I don’t know how this goes to proving that Baldwin was reckless. In fact you could argue that based off the footage when Baldwin knows the gun is loaded he is very precautious. He at one point ask the DP (I’m presuming) if she would stand on the opposite side from where he would shoot his prop gun. All I’m seeing here is that Baldwin when aware of his gun being loaded tries to make sure people are in a safe location.

It’s a very strange situation of a real bullet being on set and then you as an actor having to shoot the gun and someone gets accidentally killed. It’s hard to believe someone can be found guilty

@@Amanda-lw9kq the “I don’t want to shoot you” moment was on a different day, on a different scene, and was in an instance when Baldwin was fully aware that he carried a loaded gun. The incident in question was on a day that Baldwin was told by his armorer and his 1st AD that the gun was not loaded. On top of that he was told by the director and the DP to aim the gun at the camera so they could frame the shot correctly. In other words simply screaming “BuT hE PoINtED tHe GUN aT HEr” does absolutely nothing in proving that he acted recklessly. Especially when Baldwin believed the gun was not loaded bases off of what the gun expert on set told him, and that fact that he was directed to point the gun at the camera. If your gonna continue with the whole “he aimed a gun at someone” than I’m just gonna say your arguing in bad faith and have nothing else to say to you. Period

I agree with your general analysis. Maybe they are arguing for intentional murder then is my thought? But this presented it as retrying the manslaughter charges so that wouldn’t make sense at all.

This was the ultimate hiccup that costed a cast member their life and someone needs to be held accountable. The biggest question is how did a live round even get loaded into a prop gun on a movie set? Smh absolutely mindboggling!!

I believe it has to do with safety protocols in place in the “Movie Industry”. There’s a standard of safety and if it’s broken then criminal negligence might be at play.

It shows that he was well versed in gun safety on the set. on the day in question, when there just happened to be a real round in the gun, he aimed the weapon directly at the crew and pulled the trigger.

The biggest question I have, is how did a live round ever get on set or near a prop gun? If a gun is a prop, it shouldn't ever be used otherwise. Did someone take the props out and "play" with them? Or was this something more sinister? I think Baldwin is a colossal clown but I have more questions here than answers

Props are different from actual real guns. The person in charged of the real weapons is called an armorer. Props provides the holster. In this case, the armorer was not informed Alec was using the real gun. The man who lied about inspecting the gun took a plea deal. Alec neglected to visually watch the inspection as he was required to do. Had both men done their jobs the bullets would have been discovered. Had Alec not forced Hannah to work 2 jobs she would have been able to inspect all the bullets and find the live ones. She has all of this in writing. Alec failed on many levels, especially as producer. Hannah is going to bury him at her trial. Then he'll bury himself at his own trial. Justice for Halyna.

Based on Alec’s not wanting to fire blanks in the direction of the crew it leads me to think if he pointed a gun towards the camera he’d have done so believing the gun was empty. Still, if he’s that conscious I wonder why he didn’t check the weapon, or why the prop manager didn’t check the weapon before handing it off. Gun safety 101 says to always assume a gun is loaded until you know it isn’t.

This happened at the movie set. Guns are supposed to be pointed at the people. That is the prop guns. Not the real gun.

I don’t ever intend to protect any murderer but this doesn’t seem like a chargeable offense, it seems like a very poorly mismanaged props department who handed someone a loaded weapon and told him he could shoot it? It’s not like this happened outside of a film set. If anyone should be held responsible its the one who prepared the weapon for filming

I agree, but I think the point is that he’s being prosecuted more for his role as a Producer of the film (who is responsible for things like the culture of overall safety on set) as opposed to merely his role as the person who pulled the trigger. As a Producer, he’d be responsible for ensuring his staff - including those in the Props department - have ample safety measures in place. I agree that this footage doesn’t reveal any further evidence of negligence (to my eyes anyways), but I think that’s how prosecutors are framing the case

Why live ammo, not blanks on a movie set? You can shoot the bullets hitting dirt by prop people as it is a reverse angle.

Alec said it himself… he was told the gun was empty… that was the fatal mistake that he made. He threw a cardinal rule of gun handling to the way side. Never take anyone’s word for it, check the gun for yourself… always

You are correct. And then after failing to check the gun, Baldwin chose to violate every single basic rule of firearms safety by pointing a firearm at innocent people, manually cocking the hammer all the way back, putting his finger on the trigger, and pulling it. If Baldwin had done any ONE thing correctly, he wouldn't have killed his victim.

