Just to be clear: An actor does not have the legal or professional responsibility to have any working knowledge of weapons handling, marksmanship, or gun safety and maintenance. Their job is to perform credibly with a prop gun. It isn’t your responsibility to check a prop gun if you are an actor - your job (again) is to take the prop gun from the assistant director, (who is the set manager), and rehearse and perform your acting part with it. The First A.D.’s union job is to clear the gun from the amorist when it’s checked into the safe on set, and clear check it again before handing it to the actor. Before those two checks, the armorist is responsible for being in possession of the prop gun, cleaning and maintaining it as well as safety checking that it is empty of blanks and personally delivering it to the safe cart on set and signing off with the First A.D. Alec Baldwin had every right and even a responsibility to rely on the paid professionals and managers to deliver a safe prop gun to him to perform with. If you don’t agree with this industry wide standard, maybe lobby to get some laws passed to ban film crews from turning real guns into prop guns, but the N.R.A would put out a contract on you for it.

Gun Safety 101: Treat all guns as if they are loaded and never point a gun at anything you do not intend to shoot. Two simple rules that were not followed by Alec. If he had only followed one of them, the resulting death/injury would have been avoided. The Actors Firearms Safety Guide states: "Treat all guns as if they are loaded and deadly". This is Actor specific, which Alec should be aware of and follow, as he is an Actor. Here is what Arizona Law States: AZ SS 13-1102 A. A person commits negligent homicide if with criminal negligence the person causes the death of another person, including an unborn child. The legal definition of "Criminal negligence" in Arizona is given in AZ SS 13-105-10 (d) "Criminal negligence" means, with respect to a result or to a circumstance described by a statute defining an offense, that a person fails to perceive a substantial and unjustifiable risk that the result will occur or that the circumstance exists. The risk must be of such nature and degree that the failure to perceive it constitutes a gross deviation from the standard of care that a reasonable person would observe in the situation. Everyone in the chain of custody, from the person who loaded the live round to Alec Baldwin should be criminally charged. If Alec is not charged, this would set a dangerous precedent that would imply if someone says "cold gun" or tells you a gun is empty, you can legally disregard gun safety, even if the result injures or kills someone.
@IronFreee2 жыл бұрын
That gun was not supposed to be loaded, they hired an armorer who is supposed to make sure that it's the case. So he wasn't handling a loaded weapon in his mind. The armorer job is to make sure that there's no live rounds on the set. Only fake ammo and blanks. The armorer is the person who give the gun to the actor and tells him if it's cold (fake empty ammo) or hot (blank ammo). In the worst case scenario it should be blank ammo that wouldn't have killed anyone in that situation.
@davewave27602 жыл бұрын

@@davewave2760 The gun should only be loaded with blank in the worst case scenario. The job of the armorer is to make sure there can't never be real ammo in the gun. The armorer who hand the gun sais if it's cold (fake ammo that doesn't shot) or hot (blank ammo) when directly handing the gun to the actor. Actors don't have to know how to check guns. The fake ammunition look identical to the real ones. That's why the Armorer shouldn't have live ammo. The armorer had live ammo everywhere in the prop truck and immediately sait she F_cked up to the cops.

@davewave27602 жыл бұрын
Please read my first post again, especially the part from the Actors Firearm Safety Guide "Treat all guns as if they are loaded and deadly". which is Actor specific. Gun safety is every bodies responsibility according to gun safety, the law, and Firearms Safety Guide specific for Actors. There is a reason for this. Imagine there was a situation where a bad armorer issued 20 loaded guns, nobody else checked, and 20 people are injured/killed, and the armorer is the only one charged. This is why everybody in the chain of custody is responsible.If only the Actor, and no else follows basic gun safety, this tragedy is avoided.

