It is indeed the responsibility of the HOA. The state has given the HOA this authority. This is what deregulation in red states look like. Municipalities have shifted all their governing responsibilities to these HOAs because municipal and state governments are all broke. This is what you get in return for no state income tax. There is no such thing as a free ride.

An HOA is neither one of those things and shouldn't have the power to have cars towed unless the registered owner breaks a non-civil policy like parking in guest parking or a handicapped spot or not having an association parking sticker. Of course if an HOA is a total Karen organization, they could call the police on expired tags and see what happens. The residents of the community should have their their HOA board remove the stipulation in the agreement. Even the police that showed up were telling the tow company that what they were doing was wrong which means the HOA is also wrong.

I was very surprised when I noticed this while installing my 250 gallon fish tank. Did they even have levels in 1860? The floor joists' are actually 2" X 12" rough cut lumber cross braced every 4 feet. Built to last.

Even police can not tow your parked vehicle for expired registration or inspection. They write a citation and move on. Some how an HOA can authorize 3rd party to not only trespass on your property but steal your property? Yeah, I don't think so. These quasi government entities, HOA's, Need to be put on a very, very short leash. Only criminals lurk on other peoples property in the dead of night, that's called stalking. How would the towing company pick these vehicles from the hundreds in the neighborhood? Are they checking everyone? How far out of registration are they? I mean if your reg says September and it's October, that could be 1 day, 1 week or one month.

Remember when I was in college, a cop followed me all the way to my house from the bar and didn’t turn on his lights to pull me over until I was in my driveway. Arrested me for DUI and had a tow truck tow my car out of my driveway; In the morning, I was out and paid the tow for my car back and nothing , no ticket or DUI. Found out later that the tow truck company is the cops cousin.

As a prior officer in pasco county, the deputies are absolutely correct. This is felony grand theft of a motor vehicle. There are so many reasons why this fits the statutory guidelines for that charge. If the tow truck drivers carried a firearm which ive never met one that did not, the charge can be enhanced. Then requiring money to get it back carries more charges. This is absolutely criminal and asinine. An hoa can have rules but can not operate outside the law. Technically if they want to get creative this was organized crime. After forwarding the news clip to my friend that currently works as an attorney he said it is also racketeering and carries a 30 year sentence if convicted.

I work security, I called pd or sheriff on more tow companies for crossing the line of going on to private property to just check the tages. I got one arrested for trying to pull the car out of the person garage. The best part was a repo guy. The repo company lost there state license, the home owners sued the repo company, the lean holder settled out of court writing off the loan as paid in full. But I have stopped and had tow companies from towing cars that were backed in and had pd or sheriff have them drop the cars and did a trespassing warning and told them if they come back and they are armed, just like you said, they be going away for a long time

We had an HOA threaten to come on to our property to tow a vehicle that was in my driveway on a temporary basis. While I had the HOA on the phone (land line) I called the non-emergency police using my cell phone. I asked if the HOA was allowed to tow my personal property from my driveway. The police stated that the HOA can tow but once they do it is considered theft and I can press charges against the HOA. The HOA heard this conversation and my case was closed.

IF the HOA was correct and they were allowed to tow then I would have scrambled to get my truck out of the shop to move our pop up out of our driveway. But since the HOA was not allowed I was able to let my truck get fixed - then we moved our pop up back to its regular storage spot offsite.

It's Florida. Expect that most homeowners have at least one firearm minimum. I know we do not have a duty to retreat in Florida if someone is trespassing on our property. I am not sure if them being on private property is enough to warrant shooting them, but if they are unarmed, and they get caught by the man of the house, I would image they could wind getting beat up if they refuse to get off the property.

@@nofilter.906 The HOA I live in here in Texas has a community swimming pool/clubhouse and two parks that were recently built. They hire contractors to mow, trim, water and pick up trash in the common areas every Wednesday. Not all HOA's are alike. I rarely hear from my HOA until dues are due.

The reporting didn't exactly make the subtleties clear. Yes an HOA can have your car towed off your property (in most states) but they require an authorization by the HOA for each violator. They didn't have that so it was theft.

well think about this if you don't pay your HOA's fees("rent"), in most states they can take legal action against you or they can place a lien on your house, so in other words they can take it. I don't know about you but that sounds like renting and it's hard to get out of an HOA with your house in the HOA. By the way you also have to follow their rules or else they will make you struggle with fines, etc. I guess Mr Ditkovitch from Spiderman 2 would be proud of the HOA's.

I know they are not law enforcement but several cities give them a lot of privileges and they are willing to take to court anyone who refuses to pay them, and don't follow their rules, which is a hassle. There are several people who struggle with them.

