The chaos reminded me of "My Cousin Vinny" when the attorney went to jail with his clients on the prison bus. A lawyer being busted for pills, two people in the courtroom being busted for a drug sale and then another lawyer trying to jump ship because they are not getting paid enough. It's sort of like the Judge is a substitute teacher and the lawyers and court room guests are unruly students.

The defense attorney busted for prescription pills outside their original container (Jiminez?) had probably been doing so for a long time before without ever being caught. I live in Fulton County, and with all the Trump hysteria and YSL proceedings, the security at the Fulton County Criminal Court is EXTREMELY tight. Patdowns / wandings at the entrance to the building, and also in front of most courtrooms. Local media reported that these pills have been confirmed not to be scheduled narcotics (no further description due to HIPPA laws), but even a prescription-strength pill like ibuprofen (800mg) can easily be bought OTC in 200mg doses. In the case of a prescription heart medication or blood pressure medication, I believe a warning would suffice and shouldn't result in arrest. Once you've been getting away with something for so long, the concept of it even being criminal escapes most people's minds. Another word of advice - if you have one of those 7-day pill cases, you're really pushing it if you take that case outside of your home and travel with it. If pulled over and the container is in plain sight, the cops have the discretion of rendering a warning (imagine someone's grandmother who is on 10+ prescriptions for whatever medical reason). If it's a first time offense and the prescriptions have been accounted for, you're still committing a felony by traveling without the original container, but most reasonable cops will just issue a warning. I always carry my medications (if needed) in the original, up-to-date container. Even if it's just one or two pills in a huge container, I still don't chance it. Every bottle and corresponding paperwork all go into a separate bag in my trunk. Not only that, I keep the paperwork and the receipt from the pharmacy each time there is a refill. Before I leave the pharmacy or grocery store, I highlight all relevant info (dates, phone #s, refill and expiration dates, quantity, MD's name and phone, and their DEA license number as well as the pharmacy's DEA info) before putting the car in gear. Thankfully I don't take a lot of medications, but when my friend's 83 year old grandmother was pulled over for rolling through her neighborhood's 4-way stop sign, and she was in legal hell for 5 months before she was ultimately exonerated by the judge who told her the federal and state laws, then made her repeat them. He also gave her a printout with "plain-speech" state and federal guidelines. Thankfully that judge is still around, as he imparted his wisdom on everyone in the courtroom that day. He agreed that the arrest was not warranted, but the cop had sovereign immunity and apparently used her roll-through stop to expand the scope of his investigation. We live in a very weird time because as we continue to add new laws (state and federal), we very rarely repeal the old ones to the point that you've probably broken several laws from the 1890s that still exist but have not been updated to fit today's world. You're not going to get arrested if you wear a polka-dot dress on Wednesday night past 5:00 PM, but weird laws like that exist and I believe there are several books that show these outdated laws in a comedic presentation. They may be good for a laugh, but at the end of the day, these laws are technically still on the books in every state and you COULD still be arrested but anyone with a reasonable expectation of what is morally right or wrong would probably have the case dismissed.

Just watched an interview with one of the lawyers - the guy who got arrested had HIS OWN PRESCRIPTION PILLS in his bag and you’re allowed to have your own pills in a different container. His apparent crime is having “prescription pills not in original container” because it was in one of those Monday, Tuesday, Wednesday boxes. The “throwing the phone” thing was when he was passing his phone to another attorney to hold for him he fumbled it and it dropped onto the officer, and that charge has now been dropped. Absolutely batshit insane.

There's more to the story about the lawyer who filed to withdraw as counsel. Apparently she texted her colleagues stating that it was a ploy to get the public defenders office to pay her more and she actually didn't want to withdraw - she was under contract from the GA public defender's office. Well now that's come out, she's definitely going to get pulled from the case.

My understanding is that there is a cap on payments. In some jurisdictions in cases with multiple defendants the assigned counsel are asked to take on cases almost as a public service. I understand that the cap is $15,000. If the case is going to take up the bulk of her time for a year, you can see that this doesn't work.

