I’m in the army and I work in the arms room. Every time a weapon is handed to me it is supposed to be clear. I check every weapon every time before I put it up and there’s been one time when it was still loaded. We have a saying here. “Trust but verify” Checking every time can save someone’s life.

I agree it should be the protocol. there should be a huge red blinking light on the weapon that cannot be disabled until the gun has been manually checked.

what kind of protocol you want ? theres a clear protocol alrdy cuz of dummies like army, the protocoles wasnt invented when a bored seargent sat on the loo and had nothing else to do... some of you talk, like brain was inventen in 2016. Straight up... I've messed up reports for work and felt like I was going to die.... could you imagine if your mistake at work killed someone instead of messing up some minor accounting. Jesus. Why even take the risk of having the live ammo ANYWHERE NEAR the set??

Indeed it petrifies me the thought of messing up things (which still have significant consequences, but not death) so being in a situation where people could lose their life and safety isn’t taken into account, I don’t think I could live with myself…

They broke every safety rule, bringing live ammo on set, using the weapons for live ammo target practice, passed the weapon through three people without checking the chamber. There had been three negligent discharges on set and the camera crew walked out in protest to the safety violations. They apparently skipped safety briefs and didn't have a safety stand down after the three negligent discharges. All together, I can't see how this could be not be criminal negligence.

Some of the things you listed are unsubstantiated rumors rather than facts. You are going to be disappointed because AB won't even be charged. You will blame this on his status or wealth but the real reason he won't be charged is because there is no case.

@@almac9203 1) Live rounds were put in a weapon that was to be used on a film set. 2) End of story. I have quite a few years of experience working in a USMC armory infantry battalion. This is absolutely negligence. On many levels. I feel horribly for Baldwin and everyone else. It's that they cut corners and rushed through safety. This tragedy is not an accident. It's negligence on many people's responsibilities.

@@keldonmcfarland2969 who brought the live rounds to the set has not been established nor for what purpose. The plinking rumors are unsubstantiated. We know that there was negligence but the who is guilty has not been determined. I think the AD and Armorer are negligent but whether that rises to the level of involuntary manslaughter isn't clear-cut. AB will not be charged.

It's deeply tragic. A rushed, budget-tightened set using a non-union crew and skirting standard practices. It's a shame all those dollars saved can't replace the life lost.

Anyone possessing a firearm has the ultimate and last responsibility to ensure it's safety. Anyone not trained by a professional on use and care has no business holding one. This is on Baldwin.

Their statement that the kids are "in the car crying" is so irritating to me. Alec could be doing what his wife is doing - recording the situation "just in case." His wife, who was not there to witness the death because she was not on set, really has nothing to say on the matter. But here she is being protective of her husband with the paparazzi rather than being protective of her traumatized kids. That just annoys me. Give your husband the damned phone and get back in the car to be there for your kids. Let your husband deal with the situation - which he clearly wants to do anyway. This is a classic "Swiss cheese model" accident. If only the armorer had checked the gun. If only Hall had checked the gun. If only Alec had checked the gun. If only they had set up a barrier between the cinematographer/director and the person pointing the gun at the camera for the shot. So many things had to go wrong in order for this woman to die. It really is a tragedy.

Just a small correction, on the back of the round, it’s a primer, not firing pin. The firing pin is in the firearm. Love your vids!

The Peacemaker is also single action with a loading gate making checking the cylinder not as easy. That isn't a prop gun, it is a real gun used as a prop.

@@uzi1951Yes but it's still easy. Open gate, half cock pistol and rotate cylinder while looking through open gate. Easy. Less than 10 seconds for a fumble fingers... Knowledgeable gun owners could do it in 5 seconds. But you are correct. A few more steps to clear or check than that more modern double action .357 mag shown. I own one each of these and many more. I have the revolvers stored. All about autos now. Some were not raised on a farm where guns were common tools and we were taught safety starting at 5-6 yrs old. AB has been on sets for 40 yrs with guns on most. He didn't learn anything in 40 years? Is anyone that dumb? I guess so

There is no excuse for the the live round to have found it’s way through all of the checks and balances. The proper protocol was NOT followed and it was the AD who had a reputation for rushing onset. However, Baldwin as co-producer was responsible for the film budget and his hires.

