We are in the process of evicting a tenant at the complex and it has been interesting navigating Colorado's new tenant laws. We try to avoid evictions if we can but the tenants are not always cooperative!

Wish more states would follow Florida's lead in regards to delinquent tenants.

Been doing this for over a decade. Never "work with" them. Never ask why the rent isn't paid. Never let them think you're interested in their excuses. When the rent isn't paid, go straight into eviction. Does the electric company care why you don't pay your bil? No, they just shut it off with ZERO discussion. If your tenants know you handle business the same way, you will avoid huge problems.

It does depend on the history of the tenant but generally if they don’t have the money by the court date they will never have it. The court gives them enough time to come up with the money. Never delay because the courts are slow.

That one where the judge gave them another month, even though they were not on any lease, was insane. What kind of stupid judges do they have in Colorado, communist fools?

Those apartments are basic but the one you showed have great light. I am the weirdo that would get a more basic apartment with good light than a fancier one with bad lighting. Hope you get some great tenants. I have always been a good tenant and found that I tend to gravitate towards great landlords. I don’t know if I’m just lucky but my one bad experience was when somebody else was in charge of the arrangement. My ex was renting from a friend, and when we had problems, he did not want to say anything.

Less and less lower cost housing because you have to deal with so much of this type of crap as a landlord. Tenant was lying through her teeth the whole time about everything. You are a very patient man :-)

But the laws are written such that deadbeats and liars are protected along with innocent tenants. The only constant is that it always costs the property owner money. The inevitable result is fewer affordable housing units and higher overall rents because the landlord has to spread the loss from one deadbeat among all the paying tenants.

​@investfourmore which drives rent up, then people cry for even more government, government steps in and passes more ridiculous laws which drive rent up. It's quite the cycle.

Sadly this person knew exactly what they were doing. Her missing the mediation wasn't exactly a good move on her part. Now she's going to have an eviction on her record.

In this era of housing the tenants feel they are owed a free ride. My mom had always rented and when I got my own apartments I also rented. If I seen that an unexpected expense came up, a large car repair, then I would work the rent out with the landlord. I always worked out deals where I could possibly get the rent lowered by doing the painting inside, or doing the lawns outside. Some landlords had to come a distance to mow. I saved them time . most landlords will work things out. And as you said they know how to work the system. Good luck with the evictions.

Eviction laws here in Germany are insane. Tenants have more rights than us property owners. I am currently evicting a tenant and it is a long process. I am not evicting my tenant for non-payment of rent, but the way the tenant is being trashy with the front and back yard. Both tenants are lazy and they don't want to keep the front and back of the house clean like trimming weeds, grass and other debris. I tried working with them and they just ignore everything I tell them. So, I had to start the eviction against the tenant. Will be glad when I am able to get them out!

I completely understand your issues.I have had a few of the same type! Covid money paying rent for one tenants, and when that stopped, they couldn’t pay rent. We had to evict which is a long drawn out process. The animal situation in one of our rentals just recently cat feces everywhere same house was dog feces once before. You hate to make a no pet policy, but I’m leaning more toward that. I feel your pain. 😣

Simple rule if they don’t have the whole rent or a substantial amount buy the court date then go through with the eviction. In New Jersey landlords could make an agreement where any future rent had to be paid on time plus and agreed amount and the court allowed for an immediate eviction without having to go back to court after the first default.😊

Add 10% for 10 months. Interest free. I'd say that's a good deal.

If she asked for the mediation, why doesn't she have to pay the $100.00 ? You didn't ask for it, so why do you have to pay $100.00?, plus she didn't even show up to the meeting, therefore you should have gotten your $100.00 back ! I would have said, "money doesn't grow on trees." Boy that makes me mad !

I think it costs more than $100, he said in the video that the state pays her half. the state should pay for it entirely since it's their idea

I couldn't be a landlord if judges were taking advantage too. I don't know how anyone does it. At least in the stock market, no people are involved, stealing money from you, and laughing in your face.

Mark, from personal experience, I ALWAYS attend court for hearings. That is, unless my lawyer tells me I'm not needed. The property's mine and nobody's going to care more about the disposition of its issues than me. Good or bad news, I am present. 🖖🙏

If he didn't go. This meant that he wasn't needed. You should tell him to go even if his lawyer tells him he is not needed.

Should give a 5 or 30 day notice as soon as the rent is past due. It's costly to evict but more costly if you accept stories then eventually get amount to filing papers. Tenants will string you out as long as possible before you realize they are never going to pay rent. Ask me how I know.

He can't. He overpaid, and then with the repairs that he had to make, he is probably underwater. Now he has to ride it out.

Not sure if you are being too lenient with delinquent tenants or just need to toughen up your application process , but something needs to give !

Unfortunately with lower-rent units, you get a lot of issues and turnover no matter what you do. Seems to be endemic to that market segment. We have three SFH rentals and a duplex, the latter by far has the most problems.
