So a few things here... An indictment means that evidence has been presented to a grand jury to charge a defendant accordingly. So there is some form of evidence for each charge he was given. This is typical. It's common law enforcement practice to charge someone with as much as you can because ultimately when it gets heard in court as part of a Plea deal half the charges will get dismissed. This is done to make it seem like it's a good deal for the defendant and they are cutting him a break to plea guilty. It's basically an incentive for the defendant to plea guilty to save the courts time. I would guess CJ would take a no contest or Alford plea so he can "maintain his innocence". CJ won't do jail or prison time for this....he may get probation with suspended license and have a huge fine/restitution to pay. If he can't pay it or just refuses to pay it then ultimately they will put a civil judgment against him. Dude can't even afford batteries in smoke detectors from his last podcast with you guys lol. And the reason CJ went on podcasts after knowing he killed this deer illegally is one reason only.....attention. he wanted his 5 minute of fame. True definition of a narcissist.

@Bucky5068 looks like they are trying to hammer him, and I hope they do, but I know how the game is played. He won't do any jail or prison time for this. They will definitely suspend his hunting license. He may never get to hunt in Ohio ever again - but will he follow that? Lol. People with suspended drivers licenses still drive all the time.

I always leave my phone at home, especially when hunting. That’s not all that strange. What Might be strange, Is I quit taking photos In like 2018. Realized I don’t do this for attention, I do it because I love it. Probably hard to believe but I have multiple record book animals that have never got Their photos taken.

To clarify, he did not spotlight and kill a deer he just spotlighted one. The hunting without a license charges were for a different buck (a 8pt 150" deer) and different hunts he had done previously. He probably had a license when he shot the 18pt 244" deer, but did not have permission to hunt on the property where he took the deer, then tried to cover that part up.

In most states, a flashlight turned on leaving the stand is hunting with a light. Even if the gun is unloaded and ammo in back pack. Game Wardens are notorious for piling on charges when they catch a poacher.

Every state I have hunted in.. which is many.. allows a hunter to enter and exit the woods w/ use of a light so long as weapon is unloaded, bow or xbow have no arrows or bolts nocked. Never heard of this violation and curious which states. That's like walking in or out of the woods and getting dinged for hunting before or after hours.

​@@jeffolsen25 it is in the alabama hunters education course test. you should leave before a flashlight is needed and told that surrounding states have the same rule. it is a way to tack on charges just like an empty feeder with no corn, no battery and the spinner removed they still look for a sliver of old corn and would write a citation for bait (although now here legal with extra permit paid for)

I think someone definitely snitched about it too. This whole investigation wasn't started by the Ohio DNR, just based on things not adding up from his story.

Honestly if you put him on trial with a jury of hunters he’s gonna be guilty even if he’s killed the buck legal.. cause the jealousy in the hunting world is crazy!! This will be a tuff case. It will be interesting to see how it turns out.. They was a case here in wv where the wardens set a guy up an took his deer that he killed legally An he had to take them back to court to just get his deer back so you gotta keep all these things in mind so it will be fun to see how this goes.. great video guys keep them coming An keep following this for the rest of us to see

The whole I forgot my phone thing doesn’t fly. He has 4 kids, no parent would hunt without it or continue on hunting without it. But, he also has meth teeth and doesn’t work. Sometimes you can judge a book by its cover.

If it’s a jury, they do not need to know about deer. The evidence will have to speak for itself. There has to be substantial evidence for it to have made it through a grand jury.

Sorry, sir, but a Gran Jury indictment is much easier to obtain. A grand jury only sees evidence from the prosecutor also the grand jury is able to see evidence that will not be able to be used at trial.

@@bankerlies6121 yeah exactly a grand jury only gets to see the prosecution side of this case to make their indictment. That’s why they’re so easy to get. It seems wrong to indict somebody on only half the case don’t get me wrong if this guy is guilty then he should be punished accordingly, but it seems like everybody’s already gotten convicted before he sets foot in a courtroom and that isn’t the way it is in this country you are innocent until proven. Guilty prosecution hasnt proven anything yet

What you’re suggesting is called court. Both sides present what they have. That’s not grand jury. Grand jury just decides if there is enough evidence to move forward with the charges. It’s really not hard to grasp. So obviously there is enough to charge him. Grand jury is not as easy as you say.

I think the cell phone evidence, is what's gonna get him convicted. Did he really forget his phone, or did he just not take any pics at the kill site that the odnr claims the deer was shot. Even if you didn't, you and your buddys phones would be pingy off of towers in the proximity of the kill site. Also if your buddys snapped a pic, at the real kill site, those pics will have coordinates on them where that phone was at, at the time of the photo.

