Yeah no. There have been tons of cases where cold-blooded teens or other below age people have murdered others for unreasonable reasons. Not every case is sympathetic, like this one. I remember a case where a teenager who was 15 or so stabbed her mother to death because of some guy and claimed that her mom abused her despite no evidence ever pointing to that.

An abused, neglected, developmentally delayed 10-year-old child heard his abuser threaten to kill him and his sisters? His parents failed him, the system failed him-frankly, I would have expected anger and literal overkill. Instead, he did what he felt he needed to do and then ran and hid under his covers. The child needed help. While I'm sure he was better off in juvenile detention that he was at home or with his grandparents, but this was just the system failing him yet again.

I felt the same when I heard that, too. My chest ached horribly at the thought of that poor boy suffering so. I have 2 boys, 12 and 9, and to think of a child that young hurting inside like that is just so awful. All they want is love, no matter which flawed way they try to use to express that desire. They want so badly to be loved, instead of constantly rejected. That poor baby's life was over before it had even begun because his parents and the system were so unimaginably despicable. The children should've been removed and rehomed before it ever came close to Joseph reaching that boiling point. I hope he can find a way to be okay when he gets out.

It's going to be a big "If" in that Joseph can be rehabilitated enough to be safely let out into society becuase yeah..literally everything was stacked aginst the kid from becoming "normal" He was already born with a damaged and disabled mind with developmental disorders coming from his mother's drug and alcohol abuse during pregnancy and grew up in an environment of Violence , Abuse and Hate from his Nazi father. Is it any wonder why Joseph became a violent and hateful child? It will take some extremely good therapy and a whole lot of it to even begin to undo the Damage down from his first 10 years of life

Ironically my best friend I had in childhood her step dad was into Nazi propaganda. The only thing we could watch at her house was WWII or Adolf Hitler shows on the History Channel or he would flip out. When she had kids of her own she ended up having over 20 unsubstantiated CPS reports against her. It took years for the father of her daughter, she had 3 kids, to legally take full custody.

Joseph should've been sent to a psychiatric institution, not jail. At least then he can begin putting pieces together about his life and actually DEVELOP. My heart breaks for him. I wish I could just go back in time and scoop him up and save him from the system that failed him. He was given no chance to live an actual life. Nothing can make up for the years that were taken from him. This will affect him until the day he dies. Everyone that was supposed to help him betrayed him and the most depressing part about all of this- is that even after all of the tragedy and every change up until now, Joseph is once again back where he started. Yes and no. He is still a criminal murder is a crime and he knew it was wrong. I however dont believe he truly understood the severity of his actions. I think a juvenile detention center was the best place for him. With his anger issues and history of violence and mental health issues theres no way he would have thrived or been 100% safe for others to be around if he was with his grandma or in the foster care system. I think its pretty likely he would have ended up in jail for one reason or another either way. I just hope that he can be rehabilitated and that his awful parents didnt ruin him for life. Its always heartbreaking seeing a child become a victim to their surroundings.

My biggest issue with this case is that due to his age and developmental difficulties he was in no way able to understand his Miranda Rights. His stepmother in no way should have been acceptable as guardian because she is a victim and has no reason to protect his rights. So his entire confession should have been thrown out in court. The entire system failed this child beginning to end IMO.

To be honest, his confession didn't mean much as it was so clear he did it. That said they still should have insisted he had a solicitor and his step-mom should have been no-where near when it was another family member that was the victim. A decent solicitor would have argued that that the serial abuse, indoctrination and poor intellect meant that he did the only thing within his power to defend himself and the other children from the violence. It was his father that taught him how to shoot and taught him that killing others wasn't just right but desirable. Also he would have thought that there was no point in reporting his abuse to the authorities as they had already failed to do anything about it on numerous occasions.