I 100% agree with your point. Was the gun “empty” as Baldwin claims? Or were there blanks in it? If it was supposed to be 100% empty then you are right. If he was handed a gun with blanks loaded, then that’s a bit trickier as most people when checking their firearm wouldn’t be able to discern the difference between a blank and a regular cartridge without taking them all out for inspection.

Very possible. I have and worked on this same model of pistol It's a simple single action and if he pulls the hammer back it's possible that it dropped. Especially in movie props where they sear down the trigger to give it an easier pull. Yet IMHO he was probably holding the trigger back when he pulled the hammer and it dropped on him.

​​​@@jpwiggo Wrong. Obviously you have zero professional training, knowledge, experience, or skills with firearms. Pietta revolvers use a transfer bar safety- unless the trigger is pulled, there is nothing you can do with the hammer to cause the weapon to fire.

Sometimes guns can fire on their own, especially if firing pin has been over oiled. I think this is a management issue. The gun safety crew should've been there advising. This can easily happen and I don't think anyone had any malicious intent.

@@israelarana5283 with that logic. He was still pointing the weapon in someone's direction, AND didn't check to see if the gun was loaded with the proper equipment. Also Pietta revolvers (the one he used) has a safety that requires the trigger to be pulled. He failed multiple rules of gun safety and it cost someone their life. HE'S responsible

In production the guns could be completely empty and the smoke / fire / sound added in after, in that case if the gun is empty, why not aim it wherever? (There's an assumed chain of responsibility too, the actor doesn't even need to question the gun he's holding)

And I have NEVER pointed a firearm... loaded OR unloaded... at ANYONE. Being an actor in a film doesn't exempt you from the RULE. A true "prop gun" that is inert/incapable of firing? FINE. But not an actual, functional FIREARM.

How can we explain that? I.e. John Wick films, if you look at the behind the scenes, he's pulling that trigger and that gun is pointed right at the stuntmens' chests

Gun "experts" saying that you never should hold a gun without checking if it's loaded, that's flawed logic because you're not supposed to point it anyone either. This was a movie set not a firing range. There are not supposed to be any bullets, just blanks. Actors have to point guns at cameras all the time. The one at fault was the stage manager.

Agreed. There wouldn't be guns in movies at all if the actor is left responsible for checking. What they need to do is use actual fake guns (surely SOMEONE can make a real-looking fake gun on a 3-D printer) with a smoke-filled pellet that pops when they pull the "trigger." Then, dub in the sound later. Voila, nobody would ever die from that.

Wrong. Actors are not above the law when it comes to gun safety. Imagine these were college kids making a crappy amateur film. The same law applies. Imagine it’s a gang just screwing around to make a KZbin video. Same laws apply. A gun is an “inherently dangerous” weapon and special laws apply. A gun is not a toy. The state of New Mexico did not sign Alex Baldwin’s agreement with movie producers. In fact, Baldwin IS a producer so he has extra accountability as an actor and producer. People who know nothing about guns or the duties of handling a firearm defend Baldwin. Totally clueless about the law. Baldwin not above the law. The video shows Bladwin’s complete disregard for basic gun safety. It’s his duty to make sure the gun isn’t loaded with real bullets regardless of whatever private contracts he has with other people on set. Civil contracts do not trump state criminal law. You obviously aren’t a lawyer or a responsible gun owner. And Baldwin has the audacity to lecture other people about gun safety when he has no clue himself. The arrogance.

⁠Actually yes Alec is lead producer on set. His job is to ensure everything goes smoothly. In prior cases where similar thing happened the highest authority can be held liable...and as acting producer on set that can be him. Now it isn't like he can't deligate these tasks to others however the individuals themselves must also take part in the safety process

Members of the crew and cast had been "plinking" beer cans for fun in the desert near the film set, using live ammunition (and some of the weapons used on set).

The gun Alec did not visually confirm was properly inspected as he was required to do. Yes, you're correct. Those 2 were the worst at following all IATSE safety protocols. They put everyone's lives at risk. Crew walked off due to fear for their lives. Halls was smart to take a plea. Hannah is going to trial so her depositions will be very interesting. Alec will end up in prison. Exactly where he belongs.

Alec chose the gun himself. It was an antique Colt revolver with no modifications. He knew exactly what was in his hand. People make mistakes. That's why the gun and each bullet must be inspected by the armorer before and after the use of the weapon. Alec forced the armorer, Hannah, to work 2 jobs, against regulations. She repeatedly told him she can't do that, it's not safe, and she must focus on weapons 100%. He ignored her concerns. Had he let her do her job she would have discovered the bullets. Had Dave Halls actually inspected the gun he would have discovered the bullets. Had Alec visually watched the inspection he would have discovered the bullets. Halyna would be alive if Alec had just done his job properly as actor & producer.