What's this about pills needing to be in their original containers? I'd have to bring a briefcase full of pill bottles if I had to have the original containers for all the pills I take. It's much easier to put the doses I'll need into a separate container so I don't have to have a bunch of pill bottles with me. FWIW, I had a heart transplant 28 years ago and I still take over 30 pills a day. I almost always have a variety of pills in my pocket.

The lawyer is charged with violating Official Code of Georgia Annotated Section 16-13-75. It provides "Possession and control of controlled substances or dangerous drugs by anyone other than the individuals specified in Code Section 16-13-35 [ "An ultimate user or a person in possession of any controlled substance pursuant to a lawful order of a practitioner..."] ... shall be legal only if such drugs are in the original container in which they were dispensed by the pharmacist or the practitioner of the healing arts and are labeled ...". In other words, if the pills were prescribed for the person that had them he or she is not required to carry them in the original container. This law is aimed at caretakers, not patients. Otherwise the patient for whom the drug is prescribed would violate the statute every time he or she took a pill out of the original bottle and put it in his or her mouth. I understand these pills were prescribed for the lawyer that had them.

It's one of those gotcha! laws. In theory, LEO has some discretion if someone gets caught in this situation. Generally though you can expect your meds to be seized followed by an arrest. If you're lucky and the lab that tested them confirms that they're not controlled, you can possibly plead down or have charges dropped. However, you'd have a lot riding on the hope of dismissal or pleading to a misdemeanor.

I'm an out of touch 75 year old woman, and even I know that prescription drugs have to be in the original container. And I would think that if there's any place you have to be very conscientious about following the law, it's a courthouse. 🙄

Actually NO, it not about the courthouse. You or any other person can enter with medication in any container. The rule only applies to anyone interacting with people who are incarcerated.

If you know the law, you're not as out-of-touch as you may think. Stupid people doing stupid stuff all the time - citizens and law enforcement included. A lot of police officer's attitudes and thought process sometimes change for the worse when in uniform vs off the clock. That's where the "us vs them" mentality that binds that fraternal organization together takes root, and yes police forces are definitely fraternal organizations.

Bruce, I have multiple sclerosis and my medications are impossible for me to keep straight. My wife puts them in a pill sorter so I know what to take 3 times per day. Am I in trouble for having 7 days of medication in this sorter? It seems impossible for me to get a day right if I have to use the bottles. It's very debilitating when I get it wrong.

I have a chronic condition and take pain meds; I always always always have them in the most recent Rx bottle whenever I go to a govt building, airport, even a concert, etc. You have to be able to prove it’s legal! Just FYI if anyone needs to go anywhere like that with controlled meds.

That becomes a problem when you are traveling with multiple prescriptions. I am a disabled veteran and take almost a dozen different prescriptions so when I am traveling somewhere for just a couple days it is extremely difficult to bring 10 or so different prescription bottles some containing 90 days worth off meds.

I wouldn't even do that. I've known more than one person that was arrested for "counterfeit narcotics" because either a drug dog was called or it "field tested positive" for something. Then it gets sent to the state lab and is found to be manufactured OTC pills like ibuprofen for example. In one case, a guy I knew didn't have the money to get out and it was also during Covid so he had to be not only in jail but basically on lockdown for like almost a year before the results came back and they dismissed it. They can do whatever they want if they decide to for however long and then be like "Oh, my bad" unless you have the money to get good attorneys and fight your case from the outside it's a giant flaw in the system.

According to the TSA prescription medication does not need to be transported in its original container. It's probably a good idea to though, just easier to prove it belongs to you and you have a prescription for it. As far as ibuprofen you can do whatever you want with it. I personally like to keep meds in clearly labeled bottles, I'll buy a big bottle of ibuprofen because it's cheaper per pill then put a bunch in a smaller ibuprofen bottle and keep in my car for example.
