Hi mate. thank you very much. tbh its a joke. the only scams i have are charge backs and when they wont even give you the bank account name to take action against them there isnt much you can do. i am just glad this time its a uk customer

Keep going! These credit card company and PayPal thefts need to stop. I am struggling with similar fraudulent charges - It's so frustrating and takes a ton of time just to get no where in receiving justice and fairness. Behind you all the way!

Hello Walter! So sorry to learn you're dealing with this. Yes, it's the principal of it all! I'm a small time seller on ebay and once in a while I will check a buyers review page before committing to a sale. Just so happened one time I wouldn't accept an offer a buyer had sent for an item because they had a bad review for this very same reason. I feel your frustration, power to you! I have been through the same situation - The court will be in your area, they have to come to you. Unless you picked another court. But as far as i can remember they pick the nearest court to you. The £35 pounds can be added to the claim, plus you can include daily interest. The court will ask if you want to have mediation, but if you do, you have be ok with taking a lesser amount. My case was against Hermes, they played ever stage to the last moment, but since i would not move, the day before the court date they folded and paid me plus the fee and interest £250 pounds.

Chargebacks are a modern avenue for scams, buyers that use it to often do get into trouble with their banks but it has become the default way in recent years of getting things for free. Banks almost never don't rule in favour of their customers. I had one that I had tracking, messages from the buyer & even positive feedback but that didn't stop him two months later claiming he knew nothing about it. His bank refunded him, eBay took from me & then after I complained I got it back. But I am very interested in how the small claims court thing goes. I was aware its an option & not that expensive so am looking forward to the series.

The 14 days return only applies for a change of mind return. For an item claimed to be faulty its between 4-6 months depending on payment provider.

Well done. Well composed letter but would of made more impact if you can refer to the actual legislation - consumer protection, Long distance selling regs, and also the consequences to them if they are found to be fraudulent . I suspect it is Paypal that you may have to take action against. What are they're FORMAL complaints procedure. Look at FINANCIAL OMBUDSMAN, can you take paypal to small claims court? I can tell how upset you are by this. Is there a small business association in your area, maybe they could give some advice.

I had one in my area I wasn't covered under ebay but they certainly didn't expect me to go to the door and demand my item back I ended up having the cash and the bloody item I laughed when they threatened me with the police I said call them they are too busy arresting people for fb posts

Use a payment method known as BACS. You give the buyer your bank details, and they pay you your fee. No clawbacks from PayPal, eBay or those other self-righteous entities. You hold the Ace's.

I don’t think your description helps just say it needs re-wiring. That implies once rewired it will work. Which is fine if you can prove it. (I do get how ridiculous this in reality..I understand the simple bulb holder isn’t complicated but consumer contract regs mean it’s up to them to prove it wasn’t working within first 6 months. By not accepting the return you haven’t allowed this. Just something to check out, although I’m as frustrated as you. Also don’t think additional expenses such as travel etc are chargeable on small claims court

Hi Walter, don’t think I’ve seen you angry and I don’t blame you. I hope something is resolved for you on this one. One would imagine that selling antiques and vintage that you wouldn’t come across these types of customers but obviously this isn’t the case. Sadly it seems that in the uk the law and justice system is going out the window and scamming is reaching epidemic proportions as no action is being taken and these scum are being emboldened more than ever in all sorts of crimes the police refuse to touch. One aspect of the job I just could not put up with. Just give me good honest people. I never diddled anyone. Honestly, I just could not have this in my life. You should be going after the woman that bought it as she is completely oblivious of the grief it's causing. I hate not being in control and relying on someone else i.e. Paypal. I also hate having to chase after my own money. There are a lot of scammers out there as well as some who are completely mad. Does Ebay temp you back now? Just asking.