You didn't clarify if you mean everywhere or where this took place in the video, but it depends... In my city, a vehicle must be currently registered with a tag to be legally parked in front of my house... And my state says that if a vehicle is registered, it must have insurance. So, even if it's a car that never gets driven, I must have it registered and insured. My city also does not allow any "inoperable" vehicles in the front of the house. In the backyard behind a fence is another story...

It's different if the streets on a gated community were the private property of whatever development company built the subdivision and set up the HOA. Since the Highway Patrol can't pull you off the freeway to write you a ticket for having the wrong color bathroom blinds, an HOA shouldn't be enforcing vehicle registration laws that don't involve noise or safety.

If that happened to me The first thing I do after I find it’s been towed and why, is going to a layer and suing both the HOA AND THE TOWING COMPANY. My vehicle In my driveway is of no concern to the hoa, whether it’s expired registration or not, whatever their rules are. They can tell me, they can fine me, I’ll be pissed off about it, but once you tow my vehicle they are going to pay. I’m losing work(aka pay) and they’ll be on the hook for that, the towing/storage fees and anything else we can tack onto it(inconvenience fees, pain and suffering, any damage, etc).

The tow company is not naive. They are in bed with the DMV, the local government (county) and that county police and likely the county board as well. I have this same problem in Stafford Va because I accused the police of tortious interference in a rental agreement and taking a bribe from an apartment complex. I have a 100 page complaint for civil rights violations with the Richmond,Va FBI for deprivation of rights.

Even law enforcement has no authority to enforce tags on private property. They have to wait till you're on a public highway to be able to cite or tow you. Now in an HOA, you can literally sign your rights away. Once you do that, they can do whatever they want within the contract that you signed.

Most town's, townships and municipalities have ordnances that say you can not have cars that aren't registered and inspected on your property. I think it's unconstitutional as you say, those are regulations for DRIVING so if you aren't driving, they are irrelevant, but our corrupt courts think differently and the sheeple go along with the brainwashing.

Unless you have a warrant from a judge to seize that vehicle. She knows that it’s wrong and would lose in court if they took them to court

If I can ever afford a house, I'll avoid HOA communities if at all possible. "But what if your neighbor paints his house purple??" I'll take my chances with that guy over having my car STOLEN AT 3AM.

My dad always used to say that about my neighbors. Don't you mind that guy with the tractor trailer parked in his front yard, no dad, I mind my own business. Doesn't it bother you the guy around the corner with all the asphalt stacked up in his front yard? No dad. I think it's really weird as he has a really nice house and wonder why would he do that but it's not my house and it's none of my business. I would tell him we all do something someone else doesn't like, I don't want people complaining about me so I don't complain about them. The neighbor that irritated me the most was the two college professors who spend endless amounts of time gardening their yard and no matter what I did, my yard always looked bad next to theirs. My yard looked great compared to all the other neighbors. They also had two big boxers that they would allow to run free the dogs would always go out of their yard and chase you down. They never bit but you just never know when a 60 lb dog is running at you.

@@VivaLasVegasX At least in that situation the thief wouldn't come back the next day and put a lien on my property for displaying an American flag, or fishing, or having an unapproved shed in the backyard, or a plant on the front porch, or sidewalk chalk on the driveway, or whatever else happens to bother the local AARP busybodies.

With the exception of a legal bank or loan repossession I've never understood how the DMV or law enforcement can have a car towed off private property let alone an HOA. An automobile is you personal property and absolutely no one has a right to take possession of it.

As a Realtor, it never ceases to amaze me how many homeowners neglect thoroughly read their CC&Rs (HOA documents) when buying a house and instead blindly trust their realtor. If you don't read your HOA docs and do your due diligence in getting to know everything there is about an HOA for house you're about to spend hundreds of thousands during your inspection period, you'll have no one to blame but yourself. The inspection period is there for a reason.

then the board should suspend that authorization to tow expired tagged vehicles. However. I have a trailer in front of my house. the trailer tag has a 2023 sticker. But if you ran my tag it shows that it expires in 2025. I have the sticker in my glove box. But, regardless, then tow truck driver has no business walking up in my driveway at night. Even the police cannot tow vehicles from private property unless it was involved in a crime or reported stolen.

If it's parked on the street, which I don't think should be allowed in the first place, and you don't have the sticker on, then you are out of compliance. To be compliant, you have to stick the sticker, not just have it in your glove compartment. I personally don't care one way or the other as I think registration is a racket but I'm just saying, legally you have to comply and compliance means sticking the sticker not just paying the tax.

@@jerryw5508 In my HOA neighborhood, well, the past 3, you could not park commercial vehicles, trailers or RVs in the driveways or yards of homes. BUT, even if you did, they couldn't come tow it like you said. They would just send a letter warning about fining you, and eventually putting fines/lien on your home that would be paid whenever you sold your home.