4:00 The circular insert at the bottom of the cartridge is called a primer. The firing pin is a component inside the firearm which transfers the energy from the hammer striking it to the primer.

…and a single action Colt doesn’t open like that double action revolver in this video. The cylinder of a Colt single action revolver is rotating on a fixed axle and the cartridges are loaded one by one through a loading gate on one side of the gun.

As a Marine I can tell you we were trained to treat every weapon as if it were loaded. And you were only certain it wasn't by checking it yourself. Understandably these experts on movie sets should be trusted because weapon safety is a huge part of their profession.

I hate Alec Baldwin as much as the next guy, but the fact is that there is a person on set his entire job is to make sure something like this doesn't happen. She was incompetent and got her job due to nepotism. But yeah in the military they definitely teach you to treat every weapon as if it's loaded

Even with a weapons expert on set, it has to fall on Baldwin since he was the last person to handle the weapon. He had a duty to check it, let alone pointing it at someone.

@@darenmiller2218 but on movie sets it is not the actors responsibility, it is the gun expert’s job. That said, Baldwin bears some responsibility as producer especially because the safety concerns of some crew members were not addressed before the shooting.

Thank you for following up with the case about the tragedy between father and son. I really hope he’s found peace and forgiveness. Even more, I’m happy to hear he didn’t get time in prison. That wouldn’t have solved anything for anyone, and the judge is right. There’s nothing he wasn’t already doing to himself in his anguish. Utterly tragic. All of the stuff happening is so… tragic.

My understanding is the director never should have had the gun in his hand, the armor is the one responsible for handing the gun over to the actor or the person that will be in possession of said firearm. I was raised with firearms, and the ultimate responsibility belongs to the person that is in possession of the firearm, if Baldwin had been to a credible firearm safety class he would have checked the gun himself. (All guns are always loaded and never pointed at anything you don't want to shoot or destroy) this is a tragedy that never should have happened.

I have heard that there are many definitions of the word “cold gun” in the movie industry. To me, having come from a shooting background, cold would mean no ammo. but directors and actors from movie sets have come forward to say that a “cold gun” means that the weapon has not been tested for safety, and that a “hot gun” means it has been tested. And neither case implies ammo or lack of ammo. They say that a “live” gun means blanks.

the fact that there were any other rounds besides blanks at a MOVIE set is beyond my understanding. should slam the hammer down on everyone involved, this wasn't just negligent, this goes beyond negligence. should just take the whole movie crew and give them time, no mercy on these fools

You can have blanks (gunpowder + wad) and dummy rounds (bullet without gunpowder) when you need to show loading or pulling a magazine. Having live rounds on set is bad, using them in the prop gun is worse. They were outside Albuquerque, FFS. They had quick access to plenty of guns if they wanted to plink during down time (which they again, shouldn't have been doing, but if you're gonna plink then plink with a semi auto of a different caliber than the prop gun).

@@mikem9031 Seems like they could potentially use different guns of the same calibre if they had proper ammunition controls in place too. Ideally keeping the live rounds in a double locked cabinet with two different people holding the keys having responsibility for accounting for every round taken out. If at any time more rounds you have more rounds taken out than can be accounted for by the empty casings and any rounds returned you don't do anything else until you resolve this discrepancy by locating the missing rounds. Hell my friend is a pyrotechnician they have procedures like this to account for fireworks and the mortar charges for the display launchers even because they are potentially dangerous articles that shouldn't ever be floating around untracked where anything could happen to them.

I can't imagine picking up a gun and not clearing it. I could see failing to check for barrel obstructions, even though that would be a reckless thing to do, especially if you're even thinking about pointing it anywhere near a person, but holy hell. how does a human being pick up a firearm, not check it, point it at another human, and pull the trigger? that's one reckless decision after another, each one showing a greater disregard for the safety of those around you than the last.

