount) stated in the text then they had a written contract via text. JM and other TV judges have also explained many times that not acknowledging a text when someone claims you owe them money or a certain amount is legally saying “I owe you this amount of money.” That’s why if someone text something respond with text, or if you called them right after, reaffirmed everything said in the conversation through text. For example: “So just to confirm everything we talked about over the phone concerning the $500 you thought I owed you. I actually owe you $300, which I’m able to make biweekly $50 payments until it’s paid off. If I miss one payment without notifying you before hand, you have the right to demand the full one time payment of the remaining balance within the next two weeks.”

@34stzoo While you stated a time stamp for reference, did you quit listening right after? Judge Milian may have said first that she didn't think that PayPal should have refunded the money. But she said so based on Paypal's assertion that there was no written contract. In her opinion, there WAS a valid contract because the Plaintiff did not object to the price he sent her through text, and then went on to pay him that rate. But it doesn't seem that you are taking into account where the Judge then goes on to tell the Defendant that he is not entitled to money for an unacceptable job, just minutes after your timestamp, and further evidenced by her denial of his counterclaim. Which is essentially your argument - that the Plaintiff should get the money back from PayPal. She DID get her money back from PayPal, and the Judge ruled as such by denying the Defendant's counterclaim. So what is your argument here, then, to disparage the Judge's decision? It came out the way you wanted.

Because she didn’t respond via texts she liable to paying him $1000.00. We had conversation via texts and we will call that person to clarify a particular subject. No, the Judge is wrong!

I want to say one thing to everyone here. When you own a company with other employees you don't have to be there. You can't be on more than one job installing at once. The owner of a company can't install every single job himself. That's why business owners hire people. I'm not done watching the case but people don't always consider this fact. They just make demands and don't realize that.

I do not agree with the Marilyn’s ruling here. I would have ruled in the plaintiffs favor, but not for that amount. She didn’t have to replace all the tiles, only a few that would have had poor cuts. The full tiles could clearly have be reused, given the witnesses testimony that the thin set was still wet so it could have and most likely was just scraped off the tiles. I would have awarded her $100, Seeing that she already received her money back, so she wasn’t out any money other than the cost to replace the tiles with the bad cuts.

In this case the defendant did a crappy job and ghosted her, costing the plaintiff money. I think the ruling was very fair. 99.9% of the time I guess the same award that JM gives. I understand her thinking.
