If she were here in Australia she'd be charged for smoking in her car with a child for a start. Nor do we do field sobriety tests, but roadside breathalysers for alcohol & tongue scraping for drugs. She would've been screwed in under 2 minutes. I find it hard to believe the time & resources that are wasted with these field sobriety tests etc.

So the reason we do FSTs is so if people claim they are such hardened drinkers that they can safely drive with .008 BAC, (which does happen all the time) the FST shows the judge this person absolutely could not safely drive. You might think it's stupid but that's why. FSTs will NEVER clear you of wrongdoing only ever further incriminate you.

@@davidhubbard5196 that's a totally different issue. In Australia we have laws in every state that compel you to automatically comply to a police breathalyser test. We don't have any of this mucking around beside the road bullshit. Any police officer can compel you at any time to take a breathalyser test and it is an offence if you refuse. You will be arrested. There does not have to be any reason for doing so either. We also have random roadside breath tests where police block the road and test any driver that happens to be coming through. No probably cause is needed, you must comply.

I remember when I was 16-17, I had just gotten my license. I got pulled over and to expedite things, I decided to reach in the back for my registration (the car didn't have a glovebox) before the officer made it to the window and it was met with an unholstered sidearm, a *lot* of screaming in my face, and being pulled from the vehicle and searched. To this day, I begin every traffic stop with my hands on the top of my steering wheel, fingers spread so you can see I'm not holding anything. I try my best not to concede my rights, but outside of that, it's a small courtesy thing because they *do* have to worry about someone drawing a weapon on them. I'm genuinely surprised they didn't pull her from the vehicle just as a flight risk- she's already run through barricades. I wouldn't put it past her to start running over people. It's absolutely her privilege being revealed.

I think that her being a mom of a young child, wearing a certain type of clothing, and acting as though she should have a privilege, does have a way of making them treat certain actions with privilege. I think the *appearance* of type of social class plays a role, more than just being a white lady- although, that likely does still play a small part when factoring in to the totality of appearance of privilege. Also, the crime committed is another thing that probably tends to play into it, and if the cop just walks up on you shuffling around even before they can see your face, how many people are around, how much backup the cop has (or lack thereof) or how close their backup is to the scene, and of course, the experiences the cops or their department have had in the past, and how they've allowed those experiences to shape their current temperament and their idea of what a person may be capable of. Is that fair to say? Or nah?

Politeness, cooperation and respect will almost always be beneficial when engaging with the police. My brother was stopped years ago in London for speeding, but they weren’t traffic officers. He got out of the car, apologised profusely, explained he had just bought the car and was taking it out for a quick spin. They ran his personal details, admired the Beamer, advised him to drive more sedately and wished him a ‘good evening’.

I should have had six points taken off my license. it is still to this day I have all my points just because I admitted it, apologised profusely and did everything that they asked: just replying questions about where I was going and whose car it was, taken the breathelizer test with 0.0. And the fine was ridiculously low, only half price because I paid in time and didn't dispute the charges. I was lucky. I went back to driving school for a couple of lessons.

Nah. The only way to win the game with cops is not to play. Ask if you're being detained and if so, ask for a lawyer. Anything else that happens can and will be used against you. Sure, don't be rude, but remember they are not your friends. Cops exist to serve and protect the state *from you.*

Not just the police but everyone deserves to be treated with respect. I get it, it sucks to have to wait in line at the car rental at the airport when the computer is down, but if you think that yelling at the employees will get you faster service, I hate to tell you it won’t. But since I was patient and commiserated with the poor employee you yelled at, I got a free upgrade😅. Pays to be nice😂!