Mine would be don’t hand a real gun to anyone who hasn’t been trained, and the FIRST thing you do when you are handed a gun is check if it’s loaded in a safe direction

An Alec Baldwin quote, "I didn't pull the trigger" Ok, now y'all do see EXACTLY where his trigger finger is in the rehearsal footage right? Let's review the word "rehearsal", basically it means to practice, to work out what you're going to be doing. The simple fact of the matter is while there are multiple things that went wrong with this situation. Alec Baldwin WAS negligent in his handling of the pistol. The ONLY way the type of pistol used could fire AFTER the hammer was cocked back and THEN released. If WHEN the trigger is MANUALLY pulled. Alec Baldwin DID pull the trigger Alec Baldwin IS responsible Alec Baldwin has done nothing but lie from the get go

@nvg38102 жыл бұрын
I’m not at all a fan of Alec Baldwin, but as an actor, he is not criminally responsible for the accidental shooting and death. However, he is part owner of the production company, and therefore shares in both the responsibilities and liabilities that the production company has to ensure safety for all cast and crew on the set. Bottom line is that a videographer, Salyna Hutchins, was killed on the set, by an accidental firearm discharge. Nothing is going to be able to bring her back. However, her family can and should be compensated financially for the loss of her life and pursuant damages. The production company bears that financial responsibility and liability, and has insurance to those effects. The amount of the compensation will need to be adjudicated in civil court. The production company has been fined by a film industry oversight entity for various failures in occupational safety. So, in the civil lawsuits filed by the Hutchins family on the production company and certain of its individual officers, will likely result in award judgements for the plaintiffs (Hutchins). Law enforcement has not yet recommended criminal charges. They are being thorough in their investigation to assess if there is evidence of sabotage or pre-meditated murder. In the meantime, there’s numerous speculations and accusations of negligence and reckless disregard for life safety. Ultimately, the root cause of the accident was a live round of ammunition entering the collection of dummy rounds brought on to the set, and being loaded into the firearm that discharged and killed Salyna Hutchins. Was this an error by the supplier of the dummy ammunition? Unless it can be established with evidence that a live round was accidentally or intentionally introduced into the case of dummy ammo, on the set, the supplier of the dummy ammo will be facing substantial liabilities, both criminal and civil. What responsibilities did the armorer, Hannah Gutierrez, have? Just as the production company is responsible for overall safety on the set. The armorer is responsible for overall firearms and ammunition safety on the set. It can be extremely difficult to distinguish live rounds from dummy rounds, but it is the armorer who is on the hook to ensure that dummy rounds are indeed inert, and that only dummy rounds or blanks are loaded into guns used on the set. So, Hannah is at great risk for being found to be criminally negligent, and is civilly responsible no matter what. Armorers don’t earn a lot, but need to buy professional liability insurance. Essentially, the chain of civil law suits will be: 1. Hutchins family suing the production company plus individual officers 2. Production company plus individual officers suing the armorer 3. The armorer suing the ammunition supply company I forecast that criminal negligence will be shared by: 1. The production company and its officers 2. The armorer 3. The ammunition supply company There are lessons-learned for the future that are matters of safe firearms handling protocols and training pertaining to these: 1. Never point any firearm, real or prop, at any person 2. Always ensure that there is a backstop that can stop any projectile that may be fired, accidentally or intentionally, out of the muzzle of any firearm - and a clear path from the firearm to that backstop. Objects inside the bore of a firearm can be accelerated by blanks to velocities high enough to kill. The muzzle blast from blanks can kill at point blank range. 3. Keep your finger off the trigger and outside the trigger guard until you are ready to fire the gun On #1, accounts are stating that Salyna Hutchins asked Alec Baldwin to point his revolver at the camera. On #2, the bullet that was accidentally fired from Alec Baldwin’s revolver hit and passed through Salyna Hutchins, and then continued on to penetrate the shoulder of an on-set director. On #3, the video footage of Alec Baldwin practicing his draw on the single-action revolver clearly shows him with his finger on the trigger as he is pulling the revolver from inside his jacket. If your finger is on the trigger, and you slip while cocking the hammer, the revolver will discharge.
