It doesn't have to be. Rich people and corporations will often use cease and desist letters like weapons. They're banking that you don't have enough money to fight them in court so you'll just comply to avoid having to shell out for an expensive lawsuit. That's the biggest flaw of the civil justice system. It's extremely expensive to get sued even if you did nothing wrong. Sure, you can RECOVER legal fees, but you have to front the money. If you don't have the money then you have to handle a complex case without a lawyer. If you do even one thing wrong there's a default judgement against you. In most cases, it's better to just do what rich people or corporations want. That means that they have way more power than you do even though the courts are supposed to treat everyone equally. It's a massive flaw in our system but it would be difficult and expensive for taxpayers to fix. You're also going to have to fight mountains of corporate lobbying to even get a politician to consider it. It would cost corporate America massive amounts of money if they couldn't do stuff like this.