I don't necessarily disagree, but there is a person on set whose entire job is to make sure the actor is handed an empty gun. Add to that the potential fact that she is woefully unqualified and got the job because of nepotism, and numerous safety violations on set prior to this, and honestly I can't blame Alec Baldwin although I do despise him personally

I don't agree with you, sorry. An actor has crew around them to make sure they get what they need. It was not his job to have real weapons while working. I would not know how to check a weapon. I don't understand how there could be live amo anywhere near actors. It's probably in the ins policy the real weapons could not be near the actors. How could it be his fault when there is a person who's sole job requirement is to prevent this? You assume because you understand weapons everyone also understands weapons. That's not quite true. Especially when protections are built into preventing this. Ofcourse the family and their Attorney will go after money, it's always a relief to blame, it makes grief easier. Does the gal hired to check all weapons, who was hired to specifically do that job, have the money? Probably not. So they will go after the money. Blame where the money resides.

My divorce lawyer got shot by a long time removed client two years after my divorce. I heard it on the news. The killer walked right passed the front office worker and entered the lawers office and shot and killed him. He than proceeded to the courthouse and shot up some more. Every time I see that gun on Rivers' desk I recall the above incident, and know why it is there.

One factor that I haven’t heard discussed is the use of drugs and alcohol on set. I think that the police should’ve investigated this because being intoxicated is certainly a factor as far as determining Liability.

True 💯💯💯 I've done set security, 👮🏻‍♂️ & production. Film, TV, student films, basic cable shows. Producers, crews constantly gripe over $, ⏰, actors, sets. Some dir, producers scream snap... 🗣... accidents occur because of tired crews or stress, inept staffs. Some actors are on sets 10-12-16hr a day 6-7 days a week for 2mo 3mo... 🗓 .... dont forget bad weather, animals 🐴🐯🐕🐘 stunts too....

Every time I unholster my gun I make sure the chamber is clear and the safety is on, always down range with my finger off the trigger. Same thing before I holster it.

When I was in the army an armourer was taking a 45. He asked, "Have you cleared it". The guy turning in the gun said he did but the mag was still in the well. The armourer went to clear the gun racked the slide then realized he had not dropped the mag so he drops the mag. The armourer starts twirling the gun thus engaging the grip safety. He put a massive hole in the ceiling.

Yes, see the detailed The Hollywood Reporter article about the Rust budget, fees, costs, salary. Rust had about $7.5mil 💲 . The film was on day 15 of a 21 day production shoot.

Yes. IMDB lists him as a producer. As the biggest name on the project it is more than probable that what he wanted is what was effectuated. If he had wanted proper protocols, there would have been such. Plus, he had to know that 11 experieinced competent armorers turned down the job before he settled for what he could get on the eve of having to pay rent for the location or risk having the whole project evaporate and losing whatever seed money and contracted actor and film crew money he had into it before filming was to start.

The advantage of being born in a country that still had conscription when I was 19 is that I can call BS on all statements denying criminal negligence. AB might not be responsible as the shooter (albeit he would have been by the safety protocol that I had to follow), but there’s CERTAINTY that someone was criminally negligent - and high probably that the responsibility goes far up the hierarchy,

The round piece on the bottom of the bullet that ignites the gun powder is called a primer not the firing pin. A firing pin is what hits the primer on a striker fire gun ie glocks. A hammer is what hits the primer on an ie revolver like what you own! Gotta know your firearm parts better than that especially since your a defense lawyer. Other than that mistake love your videos and keep up the good content on the videos though.

exactly, shows a good deal of the arrogance that also led to the shooting death in question. Also, the gun in the case was a more primitive type, not a 'wheel gun' like he showed off here. The gun Baldwin had did not have a cylinder chamber that swung out, each cylinder has to be revealed one at a time, rotating the chamber and looking in each one individually, lifting a hatch to see. Does not excuse the negligence on set but helps to explain it.

I really appreciate this video for how clear cut it is. I see so many comments on this situation that seem to be based on whether the speaker likes or dislike Alec Baldwin, which is completely irrelevant!!! It's about what happened on the set. I think the Baldwin does have civil liability as a producer, especially given the complaints made about safety on his set, but it's a total reach for people to think that he shot his DP and Director out of some malicious intent.