@@The_BalloWhat nonsense … did you read them! It also says to follow directions of the armorer and responsible crew members. The gun line has a complete different relevance if the gun is specifically prepared for a scene where the gun is pointed at the cam and cocked … SAG also says about lifting heavy objects to clear the path and never jump obstacles with it … but this becomes irrelevant if you are shooting exactly such a scene!

#1 treat EVERY gun as if its loaded. He should have checked himself, it would of taken 20 seconds, and she would still be alive. Such a shame that actors apparently are too important to follow gun safety.

He had this concern on Those days maybe, but lacked that same concern the day of the shooting. We've convicted parents for not properly handling and checking the safety and location of their weapons inside and out EVERY day. All it took was the one time they didnt. Alec didn't perform the proper gun safety procedures on the day and pointed and "pulled" the trigger in the direction of people.

Live round in a gun while filming a movie should never happen under any circumstances. This stuff needs to be double, triple checked for safety. Fatal accidents happen because of extreme negligence. It's extremely tragic yet very easily avoidable. Someone didn't do their job and someone paid the price with their life as a result.

This makes zero sense! It’s a revolver! And Baldwin was not able to see if dummy’s for closeups, blanks or live. As was said … the dummy’s and live ones are identical, the shaking sound is different it’s no shooting range and it’s not about checking if empty or not.

Alec, as producer, ignored basic protocols around using guns as he refused to do the training & cuz he was the boss (he just ignored the protocols). The first armourer quit cuz of that. This lady is the second armourer. And she was ignored, too. So, as producer and the person who refused to do a gun training, ignores protocol, and pulled the trigger, yeah - he should be charged.

They are trained in this. The reason that the training goes over checking the gun repeatedly is to prevent this scenario. It never should have happened.

The real question in this case is whether you charge someone with murder for a tragic accident they obviously didn't intend on committing. It was reckless for the gun to be pointed at another person but to put someone away for a considerably long time for a common mistake is the real debate here.

The case has to be proven beyond all reasonable doubt. Even if he knew the gun was loaded it’s proving it that will be impossible. So he will get away with murder literally. Acting irresponsibly with firearms isn’t illegal so this is pointless fuel to the fire. The only person who will get jailed is the armoury woman who gave him the gun that was loaded. There is zero reason to have live rounds on a movie set and that was her mistake

Just leave it already. He didn't know the gun was loaded. He wasn't on a firing range. Why was there any real bullets on the set in the first place? Maybe place the blame on that individual. He is just an actor; he's not an armorer or a firearms expert. If a gun has blanks in it, you have to take the shells out and look at every single one of them to see if there is a projectile on the end. They both have shell casings. It wasn't his job

You are confusing “his job” with respect to his private contracts with the movie producers (incidentally, he’s a producer) and his duties under state criminal law. The state of New Mexico did not sign a contract with Baldwin allowing him to disregard the law. He’s on the hook for his reckless behavior.

Basic gun safety says regardless of a guns status, it should always be treated as if it were loaded, and kept pointed in a safe direction. This is negligence on a lot of people’s parts, but still Baldwin is mostly responsible. Especially considering everyone is responsible for every bullet that comes out of the gun they are holding, whether you are a citizen, police officer, or famous actor, the rules apply to everyone the same

This is why it's REQUIRED for the person using the gun to visually confirm it's safe to use. Alec did not watch the inspection. There was no inspection bc again, Dave Halls LIED. Hannah wasn't even there. She wasn't a prop girl. She was the armorer who was forced, by Alec, to assist props which is against regulations. Armorer is a dedicated job due to the dangerous nature of guns. She repeatedly told him she can't safely do both jobs but he ignored her concerns. She has all of this in writing. She will bury him at trial. Alec Baldwin is responsible for Halyna's death. Nobody shot and killed her but him.

When real guns are used there are safety shields, off site camera work, blanks or dummy rounds, and the armorer right there to repeatedly inspect the gun in front of the crew & actor using it. Alec didn't follow any of these protocols and didn't even need the gun for this camera set up. They weren't filming. He didn't watch Dave Halls inspect the gun, as he was required to do. Dave Halls admitted he lied about inspecting the gun. Had either one of those stupid men done their jobs the bullets would have been discovered and Halyna would be alive.