As an Australian watching this with different laws around drinking and driving, astounded at two things. The field sobriety tests!! We’d just be given a breath test straight up and game over (although not sure if blood test is then required to verify). But also legal drinking, limit 0.08 - Sheez that’s high and a little scary. It’s 0.05 in Australia and that’s bad enough, 0.08 is a lot of alcohol for someone driving 🤯

If you're showing signs of impairment under .08 they can and will still charge you for DUI.
@markmatsushima7356
@markmatsushima7356 10 ай бұрын
Bear in mind that for decades it used to be .10%! Typically in the U.S. the Per Se (in and of itself) limits are anything above .00% for anyone under 18, .04% for commercial vehicle operators, and .08% for everybody else. Colorado is unique in that it has a 2 part impaired driving law; .04% to .07% is driving under the influence and .08% on up is driving while impaired. Most driving while impaired laws have 2 parts in recognition that impairment is not always caused by alcohol, that people can be seriously impaired even with small amounts of alcohol, and some will refuse to be tested. First is the .08% limit which in and of itself is in and of itself is proof of the crime. Second is if the driver was “impaired to a noticeable and perceptible degree” on any intoxicant.

I mean, he's kinda wrong though. There's a CHANCE that if she was black, they would act different. But there's also a chance they wouldn't. I've seen hundreds of videos of cops giving too much leeway to black people digging through their things (and sometimes get shot for it), and I've seen hundreds of videos of cops giving NO leeway to white people. So while I agree black people are treated differently sometimes, it's not fair to say we know for SURE that's what would happened. Bruce is a lawyer and seems very analytical so I'm kind of dissapointed to see him fall for the classic "if they were black, guarenteed ____ thing would happen" when the truth is things don't work in 100% like that. Also, sneaky thing Bruce did here was he said a black "man", specifically. Because he knows men are expected to be violent, and women aren't. But for some reason, we don't talk about that

I'm a middle-aged, white, Canadian and sometimes the noticeable privilege is embarrassing. I was pulled over doing 25km (maybe 13miles/hour - guessing) over the limit. I was tired, kids in the car, it was a steep hill and I picked up speed, but still - quite over the limit. I expected a whopping ticket, but instead got a friendly police officer who was sympathetic as it was late and we'd been driving 13 hours. I was ticketed for doing 10 over, so no penalties on my license and a $70 fine. And a number to call if I couldn't afford the fine. Meanwhile, I see people of colour being eye-scanned just for being brown or black in a public place. It really bothers me.

I have a friend who was a cop, he attended 3 accidents in 2 weeks once and one of them had a baby in the back seat with its head smashed in, another had the car seat flung from the car as it was ripped in half and pieces of the parents and baby were on the road…the last one in that two weeks was an 8 year old and a 10 year old who bled out, the mother survived but was unconscious and in a coma for weeks, one kid lost a leg one kid lost half their arm and bled out. All 3 were caused by other drivers getting hit by someone texting, someone drinking and the other one had been smoking weed and was tired and driving home. He also lost his best friend in a car accident not long before that, anout a year before, although he didn’t attend that accident. He had a nervous breakdown and quit the force soon after, took him years in therapy to stop the nightmares.

Your observations about this woman’s white privilege are dead on. And it’s refreshing to hear someone articulate that fact. It’s horrible that a person of color has good reason to fear a routine traffic stop could end their life.

The most rational words have never been stated by anyone before: I'm going to leave my child and dog alone in the car together with the doors locked and the window cracked in a dark parking lot because I'm not going to leave my daughter alone with some _officer._ What do you think I am, stupid? @@godzilla928I'd guess because this person has many experiences dealing with drunk people who are not family or friends. It's also an expectation to refer to a Dr as Dr Surname. The same is true for police. It's not Tom, it's Officer Surname. I watch a lot of these body cam videos and I've never noticed it, but now that it's mentioned, it's absolutely true.

You say, with no evidence to support your claim. Anecdotes aren't indicative of the entire picture, and I can't find a single study about alcoholics preferring to be on a first name basis. It sounds like you're trying to use your personal anecdotes as facts, which is not at all how science works.

I’m happy her kid is young enough not to remember this. One of my most terrifying memories as a kid was in the back of my dads cas coming from a family get-together and grasping my sister’s hands as we both just kept whispering “we’ll be ok” until we got home. I hate people who do that to their kids and have no sympathy for them.