I had read about the dissatisfaction of the crew on this set a day before the shooting. It was reported in conjunction with the recently settled strike between the union representing film crews and the industry. The story said nothing about target shooting on set as a safety concern, but rather highlighted a disgruntled feeling amongst the crew relative to disparities in lodging accommodations. Apparently, crew was being housed in cheaper hotels requiring a longer commute from the set in order to save money. When i read about the shooting my first thought was sabotage and I think this is where law enforcement will be looking.

Baldwin has over 30 years of experience on movie sets with guns and blanks. HE should have verified it when all was said and done. He was one of the people writing the checks making the purchases. HE knew there was live rounds on the set. There was NO reason for a gun in his hand at the time of the shooting, as there was no footage being recorded. The armored was not there, because SHE was not required to be there, as the scene did not CALL for her to be there. If Hutchins was his friend, he should have verified those bullets were fake. Assuming his innocence? You are assuming there was zero motive for the women's death. This entire thing stinks of a Columbo murder scene, and you give Baldwin the benefit of the doubt. Everyone is innocent until proven guilty, but to have a trial first you must assume everyone did it before ruling people out.

I agree. State Film & TV offices, city commissions need to attach regulations, safety protocols to tax credits, $$$ incentives. New Mexico draws a lot of LA, NY 🎬 crews, sets, actors. Any set or location needs safety training, rules, set 👷🏻‍♂️.

Bruce as a gun owner’s me and you both know you always treat guns as loaded and would never take someone else’s word and I’m very glad you mentioned that towards the end because actor or not if you are handling a firearm you need to follow basic firearm safety and you are responsible for every round that is fired it really kind of pisses me off how nonchalant he seems about it the film industry needs to either train their actors firearm safety or not use real guns and if they do use real guns they need to use blank firing adapters like the military does when training

@@2001kb yup. That’s how I was taught. You never take someone’s word for it, you always check. However, these are actors that probably don’t deal with guns ever. They probably hate guns... I think they should have to have a bit of training and time with a firearm if they’re going to handle it on a set. Obviously whoever their armorer was, wasn’t very experienced. This never should have happened.

Appreciate your professional legal analysis. I would respectfully suggest their is a cascading chain of gross negligence that directly contributed to the tragic death of Ms. Hutchins and the serious wounding of Mr. Souza. The Rust armorer Ms. Reed was patently unqualified to be solely responsible for firearm safety for the production. The individual(s) responsible for placing her on the Rust set in that capacity and failing to supervise her activities should be held liable. The Assistant Director Dave Halls who took the firearm which Mr. Baldwin fired from a cart outside the church where filming was occurring had NO reason to assume the weapon he selected was indeed "cold". Ms. Reed was not present and a significant amount of time had passed since the firearm props on the cart were last in her possession and control. Mr. Halls has stated he wasn't sure if he checked the firearm prop he took from the cart and therefore it was grossly negligent to bring the firearm on set give it to Mr. Baldwin and announce to him and others present the firearm was "cold". Mr. Baldwin is an experienced professional and has been in several prior productions where firearm props were used. It is reasonable to presume he knew or should have known of industry safety protocols implemented on production and Mr. Halls prior involuntary dismissal from a prior production for failure to properly supervise the use of firearm props on set. Mr. Baldwin's comments about what he did on the Rust set after being handed the firearm prop seem to assert a defense to his gross negligence of reasonable reliance on the representations made by Mr. Halls. However, Mr. Baldwin knew or should have known he could not have reasonably relied on Mr. Hall's statements /representations on the status of the firearm prop he received from him. All the above individuals were or should have been aware there had been at least two negligence discharges of firearms on the Rust production and these prior occurrences should have been met by enhanced and elevated safety protocols in using firearms in subsequent filming. But based on the individuals' above actions subsequent to these occurrences they failed to take reasonable precautions and due circumspection to minimize any future negligent discharges of firearm props on the Rust set.

