If I was banned from this one I would....and I wouldn't expect an LGBT themed baker to have to bake a cake for Westboro Church with a message on it they didn't agree with. The gay communities greatest strength has always been the gay dollar. Hell, the only reason the DNC ever pretended to support gay marriage before it polled over 50% was because gays raised a lot of money for them.

thats not the point, of course they could find another baker and of course it makes sense to do business with someone who actually appreciates your business. its about challenging our public accommodation laws. Does a baker's free expression claims allow him to deny service to someone based on their protected identity? The court did not answer that question, but agreed that Philips was treated unfairly.

My answer to your question would be YES. Especially when you're talking about custom goods. I wouldn't expect an LGBT cake store to have to make an ANti LGBT God Hates F**s cake for the Westboro Baptist Church nor would I want a Jewish Bakery to have to make a Nazi themed cake. And public accomodation laws went too far in the first place. I like people being able to self segregate and market amongst themselves. FYI i'm black and gay and I can tell you the gay community is making the same integration mistake the black community made. I'm sure you'll immediately disagree with me but implore you to think about it from the prospective of not what you think you can gain but what youre going lose if this presses further and you force yourself into everybody elses space

When a baker makes a cake that conveys a message, no reasonable observer thinks the cake’s message is the baker’s words, it’s clearly the message of the customer. If I get a “happy birthday” cake for my son, does everyone at the party think the baker is wishing my son a happy birthday? I simply don’t buy the compelled speech defense from the baker.

Sarah, if I read his comment correctly, whats considered "ok" to I no spel good is irrelevant because people should have the right to do business with whomever they want. Sure, morally it could be considered wrong to deny someone business for whatever reason, but it doesnt make it illegal, thats the idea of a "free market". The liberal notion of tolerance and acceptance of everyone works both ways. Diversity of thought is just as important as diversity of gender, skin color, age etc. I am not religious, I disagree with the cake maker decision, but I agree with the court ruling. Make sense?

As a Liberal, he has a right to freedom of religion, freedom of speech and freedom of expression. I couldn't believe this incident made National headlines. The gay couple should've gone elsewhere as I pretty sure many bakeries would've created a wedding cake for them. Instead they took the guy, his family and business to court. It should've been thrown out immediately. The gay couple, Jack's family and business all received unwanted attention, media coverage and threats from both sides. Its simple. If a business denies you for whatever reason, go somewhere else.

The issue is that both gays *and* Muslims are essentially 'protected classes' according to progressive and the Left. I think that the Left and Co hope that such a situation *never* occurs because it would show them for what they are... and they could never be able to justify their actions. The Muslim establishment would be homophobic for refusing to serve the gay couple, as the Islamic faith frowns on homosexuality... but at the same time, if they tried to do what they attempted to do here (ie force the baker to violate his religious beliefs), then they would be guilty of Islamaphobia. There is *literally* no way for them to justify their actions in such a scenario.

I think people wear their ethnicity and sexuality like a shirt just so they can find conflict of interest. Being gay should be a secondary priority behind being reasonable. The baker has every right to say they won’t do a specific item they do it all the time he didn’t out right say “I won’t serve you at all” he simply said he wouldn’t make a custom wedding cake which is actually quite common for bakerys to do especially if they have a large amount of orders.

Just as it's wrong for the state to tell 1 group of people they can't marry, it's also wrong to tell businesses or churches who they must serve. For those who don't know, the next totalitarian step had this decision went the other way would've been forcing churches to oversee gay weddings under threat of government punishment using the cake decision as a precident.

Notice they didn't go (through 3 states) to a Muslim Baker (and they would never do it). It's not a vital service that you are obligated by law to provide. I’m a Christian and I have a gay close friend. He knows that being gay is a sin and I told him about the gospel but he refuses not to be my close best friend because he tells me that every time when he’s with me he feels so comforted and feels the presence of God when he’s around me. His worst fear is losing me as a friend. It’s hard but I always pray for him and I hope God will save him. I love my gay friend so much. It hurts me to see him live in that lifestyle.

Jean You got it ALL WRONG! 1) The phrase "Freedom of Religion" in THIS particular case, refers to Jack Phillips's right not to be FORCED to become a FACILITATOR of an EVENT that is contrary to his religion. Jack is not imposing his views on anyone. In fact, he offered this couple other cakes in his store but they REFUSED service. 2) This is not about the "SELLING" aspect, or about "BAKING" something. As a previous business owner Kudos to the Supreme Court. We are free in America and if I as a business owner choose not to do business with any customer that is my right. As a customer if a business does not want to do business with me, I will take my business elsewhere. For instance you wearing addidas sneakers and tommy bahamas clothes walk into Norstrom or Gucci the sales people become reserved. Do you continue to shop or walk out and shop elsewhere? Freedom of religion needs to be protected as well. He wasn’t refusing to sell you anything or to service you at his shop, he was refusing to create art celebrating something that goes against his personal beliefs. This couple could have easily gone to another shop to get their cake they were just picking a fight for their LGBT agenda. They cry out about intolerance yet are not tolerant of others who disagree with them. I don’t care if someone disagrees with me and then sue them because of it that’s crazy. You can’t make people go against their beliefs. It would be like me asking to have my wedding at a mosque or a Jewish temple where they disagree with my beliefs and way of celebrating. Go ahead and get married just don’t make others submit to you and your beliefs.

yeah but "no shirt no shoes no service" has to do with the person's conduct in your establishment. denying service simply based on something immutable, ie. who the person is (ie. black, Christian) rather than what the person does is illegal discrimination.

Yes!! While I support LGBTQ rights I also support the rights of business owners to refuse service for whatever reason they want. This gay couple could easily have gone to another baker but instead decided to make a political stink and it blew up in their faces. This wasn't discrimination, it was a man standing up for HIS rights and freedoms. WELL DONE!

Can't they find another baker? What if he had said he was too busy? So they were attacking him for his faith yet they wanted to foist their indecent behavior, flaunt their queer and force him to bake them a cake. No!