The no hunting license is in reference to the 150" 8 point he poached the prior January on the same property where he killed the large buck. the indictment in full can be read online, it is public record. I read it all this morning. There are also charges on stealing sd cards from cell cams. $10k for sale of the rack, $2k from North American Whitetail for a cover story, and $8k from Mar-vo minerals to use the pic to promote Lucky Buck minerals(all tied to the theft by deception charges)

The big thing about a criminal jury trial in the US, the jury is instructed to deliver a verdict "beyond a reasonable doubt". Reasonable doubt is a big hurdle to get over without some serious evidence. But with that said, they can subpoena cell phone records, and can tell exactly where his phone was when the deer was killed. Also his buddies phones.

If he really did forget his phone, which does happen, that is horrible luck given this situation. But wouldn't you, immediately after killing the deer have someone bring you your phone or have a friend come take pictures at the harvest location, thus containing metadata?

He’s going down, one of the two friends or sister will sing! Plus these days a phone is a GPS tracker. He left the phone knowing this. But they probably have him or the friend going to that spot several times before the kill. And once they charge the other two. I don’t feel bad, he keeps going on social media likes it’s a joke.

If they have all this evidence why didn’t they charge this guy in the normal way? Prosecutors usually Take the grand jury method because it takes much less evidence to get a grand jury indictment.

The 150” 8 pointer was killed before the 18 pointer. He shot the 150” on January 7, 2023.

the hunting without permission charges will be for hunting where he actually killed the deer, the hunting without license could be for the deer he killed last year

The process takes typically 9 months to a year with no postponements and all that shit. But if CJ's guilty he's going to postpone it as many times as he can which is three I believe to try and get things pushed under and forgot about and people just tired of it. But it all depends on what he spends on a lawyer or if he has a public defender and what that evidence shows and they have

I remember hearing about a deer that was killed in Kentucky before social media that was being talked about in amazement. If I understood the story right the deer scored around 140. What was incredible about it was it was a SIX POINTER. It was checked in during archery season as a bow kill. Rumors started flying that it had actually been poached during the archery season with a pistol. Never heard any more about it. Regarding this CJ deer, if this deer was killed 10 miles from the property CJ claimed to have killed it on, how did he even know where it was 10 miles away to kill it? I have seen a buck chasing a doe across a large bean field half a mile wide and easily cross the field in less than a minute. Also, a person can walk a mile in 20 minutes. 10 miles for a buck chasing a doe would be nothing really. Friend killed a 150 class that ran 8 trail cameras on his property. Never got a single trail cam picture of it all season, yet it showed up and got killed on his farm. He kept meticulous records of trail cam photos of all the bucks on his property and had them all named. When his son showed up to help him get it out, they are looking at each other like, uh, we don't know this deer, yet here it lays. They named their unknown buck as a "bonus buck".

Lee Ellis's big drop tine buck from this last season traveled 7 miles over night stayed 2 days then came back to where he originally had the 1st pictures then killed it. I have never poached anything in my life, and I have forgotten my phone my release my backpack more than once. All of the evidence is circumstantial.

I can see not having the phone. Ive forgotten and lost mine. He did have a hunting license, they are assuming he killed it before he bought the license. Its the basic throw as much as you can at him to see what sticks. If he did do it shame on him but i think its very likely that he is innocent. The jealousy alone in the hunting world is the biggest problem.