03:04 - The firearm shown in this video is absolutely _not_ "almost identical to what Alec Baldwin was using." The firearm used on the set of Rust was a Pietta made reproduction of a Colt Single Action 'Peacemaker (Model of 1873). The SA Colt does not have a swing out cylinder as does the .357 shown, so it absolutely _does not_ unload cartridges in the manner shown. To unload a Colt SA requires that one open a loading gate to the right side of cylinder, rotate cylinder to precise location of alignment for each chamber and, for 'spent rounds' (fired cartridges), to slide the loading rod (located alongside barrel) rearward to eject one case. Procedure is repeated for each cartridge. Unfired cartridges do not generally require use of the rod, they will fall out if gate is opened, cylinder rotated to bring chamber to alignment, firearm held upward and / or shaken. To load, the gate is opened, cylinder rotated to precise alignment, one cartridge inserted into chamber, cylinder rotated to next position, repeat, close gate when finished. The cylinder of a Colt SA does _not_ swing shut in the manner shown. The projectile (bullet) of a cartridge is not always lead with a copper jacket. Some have partial jackets, some are lead without jacket, some are 'non lead' projectiles of brass or copper. At the head of a cartridge case is a primer, not a "firing pin". A firing pin is part of a firearm, not of a cartridge. Primers are explosive, propellant ('gunpowder') is combustible. If the Pietta reproduction Colt SA used on the set of Rust was of recent manufacture it has a transfer bar safety (as found on Ruger handguns). To fire a cartridge, the hammer must be pulled back fully which brings the hammer bar into position, then released by pull of the trigger which allows hammer to spring forward and drive hammer bar against firing pin which engages and ignites the primer at head of cartridge case.

I'm disappointed I needed to scroll this far into the comments for this info; this should be at the top. Checking a single action colt would take at least the better part of a minute for most people, not that this any excuse not to do so. It's just that it's not quite as simple as shown in the video. When I take friends out shooting, everyone is told to check every weapon before handing it off, then the person receiving also checks it. Some things are worth "double checking".

Don’t spin the cylinder and don’t slam it shut either! Bruce those are the 2 things that stress the firearm ! When slamming shut it not only stresses the arm but also when it is closed like that is stresses the indexes in the cylinder . That can lead to the cylinder not locking and free spinning when that cylinder closes and lands on that index . This wear can become visible Very quickly even on top quality guns . It also can mess up the timing or cause the gun to fire slightly out of index which can lead a bullet to hit the crown of the barrel and either blow the gun apart or shear a piece of the bullet that would pass to the right or left of the barrel . Keep doing your thing Bruce just my 2 cents from a man who has carried a revolver since I was 18

So the Colt Peacemaker is a wheel gun but the cylinder does not come out like it does on that .357. The cylinder is fixed in place and covered by metal from behind. You have to flip out a little piece of metal to even see what is in the cylinder and rotate it through all the positions to see that every chamber is empty. Modern guns are much easier to check, you just flip out the cylinder and you can see all 6 chambers at once. Also the person holding the gun can see the back side of the cylinder and tell if it's loaded or not. Which isn't the case on the Peacemaker Also everyone keeps saying "prop gun". If it has a firing pin and a chamber that fits actual bullets it is just a gun, there is no prop about it. Edit: Now that I've finished the video you need to cut out the part where you say "All you gotta do... Mr. Baldwin" The gun he was holding literally does not have either of those features you demonstrated.

He also confuses dummy rounds with blanks. The gun was not supposed to be unloaded or loaded with blanks but with dummy rounds which are far more difficult to distinguish from real bullets. After the shooting they looked at the ammo and there was 4 dummy rounds and one spent casing belonging to a real bullet.

@@almac9203 I did not know that part. So even if Baldwin did double check the gun he would not be able to identify the difference between live rounds and dummy rounds. And that is not his job in the least bit. For those who don't know dummy rounds are made to look like real bullets. Let's say we have a scene where John Wick is reloading his gun and the camera is going to see the bullets up close. You use a dummy round which is made to look exactly like a bullet. Or Dirty Harry points his revolver at the bad guy and you can clearly see the bullets in the cylinder. Also dummies.

Rather, it uses an ejection rod. Each cartridge must be ejected manually. Obviously, the people in charge were incompetant and therefore negligent or reckless.