It never works to be 100% honest or always prior integrity, it's how social interactions work. I like what you say but it's not the same for an average Joe than it's for a celebrity of some short, bc the second is exposed to a huge amount of interactions and ppl won't take the time to check the context of what it's said, specially if it's about someone we've never seen in person and we'll probably never meet. Single action recover requires that the hammer being pulled back. Then, the trigger being pulled. Sometimes some revolver fire bullets without the trigger being pulled back. One of KZbin video showed a revolver shooting without the trigger pulled back.

This is a rough case. It was a tragedy but I don’t think he is guilty of manslaughter. Criminal negligence perhaps but I don’t think manslaughter is gonna happen. He’s gonna lose millions in civil court and the movie itself is gonna be a bust. As for criminally I could see him getting a couple years in a country club at most, but more like probation or some sort of short suspended sentence.

@@Erik-R double jeopardy doesn’t apply to a person who never was found innocent. They dropped the charges before a trial but can always refill them as long as he wasn’t found innocent.

@@Erik-R there hasn’t been any trial other than the trial of public opinion. The criminal charges were originally dropped but he’s still on the hook for civil liability which could have a trial or get settled. Now he could be looking at criminal charges again plus the civil liability.

Baldwin is the only person who chose to violate every single basic rule of firearms safety, pointed a loaded gun at innocent people, manually cocked the hammer all the way back, put his finger on the trigger, and pulled it.

I think another prop master did a video on this and how a prop weapon can misfire. It was basically how far the trigger is squeezed and it’s possible to believe you didn’t fire the weapon and still have it fired. Even if he did pull the trigger? So what? Hollywood has STRICT unions and it shouldn’t be his job to check the weapon for a live round. The prop master is entirely in charge of that and it should be that ANY competent actor with 0 gun experience can do their job, act. I believe where Baldwin and other producers do have responsibilities is how they treated the crew and weather it created a rushed and dangerous working environment. Small problems usually lead to bigger problems. I crashed a car in 18 due to the high stress of a terribly managed production. We were working 16 hours and our manager made a very hostile and confusing work environment. Multiple issues happened that set and it did a toll to our health. Id like to add I am not an expert on weapons, I just worked on sets.

There’s frequent mentions of the “prop” gun. Prop is just short for “property”…as in it’s the movie studios property. It isn’t synonymous with fake. Could be fake sometimes, but not always.

Double jeopardy refers to being TRIED (convicted or acquitted) twice for the same charge, not charged. People are often charged multiple times for the same crime for a variety of reasons (including mistrials) before being tried or the charges ultimately dropped or dismissed. Because of dual sovereignty, a defendant can also be charged in different sovereign jurisdictions (Federal and state courts, or two different states if both have jurisdictional claims) without violating double jeopardy.

@@DerWaidmann_ He was never charged & tried. Only investigated but not charged by the DA at the time. Also there's no statute of of limitation on murder or manslaughter. If the Grand jury returns a true bill charging him the DA will file charges and a trial date set.

Is everybody crazy? A prop is made harmless so that an actor can safely fake doing the things that would be dangerous if it were real and loaded. By what possible logic can he be held guilty? This is one of the things that shake my faith in the basic sanity of us humans.

Then seek competent professional mental health care. The word "prop" doesn't mean "fake", it is short for the word "property", meaning it is the property of the production. Productions are run by producers. and Baldwin was the producer. It was Baldwin's decision to use a real firearm as a movie "prop".

This was so sad and should never have happened but I see nothing but him verbally stating safety issues and concerns. No I am no super fan but this was a sad tragedy. I see nothing in these shorts that would state otherwise. He was certainly super cautious in every aspect.

He was absolutely NOT super cautious. One scene is different from the other. Halyna died because Aled did not do his job or follow the written IATSE protocols for weapons on set. In fact he straight up ignored 12 of them. The camera work with Halyna was just a set up to see how the light shone through the church & how best to position the camera. It wasn't scheduled and no gun was necessary. Alec wanted to use the gun. He did not inform the armorer, as required. He did not watch the inspection of the gun, as required. He aimed a real loaded Colt revolver 18" away from his coworkers and pulled the trigger. There were 2 misfires on set he did nothing about. He did not attend the required safety classes. He forced the armorer, Hannah, to work 2 jobs, against regulations. She repeatedly told him she can't do that and must focus 100% on weapons. He ignored her concerns. 'Super cautious' are not words that coincide with Alec Baldwin. He will be prosecuted and convicted for the death of Halyna Hutchins. There's no way out of this for him. Justice for Halyna.