I guess my theory is like this. When I go deer hunting I don’t carry my phone, who goes out as a the general population knowing what they will have an option to shoot. No one. At best a lot of people are using game camera. However as anyone knows you could have a mature buck on a certain property everyday, at the same time then it disappears until after hunting season or the next season. Also to be truthful they may not be seen on a camera for 2 years. Ten miles is very much within the bucks territory and regardless what the curly haired dummy says, people can not walk 100 miles in a night, but a deer can easily go 10 miles in a night, easily! Remember he took the officer to the place they hunted offered to show the the carcass. This is fucking stupid tell me what proof is there to even having opened a case. Literally who would make the deer public especially to the folks he took it public to.If you do something like this even an ignorant person would not make it public. They don’t have anything but circumstantial evidence. I would fight this tooth and nail. They are trying to scare him into taking a plea deal. To justify their time. Hey curly this is what teaches people to actually have to do pictures and call dnr, because evidently American has gotten to the point where your guilty until you prove your innocence. There is no evidence to show anything, what evidence they claim to have is what they are reading into it. Look I went to college for criminal justice but never worked as a cop. The fact is a lot of our cops these days are trying to revenge for 13 or more years of being a damn puss and getting his ass pushed, or bullied in school. They have a power trip problem because they think the law is backing them, not really the case.this is why innocent people get shot and die. I like you guys mostly you two that did the podcast with CJ, ole curly there is awfully opinionated for someone that hasn’t been put in the same position. Plus the one thing no one has even stated is everyone has a different personality, there are those people, I’m one of them that does not document everything. And I have had a cellphone for probably longer than you’ve been alive. Come on the hunters need your backing so that the police don’t think they can do this to everyone they need to do their job, until he’s proven guilty you should be saying the law must prove it to me! Why should CJ have to prove he did everything he did was right. It’s their job to prove he did wrong.I really wish I was on your podcast, cause someone needs to stand with the people. As someone who has been falsely accused of taking a buck I didn’t even shoot I completely understand how CJ is feeling, if he didn’t in fact do it. Also I feel like as a hunting community there are way to many jealous assholes out there and there will be a day where people who are talking shit now will be doing the same thing just to hunt and get meat in the freezer. Just remember, karma is a bitch and you will get yours. I don’t think poaching should be a federal charge at all and in all honesty I think it’s unconstitutional. However, if you do get caught then I believe there should be lots of community service hours helping park rangers on public grounds to help better our hunting areas. This makes way more sense than stealing someone’s hunting rights. Laws that are unconstitutional do not apply to me or anyone born in this country legally. I think that we should all be sharing properties for hunting and sharing information with each other about every deer we have and maybe someone wants to shoot something on your property and you have one on theirs. We all as hunters should strive to do better and work with each other, not beat each other down. Because if this continues, I personally will strive to have all hunting banned permanently. So tread lightly because if you continue to bash other hunters, it will be very easy to make sure nobody has a chance at doing it legally.

CJ tells the story so straight and so convincing that we will have to see what evidence prosecution actually has. Only a couple things I’ve ever questioned in his story but not much.

Tbh I don't know enough to say if he did or didn't do it BUT I do hunt 95% of the time without my phone (stay on my 1 acre) but i also dont hunt for horns, pretty much the only deer i pass comes with potatoes and gravy 😂

To the guy drinking a beer, that's, very un becoming. you can start to see as the pod cast was going, he was getting a buzz... Now about the deer, I sure hope he didn't do it. I think there is A LOTTTT of jealousy on the part of the property owner that the deer was suppose to live on. From what has been said in the past, how would it be possible for CJ to shoot the deer on that property and get it out of there without getting caught!!!.

To get a grand jury indictment some evidence had to be presented! Also, I’d say it’s a good bet his buddies sing like canaries to get themselves out of trouble or a lesser penalty! CJ is toast!

Its pretty obvious that one of his buddies or his sister is telling the truth to the detectives because thats the only way they would know that the permission was signed after he killed the deer. Theres literally no way to prove that unless someone is talking. Also, he didnt even have a license last year so you think getting his license revoked is going to keep him from hunting in the future!?

It kinda seems that you guys are on the fence as to if he actually did what the charges are saying. From the beginning of this story there were red flags that needed to be looked into I'm not saying he is guilty but I'm also not saying he is innocent this has been an ongoing investigation that was probably thoroughly looked at

I'd like to know 1. what did they take off his cell phone? If he made calls/text then I get it if they used some form of tracking from an app then I think that is self incrimination and should not be allowed in prosecution. 2. i don't think you should need written permission from your siblings. that's over kill 3. his sister must have been heavily involved otherwise I don't see her being complicit. all hunters have taken an animal and then pictures elsewhere. 4. hunting with a light? how'd game warden know this if he was not there when the kill was made? might go back to point number 1.

It’s for the jury to decide. Everyone is different in the aspect of how they view their trophy. You are innocent until proven guilty. That is how it is supposed to be in this country. Jurys have been known to go after individuals to simply make examples. A huge example is the way a jury is treating a past president to this day. If someone in the government was hunting this deer and is jealous now because of the kill, who is to say how far they will take this if they have the ability. Just the way the indictment itself is worded is sketchy. They are saying he is guilty before trial which is unconstitutional. If you guys ever kill a 200” deer there will be those who don’t believe you killed it legally. Just imagine if you pissed the wrong person off. Deer have been proven to travel large distances over and over, so I feel like you may not know as much about whitetails as you believe. I personally have seen the same deer 8 miles a way, 2 days apart in southeast Missouri in farm country. I’m not saying he hasn’t done other illegal things but it’s not for us to judge.