Not sure if it'd apply in California, but in Virginia there's a statute pertaining to "spontaneous utterance"; in a nutshell, anything a suspect says of their own free will before receiving their Miranda warning is fair game for officers and prosecutors, provided they are not being directly questioned. "I can't believe I shot him" when being asked about what happened wouldn't fly, but if the investigator is walking into the room and the suspect says "I can't believe I shot him", different story. Based on how the story's presented here, it's possible that Joseph offered it up completely voluntarily and unprompted by detectives, and in so doing provided his own silver bullet. A confession isn't an automatic win for the prosecution, but it does make the defense's job considerably more difficult. Now, nobody in the comment thread is wrong in saying that it never should've gotten to this point, especially considering it was already clear that Joseph wasn't fully cognizant of the situation. Solicitor on deck, different adult in the room, and possibly not even walking in until the previous two points were resolved. But from a purely procedural standpoint, the confession would be admissible (at least in one state; as said, CA may play by different rules).

thing is, families that are struggling & need support to provide a safe, caring home to their children SHOULD be kept together. non-hazardous households should not have to surrender their children unless they truly do not have the bandwidth to care for them. this is not that situation. i'm not going to sit here and pretend there are no systemic problems or even that these services are consistently delivered properly - that'd just be disingenuous - but the goal of "keeping families together" is for the benefit of parents who are genuinely trying to support their kids and the children who earnestly need their caregiver attachment. the mission to keep families together is because of those that have been unjustifiably broken apart by the state. this was by no means that mindset at work; to "keep families together" requires investigation that leads to an understanding of the core issues disrupting children's' welfare. this was an inapplicable situation characterized by a profound failure to investigate anyone other than joseph's biological mom.

How this case was handled is shocking. In South Africa, the child would have had a criminal capacity assessment by a panel of psychologists/psychiatrists rather than having inept lawyers decide on this with no understanding of child development, neurodevelopmental disorders and the impact of all of this and abuse on his ability to understand and take responsibility for his actions. Unfortunately thats not how self defense cases work. Killing someone in their sleep is likely never going to be considered self defense in a court of law even with the history of abuse and the verbal threat of his father killing the family. Its a very unfortunate case but i think juvenile detention is the best place for him to be. With his violent past and agression issues on top of other mental health issues if the charges were dropped and he was sent to live with his siblings and grandma or put into the foster care system i feel its likely that he would have ended up in jail one way or another. One can only hope that he is able to be properly rehabilitated not sure if juvenile centers partake in therapy to help these kids out or not but ultimately for the safety of him and others i do think its the best place he could be put.

@@biipo4064 here in michigan (not sure how it works in California but most likely the same or close) he would go to a juvenile detention center (my buddy works at one). it is nothing like prison they receive mental help, schooling, meds if deemed necessary. the problem my buddy repeatedly sees is once they get out the meds stop and they wind up back in. the problem is not the juvenile detention center, its a lack of care once out in some cases. others cases juvie only teaches them to be better criminals and they wind up back in. total lack of proper mental health care here in this nation. i completely agree its the best place for him and good luck to him, it will be an all up hill battle. unfortunately "the nut doesn't fall far from the tree" i'm a nature over nurture type person.

As an educator and a mother of 4 children (all now successful adults) the case of Joseph went straight to my heart😢 This case made me cry. Joseph could have flourished in different living conditions with possibly foster or adoptive parents despite his compromised cognitive abilities. It makes my blood boil how the police failed this 10-year old boy and wonder why he was not first psychologically evaluated? My fear is that Joseph was exposed to more violence and other negative behaviours while in juvenile detection, unless he received excellent treatment. I wish Joseph a better and successful life as an adult ❤

The father was drunk and was known to be mean when he was. Joseph shot him before he went to bed. Most likely. he was truly in fear that his father would kill him if he went to sleep. To Joseph it was immediate. To him it would have been a choice of going to sleep and dying or shooting his father to stop him from burning the house down. It would have been staying alive is now or never. I don't know what occurred that night or what Joseph was thinking, but it wouldn't be out of the realm of possibility that Joseph, known to be a handful, had acted out and his father told him he wasn't listening. To a little boy with diminished reasoning power that would have made the threat a certainty.

I've been watching your videos for years and this is the first time I've taken the time to comment. I was in tears for this boy by the time the video was over. I have never felt this sorrow for anyone in your videos before and just wanted to comment that this poor child never stood a chance with the "parents" he had or the system for failing him the way they did. What a horrible childhood he had… it’s very sad. In Germany, he would not have faced charges. Because here, a child cannot be held accountable for any crime before the age of 14. It’s clearly debatable if this is right in our country, but I do think that this boy was scared that his dad would wipe out the whole family, because of his threat , and he was trying to protect his family the only way he knew : through violence.
