Good day Atty, How can we reconcile article 3 section 5 of the Constitution from PD 1083? in relation to this question, is it constitutional for a person exercising the Muslim faith to do acts contrary to the laws of the land where they soujorn or citizens? Hello, Atty. Good day! Ano po ba maaring ikaso sa taong namemeke ng resibo, pineke nya po resibo ng DENR, BIR. City treasurer at iba pa po. Siya po kasi pinagkatiwalaan po namin sa process ng lupa namin tapos peke pala mga resibo binigay nya sa amin kinumperma po namin sa DENR kung sa kkanila po ba talaga. With due respect sir , traffic laws are under administrative law. You have to go back into Republic act that creates LTO . Local city/municipality jurisdiction. I totally agree w/ u it’s legal However it’s doesn’t mean it’s lawful. The problem here is that These these government agencies such as DOTC , LTO etc they are in business of rule making in which they’re permitted under the organic act that creates them however they can’t violates your constitutional rights. Also if the organic act doesn’t say specified a certain inclusion , exclusion or prohibition then That’s a violation of Executive agency OVER REACH . If the organic act is ambiguous, vague on certain inclusion, exclusions then whatever municipal , city ordinances applies to that traffic law will deem illegal. Remember city ordinances, LTO circular order etc ARE not LAW .
